Auction Company believes that all descriptions are accurate, but in no way guarantees or warranties descriptions or items.
Bidder inspection of items is encouraged prior to bidding. (see preview times and dates)
By placing a bid, bidder signifies and agrees that they have examined the items to their satisfaction or that they have chosen not to personally examine them and accept them "AS IS"
It is the bidders responsibility to determine the condition, age, genuineness, value, and any other determinative factor, Descriptions and photos are offered as a guide only. Bidder shall be sole judge of value.
Auction Company may add or withdraw any item before or during the auction.
Brooks Auction Service reserves the right to resell any items not paid for in full by the conclusion of the stated pick up period. In any such event, the buyer will still be responsible for payment for the original purchase and the costs of collection of this payment and or damages resulting from the resale of the property.
Buyers are responsible for loading and moving all items purchased without assistance from auction company, If you fail to pick up your items, they are forfeit without refund.
All legal proceedings or disputes shall be governed by Tennessee State law.
Auction Company reserves the right to cancel and or reopen the auction due to system failures
TN sales tax will be collected on all items sold unless you have a valid sales tax resale number on file with Brooks Action Service.
If you are a new customer with us, it is your responsibility to make sure we have a signed copy of your tax exempt form.
Interstate Commerce customers are exempt from sales tax if we ship your items to you out of state.
All items must be paid for in full by the end of pick up day. NO EXCEPTIONS!!!

All bidders will incur a $1.00 charge to their credit card for auction registratiion/ bidder verification.
Buyer's premium: 12% if paying cash or Tennessee check, ( NO OUT OF STATE CHECKS)
15%: If paying by credit or debit card.

You must have a printed copy of your invoice to pick up items.
Bidder agrees to hold Brooks Auction Service harmless for any power outages,
insufficient internet connections, or technical issues that may arise.
The buyer agrees to pay all reasonable attorneys fees and other costs incurred by Auction Company in its efforts to collect unpaid funds from the buyer.
