BIDDER’S RESPONSIBILITY:
• Buyer’s Premium: We charge a flat 18% buyer’s premium. Buyer’s premium is 15% and charge card fee is 3%.
• Item Condition: It is the Buyer’s responsibility to determine the condition and usefulness of items being purchased. If you have questions about the condition of an item, please feel free to call our office to get more information. We will answer any questions to the best of our ability.
• Previews: Preview times of all items will be posted on the auction website. NO CHILDREN OR PETS WILL BE ALLOWED IN THE BUILDING DURING PREVIEW OR AUCTION TIMES. There are fragile items and anything broken during preview and/or auction times, you will be required to pay for.
• Bidding: Bidding by any person shall be conclusive proof that the person has read and agreed to these terms and conditions.
• Payment: Buyer’s is responsible for giving accurate charge card information. All charges will be automatically collected at the close of the auction. In the event of non-payment due to an invalid charge card, we will contact the buyer for an additional charge card. If an additional card is not provided, we reserve the right to contact the backup bidder to verify if they wish to purchase the item. If item is not purchased by the backup bidder, it will be placed back into another auction for sale. Failure to honor your bid may result in the loss of bidding privileges. We will accept VISA, Mastercard, and American Express. We do NOT accept cash, checks or cashier’s checks. All credit card payments will be processed through Global Payments. Please contact us prior to the live auction should you change your credit card information.
• Pickup: Proper identification must be presented in order to pick up items. The pickup address will be provided on your paid invoice via email. On pickup day, you will be required to sign a copy of our paid invoice. Once you sign the invoice, you are acknowledging that you have received ALL items listed on the receipt. Some pickup locations are at a private residence (estate sales). Pickup times must be held firm at these locations. We want to extend a courtesy to the homeowner by completing the auction and pickup in a timely manner. If you purchased a lot of multiple items, you must take ALL items whether you want all items or not.
Come prepared to pick up. Please bring your own help to load large items. Also bring boxes, bags or any other packing material needed for you to obtain your items. If you are unable to come during the posted pickup times, please contact our office for further options.
If the above conditions are not complied with, the auction house has other remedies available to them and the seller, by law, including without limitation, the right to hold the purchaser liable for the bid price. Auction house at our option may 1) resell the property publicly or privately, with the purchaser being liable for the payment of any deficiency plus all costs incurred or 2) cancel the sale, retaining all liquidated damages on all payments made by purchaser. Commissions and all other incidental damages will be charged. Auction House is acting as an agent and agent only and is not responsible for the acts of his or her principals.
All persons attending the pickup process of sold goods assume all risks of damage of items or loss to persons and; specifically release the auction house, all employees, real property owners and consignors from any and all liability. Neither auction house or its principals and/or consignors or property owners shall be held liable by reason of any defect in or condition of the premises on which the sale and pickup is held including but not limited to personal injury, fire or theft.
• Pickup Times: Pickup times and location will be published on your paid receipt which will be emailed at the close of the auction. All items must be picked up during this time period. If, however, there are extenuating circumstances that you are unable to pick up items during the posted pickup time, please contact us IMMEDIATELY so that other arrangements can be made. WE WILL NOT STORE ANY ITEMS DUE TO FAILURE TO PICKUP. THERE IS NO GUARANTEE THAT YOUR ITEM WILL BE HERE IF YOU FAIL TO PICK UP DURING THE REGULARLY SCHEDULED PICKUP TIME. If you fail to pick up during the posted pickup times and other arrangements have not been made, we will charge your credit card and your items will be forfeited. We also reserve the right to charge a disposal fee of $100 if any items are left behind or not picked up. Failure to abide by the pickup times may result in loss of bidding privileges.
• Shipping: We offer shipping for any items that will fit into large boxes. Additional charges will apply for packing materials and personnel.
• Indemnification: Buyer shall indemnify Amplify Auctions, LLC against any claims, damages, or liability (including reasonable attorney’s fees) as a result of an injury or other harm suffered by any person and stemming from the sale, whether arising before, during or after the sale. Buyer agrees to indemnify Amplify Auctions, LLC for any damages or losses. Buyer will not hold Amplify Auctions, LLC, its owners/managers, individual property owners, affiliates or its employees, liable for accidents, injury, theft, or incidents related to this purchase.
• Authenticity: Item descriptions are believed to be correct. Neither auction house or seller makes any warranties of any kind with respect to the property. In no event shall the auction house or seller be held responsible for having made or implied any warranty of description, genuineness, authorship, attribution, provenance, period, culture, source origin, fitness for a particular purpose, condition, etc.
• The Auction: The Auction House owner, employees and consignors reserve the right to bid on any items in the auction.
• Governing Law: The laws of the State of Texas govern this agreement. Any and all lawsuits must be filed in Van Zandt County courts and the Northern District of Texas. Privacy Policy Included in these terms and conditions is the privacy policy as outlined on the Amplify Auctions’ website.
Bidder agrees that by signing up as a bidder, you agree and give permission for Amplify Auctions, LLC and it's affiliates to use your email address to send you promotional material regarding current and/or future auctions.
