The Real Estate will be Live on HIbid starting at 4:00 PM on July 13th and will be available for bidding in person on August 3rd at 12:00 noon. Some personal property will be available for bid on Hibid starting on July 20th and Live Bidding will begin at 10:00 am on August 3rd. Other personal Property will sell at Auction Live only after cataloged lots sell.
We reserve the right to end the Real Estate Auction early if we get an offer we believe is better than what the Auction may bring.

1. Registration and deposits
Although there is no obligation to bid, all prospective buyers must register in order to bid in the auction. This is true for both online and live auctions. A earnest money deposit of 5% of the purchase price will collected immediately following the sale for live auctions and within 24 hours for online auctions. These funds must be wired or made by certified check. A personal or business check may be used if prior authorization from auction company is received. Checks will be made out to CENTURY 21 Thacker & Associates, Inc. These funds will be deposited into the Real Estate Brokers non-interest bearing trust/escrow account. These funds will be credited to the buyer at the closing. The property should close in Thirty (45) days unless other terms are posted in the listing. The deposit is non-refundable for any reason. The deposit will be forfeited if closing does not happen by closing date. By signing these terms you are always agreeing to a release of the earnest money.
2. Buyer’s premium
A Five percent (5%) buyers premium will be added to the final bid to establish the final contract price. It is clearly understood by the Buyer, that the Auctioneer represents the seller and that this buyer’s premium in no way implies and agency relationship between the Auctioneer and Buyer
3. Auction Type
Properties may be offered through any of the following auction methods. The auctioneer reserves the right to withdraw any property from the auction, up to the start of the auction without penalty including absolute auctions.
a. Absolute Auction- the property will be sold to the highest bidder regardless of price.
b. Minimum Bid- the property will be sold to the highest bidder at or above the published price.
c. Reserve/Seller conformation- The seller has the right to accept or reject the highest bid.
This Property will sell with owner confirmation.
4. Conditions of the Auction
The Auctioneer’s decision is final in the event of any dispute over any auction matter. The Auctioneer reserves the right to accept bids in any increments he feels are in the best interest of his clients and reserves the right to waive any previous printed or announced requirements. All auction day announcements by the Auctioneer supersede any printed material or any other auction statements made previously. The Auctioneer reserves the right to bid on behalf of any buyer. All auction sales contracts will be presented to the seller for approval. The Auctioneer reserves the right to withdraw any property including absolute sales from the auction, without penalty. Auctioneer reserves the right to cancel the auction, without penalty if the auctioneer believes the outcome will not be in the seller’s best interest. If Seller is not present, the Auctioneer may elect to start or cancel the sale without penalty. The Auctioneer shall be held harmless by the buyer and seller should the property fail to go to successful settlement for any reason. The Seller, Auctioneer, CENTURY 21 Thacker & Associates, Inc, and any of its agents shall not be held liable for any errors and omissions regarding auction property. Buyer assumes the responsibility to check with the appropriate authority/authorities regarding the properties zoning and current and future intended use as wells as restrictions and covenants affecting the property. Bidder(s) have the right and should examine the applicable county master plan and any municipal land use plans and maps for the area the property is located prior to bidding. The Seller, Auctioneer, CENTURY 21 Thacker & associates, and any of its agents assume no responsibility for the information contained in such plans and maps, and assumes no liability for failure of the buyers to review the plans and maps. The contract will not be contingent upon bidder(s) reviewing such plans and maps. Auctioneer complies with all federal, state, and local laws regarding the buying and selling of property.
5. Mortgage Financing
Financing is not a condition of the purchase contract. It is recommended that the bidder does his due diligence in regards to being able to perform within the allotted closing period. The contract will be written as a cash contract. There will be no contingencies for appraisals or inspections. Deposit will be forfeited if failure to close for any reason.
6. Property inspection
Bidder acknowledges that he or his agent has inspected the property and will be purchasing the property “as is-where is”. Property may only be inspected during the posted inspection periods or with written approval from Auctioneer.
7. Warranties
There are no expressed or implied warranties on the property. The property is sold “As is Where Is”.
8. Forms
Bidder acknowledges that he has reviewed the appropriate forms as may be required by the state of Ohio.

B. Disclosure of Agency relationships
C. The disclosure of information and acknowledgement / lead base paint and/or lead base paint hazards required under Title X for homes built prior to 1978.
If successful Bidder, Bidder agrees to execute all necessary forms within 6 hours of accepted bid.
9. Fair Housing

10. Bidders Acknowledgement
By signing below or registering online, you as the successful bidder agree to the terms and conditions stated herein. This document is part of the non-contingent purchase contract for the sale of property that is being offered at Auction this date. This is a public offering open to all.
11. Buyer Agent Co-op
If you as a bidder have a buyers agent, they must successfully register with the Auctioneer 48 hours prior to the auction and before you view the property or register to bid in order to receive a co-op commission.

Hometown Estate Liquidators LLC Terms & Conditions - All Rights Reserved Final sales prices are determined through Public Auction, with competitive Online Bidding. Because we do not set the final sales prices - ALL SALES ARE FINAL except for the guarantees explicitly outlined below.
METALS: Gold & Sterling Silver are guaranteed 100% genuine.
DIAMONDS: All diamonds are 100% guaranteed for authenticity. Diamonds are tested on electronic Presidium Gem Testers and are guaranteed to be genuine. Opinions of size, color, clarity, cut and cutting style can vary greatly among experts and are not warrantied.
COLORED STONES: Gemstones listed as "Genuine" or "Natural" are tested by Presidium Gem Testers and are guaranteed to have the chemical properties of a genuine gemstone. All colored gemstones are considered to have had treatments common in the marketplace such as heat, diffusion, lead glass and flux additives. 99.99% of all colored gemstones on the marketplace have had treatment. Colored gemstones without "Genuine" designation are untested and are considered to be synthetic, man-made or unknown in regards to the original origin of the stone. Watches are verified by professional watch makers by serial number and cross referencing the movement of the watch. We guarantee the movement of the watch, as that is all we can honestly warranty. We DO NOT warranty bands, bezels, crowns, dials, crystals or any other parts making up a watch that could be after market.
COINS & CURRENCY: Hometown Estate Liquidators, LLC guarantees the authenticity of coins and currency. Hometown Estate Liquidators, LLC makes no warranty as to the condition of coins or currency. Coin grading varies greatly based on the experience of grading standards of the individual or grading company, it should be used as a guideline. Hometown Estate Liquidators, LLC does not warranty any basis of grades.
PURCHASE TERMS: An 13% buyer's premium will apply to all purchases. Payment is due within 24 hours of the conclusion of the auction. Real Estate has 5% buyers premium
CREDIT CARD TERMS: Please note that the credit card you place on file will be billed, and the shipping address you provide will be where your items will be shipped to. The auction software uses a credit card verification system to validate credit cards and matching addresses, so ship-to addresses cannot be changed. The auction company reserves the right to require ACH or Wire Transfer payment for any invoice based on risk factors.
DEFAULT: Payment is due immediately following the auction. Invoices not paid within 3 days will be considered in default, and the following actions will be taken. 1. Bidding Privileges Suspended and Account Blacklisted: Your account will be permanently suspended from bidding or participating in auctions on our platform, as well as across other associated platforms where blacklisting measures may be taken. 2. Resale of Items: In the event of continued non-payment, we will proceed with reselling the items associated with this unpaid invoice. However, it is important to note that even if the items are resold, you will still remain responsible for the following fees: • 13% Auction Fee: This fee covers the administrative costs and expenses associated with organizing the auction. • 10% Relisting Fee: This fee covers the costs associated with relisting the items after the initial sale fell through. • To facilitate the collection process, our collection attorney will add a $250 collection fee, as well as any and all court and filing costs associated with this collection. Ohio residents are subject to a 7.5% sales tax. This is an "All Sales Final" auction event, and items are not eligible for returns or exchanges. If the auction company, at its sole discretion, agrees that a return of a product is in the best interest of both parties, it is agreed that under no circumstances will fees associated with the auction, including buyer's premium, shipping, and processing fees, be refunded. All auctions in Ohio are considered to be with reserve unless advertised as absolute. This auction is not absolute, and some pieces may be sold with reserve. The auction company reserves the right to bid on behalf of the reserve price. Hometown Estate Liquidators, LLC uses third-party software for online auctions. The auction company, as well as the software provider, will not be responsible for any interruption in service or errors caused by any means, including power failures or website outages. This auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void a sale, suspend bidding, and re-sell any item/lots that were affected by any malfunction. The decision of the Auctioneer is final, as is the case in a live auction.
IMPORTANT NOTE: When you register for your account, you are assigned a unique username and password. You are responsible for bids made on your account. An online bid is a legally binding contract. If you feel your account has been compromised, it is your responsibility to contact Hometown Estate Liquidators, LLC immediately to suspend your account. Final bids made from your account ARE NOT SUBJECT TO CANCELATION.
NOTICE: For bidders who are new to our website and are unknown to our company, we will likely ask you for more information to verify your identity for purchases exceeding $1,000. In the event that we cannot verify your shipping address with your identity, we will require wire transfer or ACH.
SHIPPING: All shipping and packaging will be done by the UPS Store in Springboro, OH. Items will be dropped off the Monday following the Auction. There is a $1 per item fee for small items and $25 for furniture added to the final price for delivery to the UPS store. You must contact them to arrange shipping and packaging. SALES TAX: No Sales tax at this Auction
WHOLE AGREEMENT: Acceptance of these terms constitute a whole and legally binding agreement between the bidder and the auction company. Note that acceptance of these terms is a requirement to bid in this auction, and that any bidder who chooses not to abide by these terms and conditions are disallowed from bidding. As a condition of your approval to bid in this auction, it is mutually agreed that all disputes that could arise will be tried in Warren County Ohio. As acceptance of these terms and conditions all bidders agree that items are sold AS-IS and are not subject to a credit card dispute. Shipping / Pick Up
Items bought online will be dropped off at The UPS Store in Springboro, Ohio for Shipping by Tuesday August 6th, They will contact you for payment on shipping and packing. Large Items can be expensive so please check ahead of time if you are going to need them shipped.
In Person pickup can be at the property or in Springboro, OH for small items, Large items must be picked up at the property.
Pick up times at the property will be Monday August 5th from 4-8 pm and Tuesday August 6th from 8-10 Am only. Special requests on pick up can be made but must be approved before the Auction. Please bring help loading your items as staff can not help.
Pick up times for small items in Springboro will be Monday through Saturday 11:00 am-3:00 pm.
There is a $1 handling charge for small items being shipped and $25 for Furniture being shipped.
Signature will be required for all items shipped over $100 in value.
