Terms and Conditions for Online Auction Including Firearms Sales with Shipping
These Terms and Conditions ("Terms") govern your use of the HiBid online auction platform ("Platform") provided by Strait Auctions LLC ("Strait Auctions") for the sale of various items, including firearms. By participating in the auction, you agree to be bound by these Terms. Please read them carefully before using the Platform.
1. Eligibility:
-You must be at least 18 years old to participate in the auction.
-By registering on the Platform, you certify that you are eligible to purchase firearms under all applicable laws and regulations.
2. Registration:
-To participate in the auction, you must register on the HiBid Platform and provide accurate, current, and complete information.
-You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3. Item Descriptions:
-All items listed for auction, including firearms, are sold "as is" and "where is" without any warranties, expressed or implied.
-Item descriptions provided on the Platform are for informational purposes only and may not accurately represent the condition or value of the item.
4. Bidding:
-Bids placed on the HiBid Platform are binding contracts. Once a bid is placed, it cannot be retracted.
-The highest bid at the close of the auction will be the winning bid, granted all reserves are met. If the reserve is not met, the item will not sell.
-Strait Auctions reserves the right to reject any bid deemed unreasonable or suspicious.
5. Payment:
-Winning bidders are required to pay the full amount of their winning bid and 15% Buyers Premium, shipping costs, and any applicable taxes and fees.
-Payment must be made through the payment link sent by Strait Auctions to the winning bidders.
-Failure to make payment within 48 hours may result in the cancellation of the sale and forfeiture of the item.
6. Shipping:
-Strait Auctions will arrange for the shipping of all items to the address provided by the winning bidder.
-Shipping costs, including any applicable insurance fees, will invoiced and borne by the winning bidder.
-The shipping invoice must be paid in full prior to shipping of any items won in the auction.
-Firearms will only be shipped to licensed firearms dealers or individuals with the appropriate permits as required by law.
-It is the responsibility of the winning bidder to ensure that they are legally allowed to receive the firearm in their jurisdiction.
-Strait Auctions will not ship firearms to locations where they are prohibited by law.
7. Compliance with Laws:
-By participating in the auction, you agree to comply with all applicable local, state, federal, and international laws and regulations.
-It is your responsibility to ensure that you are in compliance with all laws regarding the purchase, possession, and transfer of firearms.
8. Indemnification:
-You agree to indemnify and hold Strait Auctions harmless from any claims, damages, liabilities, or expenses arising out of your use of the Platform or any violation of these Terms.
9. Modification of Terms:
-Strait Auctions reserves the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the HiBid Platform.
10. Governing Law:
-These Terms shall be governed by and construed in accordance with the laws of Maricopa County, Arizona, without regard to its conflict of law principles.
