No appraisal or auction estimate should be used as a suggestion of resell value. Opinions of value and quality of stones can vary greatly among "experts" based on current market conditions, availability in the market place, geographical location, gemological equipment types, method of grading and the evaluator's training. Such variances do not constitute any error on either evaluator. BMS does not warranty any opinion of value, or grading evaluation. Items are placed in a professional lighting studio box to enhance the lighting and represent natural lighting from the outdoors. PURCHASE TERMS: A 15% buyer's premium will apply to all purchases in the amount of the hammer price, along with the following payment charges. Payment is due within 24 hours of the conclusion of the auction. SALES TAX: California residents are subject to a 10.25% sales tax. Buyers will be charged all applicable taxes unless SATISFACTORY PROOF OF EXEMPTION is provided to Auctioneer prior to payment. If satisfactory proof is not provided, Buyer will pay all applicable taxes to Auctioneer. No taxes will be refunded once the tax has been collected. Proof of exemption, subject to approval by Auctioneer, includes VALID RESALE CERTIFICATES, EXEMPTION CERTIFICATES, VALID CRS only, and any other documents as governed by applicable local, state, and federal laws deemed acceptable at Auctioneer's sole discretion. Taxes are calculated AFTER the buyer's premium. SHIPPING & HANDLING: Each bidder will pay $5.00 shipping and handling fee PLUS the cost of shipping. Bidder hereby authorizes BMS to charge the credit card provided by Bidder as specified herein. BMS does their best to combine multiple lots for shipping and uses USPS or UPS for domestic (USA) shipping. Shipments will be processed within 72 hours. Once the shipments are processed, the tracking number will be emailed to the bidder. SHIP TO ADDRESSES: The auction software uses a credit card verification system to validate credit cards and matching addresses. The shipping address you provide will be where your items will be shipped to, so ship-to addresses cannot be changed. RETURNS: We want to make your auction experience with BMS as pleasant and pleasing as possible. If you have questions about the merchandise, the time to ask questions is well in advance of the live auction. No returns or refunds are allowed. PAYMENT: Payment of the winning bid amount, buyer’s premium and shipping/handling charge will be made at the time the auction is reconciled by BMS using the credit card on file - except for the exceptions listed below. FORMS OF PAYMENTS: Payments shall be in US currency only. Acceptable forms of payment are MasterCard, Visa, Discover, American Express, and Wire Transfers. Unless prior arrangements are made, invoices totaling more than $2000.00 will be required to pay by Wire Transfer. CREDIT CARD TERMS: 3% credit card fee will be added to all invoices paid by credit card. Please note that the credit card you place on file will be billed, and the shipping address you provide will be where your items will be shipped to. The auction company reserves the right to require ACH or Wire Transfer payment for any invoice based on risk factors. PAYMENT FOR BULLION: All winning bids for Bullion (Gold, Silver, Platinum) will have to be paid by wire transfer and must be paid within 24 hours. Instructions for wire transfers will be sent to the winning bidder once the auction closes. VERIFIED BANK TRANSFER & WIRE TRANSFER TERMS: There is no incoming wire transfer or bank transfer charge to the bidder or invoices paid with this method. DEFAULT: Payment is due immediately following the auction. Invoices not paid within 7 days will be considered in default, and the following actions will be taken. 1. Bidding Privileges Suspended and Account Blacklisted: Your account will be permanently suspended from bidding or participating in auctions on our platform, as well as across other associated platforms where blacklisting measures may be taken. 2. Resale of Items: In the event of continued non-payment, we will proceed with reselling the items associated with this unpaid invoice. However, it is important to note that even if the items are resold, you will still remain responsible for the following fees: • 18% Auction Fee: This fee covers the administrative costs and expenses associated with organizing the auction. • 10% Relisting Fee: This fee covers the costs associated with relisting the items after the initial sale fell through. • To facilitate the collection process, our collection attorney will add a $250 collection fee, as well as any and all court and filing costs associated with this collection. COMMUNICATION: By agreeing to these terms and conditions you are agreeing to receive email, and text notifications from BMS and its affiliates. REQUIREMENTS TO COMPLY WITH APPLICABLE LAWS AND REGULATIONS: It is the bidder's responsibility to ascertain and comply with all applicable federal, state, local and multi-judiciary laws, ordinances, and regulations pertaining to the registration, licensing, handling, possession, transportation, transfer, export, processing, manufacture, sale, use, or disposal of property listed in the invitation. Purchasers or users of this property are not excused from any violation of such laws or regulations either because the United States is the party to this sale or has had any interest in the property at any time. CLAIMS LIABILITY: The bidder or purchaser agrees to save BMS and Consignor harmless from any and all actions, claims, debates, demands, judgements, liabilities, costs, and attorney's fees arising out of, claimed on account of, or in any manner predicated upon loss of or damage to property and injuries, illness or disabilities to or death of any and all persons whatsoever, including members of the general public, or to the property of any legal or political entity including state, local or interstate bodies, in any manner caused by or contributed by the bidder or purchaser, it agents, servants, employees, or any person subject to its control while in, upon or about the sale site and/or the site on which the property is located, or while the property is in the possession of or subject to the control or the bidder or purchaser, its agent, servant or employees after the property has been removed from Consignor's control. RISKS: All risk loss shall pass to Buyer at the time of payment. If Auctioneer is unable to deliver an article sold to Buyer due to fire, theft, or any other reasons whatsoever, Auctioneer shall reimburse Buyer for all monies paid to Auctioneer in respect to the article and Auctioneer shall have no further liability to the purchaser arising from or relating to such loss, including without limitation any damages for loss of profits. LIABILITY AMOUNT: In no event shall Auctioneer's liability to Buyer exceed the purchase price actually paid. A Buyer's claim shall be limited to the amount paid for the merchandise, and shall not extend to any obligation; risk; liability; right; claim; remedy for loss of use, revenue or profit; liability of Buyer to any third party; personal injury; or any other direct, indirect, incidental or consequential damages. Auctioneer is acting as an agent only and is not responsible for the acts of its principles. WITHDRAWAL OF PROPERTY AFTER REWARD: The Consignors reserves the right to withdraw for its use any or all of the property covered by this contract, if a bona fide requirement for the property develops or exists prior to actual removal of the property from BMS control in the event of a withdrawal of this condition, BMS shall be liable only for the refund of the contract price of the withdrawn property or such portion of the contract price as it may have received. CONSIDERATION OF BIDS: BMS as a commissioned agent for the consignor reserves the right to reject any or all bids including all bids under which a bidder would take unfair advantage of the consignor or other bidders, to waive any technical defects in bids, and unless otherwise specified by the consignor or by the bidder, to accept any one item or group of items in the bid, as may be in the best interest of the consignor. BMS reserves the right to bid on behalf of individual consigners, consigning agencies, and itself.
