2.) 20% Deposit Day of Sale, balance due upon Court Confirmation. Auction Conducted Subject to a 10 Day Raise Period.
3.) Deposit to be delivered to Dorothy Stanton, Clerk & Master (931) 823-2536 located at 100 E Court Sq., Livingston, TN 38570 ( No later than 4 pm day of Sale).
4.) Purchaser required to sign a Purchase Contract at the conclusion of the sale.
5.) Selling under the direction of Overton County Chancery Court Case No 2024-CV-08. Dorothy Stanton, Clerk & Master (931) 823-2536 located at 100 E Court Sq., Livingston, TN 38570
6.) The Real Property will be conveyed by a Clerk's Deed.
7.) Possession is with Deed at Closing.
8.) Pro-rate current year taxes
9.) The Buyer is responsible for any closing costs.
10.) Selling by a new survey.
11.) Home built prior to 1978, buyer to sign a 10 day waiver on inspection for lead based paint.
12.) Amonett's Eagle Auction & Realty, LLC are agents for the court.
13.)This sale is final with no contingencies and is not subject to the buyer's ability to obtain financing.
14.) Property selling "as is, where is", both surface and subsurface with no warranties guaranteed or implied. Bidders should complete their own due diligence prior to bid-ding. Seller nor his/her agent (Amonett's Eagle Auction & Realty) make any represen-tation or warranty regarding any utility service(s) available to the real property being sold. Bidder/Purchaser has the duty to determine the feasibility of any utility service(s) prior to bidding.

--Terminate or suspend any bidder's registration to bid and bidder account. Bidders guarantee that the information they supply to Amonett's Eagle Auction & Realty, LLC is accurate. Users agree to indemnify and hold Amonett's Eagle Auction & Realty, LLC harmless from any lawsuit based on users’ negligence or activities.
--Suspend bidding on any individual lot and/or all lots in any auction at any time.
--Extend the bidding ending date & time for any individual lot and/or all lots in any auction at any time.
-- International Bidders are required to place a "bid" deposit prior to bidding. If they are a winning bidder, the "bid" deposit will be applied towards the purchase price. If they are not a winning bidder, the "bid" deposit shall be refunded. The "bid" deposit shall be 20% of the maximum bid per lot. The "bid" deposit shall be submitted by wire transfer only.
--By accepting the terms and conditions of the auction: If Purchaser(s) fail to close, Purchaser(s) agrees that Broker is a Third-Party Beneficiary of this Agreement due any damages from the breach, including but not limited to all costs of the sale and any commissions due from the sale, and those damages are enforceable against the Purchaser(s) irrespective and independent of any action taken by the Seller. Any action by Seller or Broker to enforce any rights provided under this agreement shall include all costs of collection and reasonable attorney’s fees. Purchaser(s) agree that the Chancery Court for Pickett County, Tennessee, or the General Sessions Court for Pickett County, Tennessee, depending on the subject matter of the lawsuit, shall be the venue for any action related to this sale. The laws of the State of Tennessee shall apply.
