* Announcements (verbal, written, online or otherwise) made on the days of the auction shall be binding over all printed material or oral statements made.
* Bidder inspection is encouraged.
* By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them.
* Bids may not be cancelled - ALL SALES ARE FINAL
* Howell & Sons, Inc., Reserves the right to reject any bid at its sole discretion.
* Applicable taxes will be collected (except in the case of tax exemption with certificate on file).
* Buyer's premium rate of 10% will be charged on all lots.
* Unless special arrangements have been made prior to the close of the Auction, payments accepted are Wire Transfer, Credit and Debit cards. Cards will be charged at the conclusion of the auction. All payments must be made and accepted prior to taking possession of an item.
* A 3% surcharges is applied to Credit and Debit Cards. Wire transfer fees are in accordance with bank policy.
* Items must be removed from 213 Rolling Thunder Lane, Staunton, VA 24401, on Wednesday, October 20, 2021, between 8 a.m. and 5 p.m.
* Shippers must comply with the above unless other arrangements have previously been made.

Bidder is responsible to inspect all items and age, condition, description and authenticity of all items prior to placing any bid. Howell & Sons, Inc., shall have no liability, as a result of any errors in description, cataloging, mislabeling or imperfections, for any item. All lot descriptions are merely a guide and the accuracy thereof cannot be guaranteed or warranted by Howell & Sons, Inc., and any lot or item information provided by Howell & Sons, Inc., or its representatives is not guaranteed.
By placing a bid, buyers acknowledge that they have either inspected the item in question, or obtained a satisfactory condition report. Howell & Sons, Inc., recommends each item be examined thoroughly to determine condition and whether or not items have been repaired, restored, or damaged. This is a consignment auction. Neither Howell & Sons, Inc., nor the seller make any warranty or representation with respect to the correctness of the catalog.
All participants in the auction must register prior to placing a bid. When you proceed to the registration page for the online auction, you are required to furnish your contact and credit card details. This information will be used to generate your invoice. Providing false information when registering, such as a false name, or fraudulent contact information can result in suspension, bannishment and/or legal action. Failure to honor winning bids will also have similar consequences.
Please make sure you know what you are bidding on. BIDS CANNOT BE CANCELLED. All sales are final. If the bid is tied between internet bidders, the earliest bid will be recognized. In the event of a dispute between two or more bidders, the item may be put back up for resale.
Order of sale and bidding increments shall be at the sole discretion of the auctioneer. The auctioneer reserves the right to delete or add items at its discretion. Howell & Sons, Inc., may, at its sole discretion, cancel or postpone the auction, at any time including after beginning an auction.
Howell & Sons, Inc., will not be responsible for technology disruptions, errors, or failures (including disruptions to bidding or the failure to execute, recognize, or record online bids), whether caused by (i) loss of connectivity, breakdown, disruption, or failure of the Online Auction Platform, (ii) breakdown, disruption , or failure of a Bidder's internet connection, computer, or system, or (iii) otherwise. Auctioneer may, but will not be required to, continue, suspend, delay, extend, reschedule, or close the Auction because of disruptions caused by technology failures, even after bidding has commenced.
Howell & Sons, Inc., may use an Online Auction Platform Provider to facilitate the Auction. Under no circumstances will Howell & Sons, Inc., be liable for any failure of the Online Auction Platform Provider to perform all or any of its obligations, or for the failure of any affiliates, employees, agents, representatives, or contractors of the Online Auction Platform Provider to perform their obligations.
Immediately upon the conclusion of the bidding and an item is deemed SOLD, ownership shall pass to the Purchaser. Howell & Sons, Inc., shall not be responsible for any loss or damage to any lot or item once the auction is concluded. Bidder is responsible to insure all purchased items immediately.
Howell & Sons, Inc., may refuse any bidder registration privileges at any auction and/or refuse access to, or remove any person from an auction site for any reason including, without limitation, bid or item tampering, collusive bidding, violation of these terms or inappropriate behavior. All Bidders agree to leave the auction site upon request by Howell & Sons, Inc.
