Terms and Conditions
ATRA TRADING LLC BIDDER TERMS AND CONDITIONS
1. General Information
Buyer’s Premium: 18%
Sales Tax: 7%
Participation Requirements: Valid credit card with address matching the shipping address is required for bidding approval. Merchandise will only be shipped to the registered address.
By participating in the auction, bidders consent to receive electronic communications from ATRA TRADING LLC, including but not limited to invoices, notifications regarding bids, auction updates, and other relevant information. Bidders acknowledge that such communications may be sent via email to the address provided during registration and agree to ensure that their contact information is accurate and up to date.
Payment Options: We only accept Visa and Mastercard.
Payments: All invoices will be charged to the credit/debit card on file upon the closing of the auction.
Preview: Item viewing may be done via the pictures and descriptions listed on HiBid. Lot previews will be viewable online 2 weeks prior to auction open.
Bidding: Lots are staggered by 30 seconds with 180 seconds soft close
1. Sales terms
ALL ITEMS ARE SOLD AS IS. ALL SALES ARE FINAL. NO REFUNDS, RETURNS, OR EXCHANGES WILL BE ACCEPTED. All auction dates, information, descriptions, and prices for the listed items are determined by the seller and are subject to change.
2. Bidder Registration
As a bidder, you understand and acknowledge that you must register a bidder account with a valid email address. This account must be approved by Atra Trading LLC at their sole discretion, who reserves the right to decline the account for any reason. An application for a bidder account with Atra Trading LLC signifies express agreement to these Terms and Conditions.
3. Bidding
Atra Trading LLC is not responsible for any errors or omissions in the content of the listed items. All written and oral descriptions of the items offered are strictly the opinions of the seller and are in no way to be considered a guarantee as to the age, condition, material, features, or authenticity of said items being sold. By placing a bid, you signify that you have inspected the items in question to the best of your ability and asked any questions you might have of the seller. You understand and agree that in placing a bid, it will be viewed by the seller as a commitment and irrevocable offer to purchase. Bids may not be retracted. In placing a bid, you understand and agree to the following conditions:
a. Auctions may have time extensions at the discretion of the seller. Closing time for listed products may be extended when a higher bid is placed prior to expiration of the listed product.
b. Atra Trading LLC reserves the right to withdraw, postpone, or cancel listed products at our sole discretion, with or without notice and will have no liability to you because of this.
c. Atra Trading LLC reserves the right to void any bid that you place which we believe to be fraudulent, not in accordance with these Terms and Conditions, not made in good faith, or intended to manipulate our services in any way.
d. Any deliberate attempt to influence the sale price of listed items, directly or indirectly, through means such as bidding through secondary accounts, agents, or representatives is expressly prohibited.
e. A bid that is entered by mistake is not grounds for cancellation of the bid as you are responsible for your account and your bids. Therefore, any bid made on your account is binding in accordance with these terms.
4. Shipping and Handling
Atra Trading LLC is not responsible for transportation, delivery, loading, care, incorrect shipping addresses, or risk of loss of any listed products. By purchasing an item, you accept full responsibility for compliance with laws and regulatory requirements applicable to the transportation of listed products. The buyer is held solely responsible for verifying shipping addresses and all costs related to transportation of listed products including but not limited to special handling, loading, transportation costs, taxes, packaging materials, and fees that are required to move listed products to your desired destination. A signature will be required upon delivery of all shipments. Atra Trading LLC will pack and ship items (excluding firearms) approximately 1 to 14 days after payment and will provide tracking information to the email account registered on the buyer’s account. We do not combine shipping for separate auctions.
Shipping costs shall be calculated based on the size, weight, destination, and selected method of transportation for the items. It is hereby acknowledged that these shipping costs are distinct from the prices of the items themselves.
A handling fee of $30 per hour shall be assessed, with a minimum charge of $10. This handling fee shall be in addition to any applicable charges for packing materials (if deemed necessary) and insurance. Furthermore, certain items may incur additional fees due to oversized dimensions or weight, resulting in applicable shipping surcharges.
Prior to the shipment of any items, the buyer shall receive an invoice outlining the final shipping, handling, and insurance fees. All shipments will be subject to signature confirmation upon delivery.
Should a bidder refuse to remit payment for the shipping costs, such bidder shall remain liable for the full hammer price, buyer’s premium, applicable taxes, and any other fees to which they have agreed during the registration process for the auction. In such instances, items shall not be shipped.
All firearms must be shipped to a licensed FFL dealer. Shipping and handling of firearms will be handled by FMZ Guns LLC. The buyer is responsible for checking state and local regulations before purchasing. The buyer is responsible for providing their FFL dealer’s information to the shipper for verification. Ammunition will not be shipped with the associated firearm. Additional charges may be applied for ammunition shipments and may require heavy or oversize charges. All firearms will be shipped via FedEx. Shipping fees for firearms are $40 for standard handguns and $65 for long guns, plus insurance, shipping and handling conditions apply for consolidated shipments (see above). Oversize shipping charges will apply to guns over 45” overall length.
Shipping Timeline
Shipping may be subject to delays due to factors beyond our control, including but not limited to adverse weather conditions, carrier delays, or other unforeseen circumstances. ATRA TRADING LLC is not responsible for any such delays and will communicate any anticipated shipping issues to the buyer as soon as possible.
5. Shipping Insurance
All shipments will have mandatory insurance coverage, which covers only the cost of the items being shipped and does not cover shipping costs or buyer’s premiums. Should any items be damaged during the shipping process, an insurance claim must be initiated. To start an insurance claim, the buyer who accepted the damaged items is required to submit in writing the following information:
a. Buyer Name
b. Buyer Address
c. Bidder
d. Lot numbers of damaged items
e. A detailed description of the damages
f. Several detailed photographs of packaging before opened to be provided to the insurance company
This information must be emailed to sales@atratrading.com. Once all this information is received, we can begin an insurance claim, which can take several weeks to investigate. Buyers may be required to send items back and this is decided on a case-by-case basis. All insurance claims must be filed within 3 days of receipt of the damaged items. If a claim is not filed within 3 days, we will assume your items have been received in acceptable condition.
6. Terms of Payment
Upon completion of the auction, the bidder assumes responsibility to pay the full purchase price as required by the seller. When bidding on an item, you specifically agree that you are waiving your right to file a dispute of any kind with an online venue, a credit card, or any third party as well as the right to initiate a credit card chargeback dispute. Atra Trading LLC will hold the buyer responsible for any costs and fees associated with resolving a failure to make a payment or any related payment disputes. The buyer’s premium, taxes, and any other fees collected during the initial sale are non-refundable under any circumstances.
There will be two invoices sent upon completion of the purchase of a lot. The first invoice is for the final hammer price of the item with buyer’s premium, and sales tax and will be sent out within 48 hours of auction close. The second invoice will be sent once the final cost of shipping and handling has been determined. All payments must be made using a Visa or Mastercard. No other forms of payment will be accepted. No items will be shipped or available for pick up until full payment including shipping and handling charges has been received within 7 days of auction close.
Atra Trading LLC accepts no responsibility for items that have not been paid for within 7 days following the auction closing date. After this 7-day deadline, auction items are forfeited, are no longer considered the buyer’s property, and are subject to be re-sold or discarded at the discretion of the auctioneer. Bidders who do not pay before this deadline will be blocked from all future auctions for interfering with auction sales and can only be unblocked when payment for the hammer price and buyer’s premium they agreed to pay is received. Please carefully review the following important information:
a. Credit card payments will only be accepted from the buyer’s name listed on the invoice
b. Atra Trading LLC does not allow credit card chargebacks for any reason
c. Atra Trading LLC will only ship to the billing address on the credit card being used
d. Any delivered firearms subject to chargeback are considered stolen and will be immediately reported to law enforcement
e. Atra Trading LLC does not store credit card information, and it is the sole responsibility of the buyer to pay all invoices
f. All documents of sale will be delivered to buyer upon payment in full
7. Firearms
Firearms are required by law to be shipped to a licensed FFL business within their state of residence for transfer. It is the sole responsibility of the buyer to contact their receiving FFL and arrange transfer and FFL remittance. A current copy of the FFL must be submitted to FMZ Guns LLC at sales@fmzguns.com by the receiving dealer for each individual invoice. All firearm transfers will take place in strict accordance with all Federal, State, and Local laws. The buyer is responsible for following these laws prior to bidding on any firearms. Only the person with a registered bidder number may take possession of the firearm at the conclusion of the sale – per Federal Law. Buyers may not bid on or pay for firearms on behalf of another party.
Firearms, ammunition, and edged weapons will only be sold to persons 21 years of age or older with a valid photo ID. The seller reserves the right to deny the sale of a firearm to any buyer, for any reason, at any point throughout the auction and sales process as well as the right to withdraw any firearms from the auction and will have no liability for doing so. No returns, refunds, or cancellations will be offered because of ineligibility. If denied by FBI/NICS background check, buyers will not be able to take possession of the firearm. If the bidder determines that they cannot legally own a firearm or accept delivery, the bid is still a valid contract, and the buyer is obligated to pay according to the payment terms described in this contract.
The seller and shipper are not liable for the condition of internal mechanisms or moving parts of firearms or the quality or functionality of any ammunition. Guns are not test fired and internal mechanisms are not inspected unless otherwise stated. All firearm purchases should be examined by a certified gunsmith prior to use.
The designated Federal Firearms License (FFL) dealer for Atra Trading is FMZ Guns, located at 7062 NW 50th Street, Miami, FL 33136. Bidders have the option to pick up their purchased firearms directly from FMZ Guns.
To complete the transfer of the firearm, bidders must present a valid Florida identification card and are subject to a mandatory background check. It is required that all purchasers be either U.S. citizens or permanent residents.
FMZ Guns charges a transfer fee of $35 for the first firearm and $25 for each additional firearm transferred. These fees are payable directly to FMZ Guns at the time of pickup.

All participants must comply with federal, state, and local laws regarding the purchase and transfer of firearms. Failure to comply may result in the cancellation of the purchase without refund.
ATRA TRADING LLC reserves the right to amend these Terms and Conditions at any time. Participants are encouraged to review these terms periodically.
By participating in the auction, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
8. Pickup Scheduling
All auction items must be retrieved by prior appointment if the bidder chooses to pick up the items instead of opting for shipping. To arrange for item pickup, the winning bidder shall contact ATRA Trading via email at sales@atratrading.com. Pickup appointments will be available exclusively between the hours of 9:00 AM and 5:00 PM, Monday through Friday. The winning bidder is required to receive confirmation of the scheduled appointment prior to arriving for pickup.
The winning bidder must present a valid identification and the corresponding invoice (settlement) at the time of pickup. Pickup shall only be conducted by the individual who placed the winning bid; no third parties will be permitted to collect items on behalf of the winning bidder.
No-Show Policy
If a bidder cannot attend a scheduled pickup appointment, they must notify ATRA TRADING LLC at least 12 hours in advance to reschedule. Failure to provide timely notice may result in forfeiture of the item, which will be subject to resale at ATRA TRADING LLC's discretion.
Other Terms
By agreeing to these Terms and Conditions, you hereby waive and release your right to hold Atra Trading LLC responsible for any claims, demands, damages, expenses, or any compensation whatsoever growing out of any defects in the physical condition of any items purchased. You will hold Atra Trading LLC harmless from any claim pertaining to:
a. Use and or resell value of items purchased
b. Provision of proper safety devices and equipment
c. Notification or warning of buyer as to the dangers or risks while operating any equipment
d. Condition of said equipment
Atra Trading LLC reserves the right to commence legal proceedings to recover the purchase price in the event of non-payment. The buyer is responsible for any fees and costs related to such proceedings. You agree to indemnify Atra Trading LLC and any related entities from all demands, claims, damages, costs, fees, or other liability resulting from and breach of these terms and conditions or lack of compliance with any laws, rules, or regulations related to your use of Atra Trading LLC’s sites, services, or any transactions. Any dispute related to the interpretation, execution, and settlement of the terms included in this contract will be resolved amicably between the parties. If an agreement is not reached within 30 days, both parties expressly agree to carry out a mediation process in the Judicial Courts of Miami Dade County, Miami Florida, USA.

Shipping Costs: Buyers are responsible for all transportation costs, including special handling, taxes, and packaging. Shipping costs are separate from item prices and depend on size, weight, destination, and shipping method.
Handling Fees: A handling fee of $30 per hour (minimum $10) will apply, plus insurance, along with charges for packing materials and potential surcharges for oversized items.
Shipping Timeline: Items will be packed and shipped (excluding firearms) within 1 to 14 days after payment. Signature confirmation is required upon delivery. Delays may occur due to external factors, and Atra Trading LLC will notify you of any issues.
Firearm Shipping: Firearms must be shipped to a licensed FFL dealer in the buyer’s state. The designated FFL dealer for Atra Trading LLC is FMZ Guns LLC. Buyers are responsible for contacting their FFL to arrange transfer and submitting a current FFL copy to FMZ Guns LLC at sales@fmzguns.com.
