BIDDER PAYMENT - All accounts will be settled at the conclusion of the auction. We accept Visa, MasterCard, American Express, and Discover. Your credit card will be charged for your purchases, plus buyer’s premiums, any taxes if applicable. A pre-auction authorization will be performed to establish available credit. PLEASE NOTE, A $25 service fee will be charged to all accounts where the credit card on file is declined and a telephone call or other communication by our department is necessary to collect payment.

PICK UP DAY - Thursday 1 to 5 p.m. August 29th and Saturday 10 - 12 August 31st You must sign up for an appointment to pick up items. Please bring anything needed to remove your items. Labor, boxes, etc. If you or a representative for you can not make the pick up. Please do not bid.
DELINQUENT PAYMENT - The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 4% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser’s failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Noble County, Indiana.
MISSED BIDS - Internet bidding is provided as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly. Under no circumstances shall Bidder have any claim against Hosler Realty & Auctions if the Internet service fails during auction.
PROPERTY DESCRIPTIONS - Hosler Realty & Auctions shall endeavor to describe in detail each item and any pertinent information about it. Hosler Realty & Auctions will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and where is and that they may not return any item they purchase. All bids are final at the close of bidding.
Shipping is available on specific items at the cost of the buyer with a $25 handling charge per lot unless combined in the same box and the cost of shipping will be added to the buyer's invoice. Every attempt will be made to combine smaller items in the same box so only one $25 is charged.
If the winning bidder cannot pick-up the items on the above allotted dates and times, there will be a $25 fee charged for a Hosler Realty & Auctions member to meet the winning bidder on a different date and time.
Paid items must be removed from the pick up location within fourteen (14) days. After fourteen (14) days, any item(s) remaining at the auction facility will be placed in storage. Fee for storage will be $10 per day, per item. If item(s) remains in storage for more than 30 days it shall become the property of Hosler Realty & Auctions.
--- DEFAULT: If the winning bidder refuses or fails to complete the transaction for ANY reason (including, but not limited to, remitting the total purchase amount, or arranging pickup of the item, or paying for shipping of the item), Buyer shall relinquish ANY right to complete the transaction and shall have no rights or interest in the property, as well as forfeit all deposit monies as liquidated damages to Seller. PLEASE BE ADVISED: Various state statutes give Seller the right to pursue legal action against bidders who refuse to complete transactions. This may include (but is not limited to) suit to compel completion of the sale, and/or criminal charges of fraud or other intentional act.
--- AUCTIONEER RIGHTS: Auctioneer Reserves the right to make changes to an auction, to split or combine lots, cancel, suspend or extend the auction event.
--- DISPUTES: If any dispute arises concerning any part of the online auction process, payment of items, quality, quantity of merchandise being sold or if an item has been paid for by a buyer and then the item is no longer available for buyer to obtain. The auctioneer has final say so on resolving said dispute and the auctioneer may elect to refund to the buyer their total funds used to purchase said items as resolving the dispute. If the auctioneer elects to refund the buyer their money, buyer herein agrees that this will terminate all said buyer's rights to any future claims against Hosler Realty & Auctions and the seller concerning this matter.

THE REGISTERED BIDDER IS PERSONALLY RESPONSIBLE, LEGALLY AND FINANCIALLY, FOR ALL AUCTION ITEMS BID UPON WHETHER REPRESENTING ONE'S SELF OR ACTING AS AN AGENT. AN ONLINE BID ACCEPTED AT PUBLIC AUCTION IS A LEGAL AND BINDING CONTRACT TO PURCHASE.
