Lease Agreement: Willow Bend Farm, LLC Hunting Lease 1378 King Road Clifton Springs, NY 14432 518-605-0634 Subject to the terms and conditions set forth in this document, Willow Bend Farm, LLC does hereby grant to ______________________ the right to access and hunt only the following property: ______________________________ ______________________________________________________________________________________________________________________________________________________ The term of this lease shall run from July 1, 2024 through June 30, 2029. The LESSEE hereby agrees to the following: Pay to Willow Bend Farm LLC the sum of _________ per year to be paid no later than June 1 each year unless previously arranged. Payments not received by July 1 will be subject to a $100 late fee. Willow Bend Farm reserves the right to terminate this lease for non payment after June 15. Abide by all local, state and federal hunting regulations as well as those prescribed by Willow Bend Farm, LLC. Lessee may protect leased land from trespass by posting signage and reporting trespassers to the Lessor. Agree to limit the number of hunters (members and guests) in order to protect game populations. Be personally responsible for actions and activities of all persons hunting under this agreement and to act as a representative in all matters regarding all activities carried out under the lease. While on the leased area, the Lessee shall: Observe the rules of safe gun handling; never shoot in the direction of any people, buildings, or livestock; leave all gates as the Lessee finds them; use proper care in crossing fences; and not use alcohol or drugs. Maintain proper vigilance aimed at preventing vandalism, fires or damage by other means to the leased area. Lessee agrees to allow no trash on the premises, to remove all material refuse and litter that they or their guests deposit. See that vehicles are driven only on established roads and to see that all gates are left as originally found. Damage to crops or fields will not be tolerated. Maintain a “No Hunting” or shooting zone within 200 yards of occupied buildings or other designated areas. Adhere to all NYS hunting regulations when discharging your firearm. For everyone’s safety, unsafe hunting practices will not be tolerated. Willow Bend Farm, LLC will maintain a safety first policy. Safety infractions may result in termination of the lease. Please keep records of all game harvested and supply these records to Willow Bend Farm, LLC annually by January 1. Remove all structures placed or constructed by LESSEE from the lease area at termination of this lease unless prearranged with Willow Bend Farm, LLC. Abide by all written rules and regulations supplied at the onset of this agreement. Rules regarding safety and damage prevention of Willow Bend Farm, LLC property are subject to change at any time. Permanent type structures (i.e. huts, treestands) must be placed with care as to not interfere with farming operations or the growth of the woodlot. Willow Bend Farm, LLC will not be liable for these structures. Please obtain permission before cutting any mature trees. Willow Bend Farm, LLC may at anytime log wooded lots. Willow Bend Farm, LLC hereby agrees to the following: That only the LESSEE and their guests shall have hunting rights on the leased land area during the term of the lease except those reserved as follows: _____________________________________________________________________________________________________________________________________________ Agriculture and/or forestry practices are necessary on the premises and take precedence over the rights detailed within this agreement. Hunting shall not interfere with any farm activities. It is mutually agreed that failure to abide by the terms and stipulations of this lease by any person present on the leased area under this lease will constitute cause for the forfeiture of all hunting rights, deposits and fees. LESSEE shall not assign or otherwise convey any rights granted by this agreement to other persons without the expressed written consent of Willow Bend Farm, LLC. Willow Bend Farm, LLC reserves the right to control pest animals on any property. Nuisance species such as coyotes, crows and feral hogs may be taken at any time as the law allows. Where appropriate LESSEE will be given notice and opportunity to harvest pest animals. Lessee recognizes that accidents involving firearms, ammunition, falling trees, hidden ground openings, poisonous plants and animals and various other dangers may forcibly occur on the premises aforementioned. Lessee acknowledges his/her recognition of these dangers and the possible existence of dangerous physical conditions upon the premises such as, but not limited to, those described on the enclosed map. With the aforementioned recognitions in mind, lessee agrees to indemnify and hold harmless, landowner and all of his/her family, servants, employees and agents from all claims, suits, losses, personal injuries, deaths, property liability and all other liability resulting directly or indirectly from or on account of hunting activities engaged in by the lessee or lessee’s guests on the premises heretofore mentioned, said obligation to indemnify extending to the reimbursement of landowner for all expenses and suits including but not limited to, judgements, attorney’s fees and court costs.
