FULL PAYMENT: All items must be paid for in full before the Bidder leaves the premises. Nothing may be removed until it is settled for. Payment for purchases must be made by Cash, Interac, Visa, Mastercard, Email Money Transfer or Prepaid Credit Card. All sales are subject to applicable sales tax, and a 12% Buyers Premium that is in effect for this auction.
NO WARRANTY: ALL ITEMS ARE SOLD “AS IS”, WITH ALL IMPERFECTIONS. Any descriptions by Auctioneer, Staff and Catalogue are for I.D. purposes only. The Bidder is to examine and inspect the merchandise and accept it the way it is.
DISPUTES: The Auctioneers shall designate the winning bidder after each item is auctioned. If a dispute arises between two or more bidders, the Auctioneers reserve the right to reopen the bidding between the bidders involved. The Auctioneer’s designation of a buyer shall be final.
BUYER’S RESPONSIBILITY: After a Bidder has won the bid with his/her high bid, they have become the new owners of the item, even though they may not have paid for the item yet. The item(s) become the full and sole responsibility of the Buyer at this point, and the Buyer assumes all risk of loss and damage. Buyers should guard their items accordingly.
INJURY AND DAMAGE: Bidder, or any persons attending the auction or otherwise in attendance during the auction acknowledges responsibility for any personal injury or property damage caused by the Bidder or his agent, and further agrees to hold Auctioneers harmless from any personal injury to himself or his Agents and any property damage incurred on auction premises.
The Auctioneers are acting as Owners Agents only.
ADDITION TO OR WITHDRAWL FROM SALE: The Auctioneer reserves the right to withdraw from sale any item(s), or to sell at the auction any item(s) not listed, or to group one or more items or lots into one or more selling lots, or to subdivide any lots into two or more selling lots.
REMOVAL: Removal shall be at the sole expense, liability and risk of the Bidder. Upon failure of the Bidder to remove any item or lot within the time frame announced at the auction, the Auctioneer shall have the option of removing and storing such items or lots at the sold expense and risk of the Bidder.
MISCELLANEOUS: The record of sale kept by the Auctioneer will be taken as final in the event of any dispute. Any bid which is merely a nominal or fractional advance may be rejected by the Auctioneer, if in the Auctioneer’s judgment it may affect the auction negatively. The Auction may be recorded by any means possible – hand written, data entry, digital recording, video camera, etc. Any disputes concerning the Auction will be handled with sole discretion of the Auctioneer.
