Bidding on and buying auction assets on www.rjsauctionservice.com and its affiliated websites are subject to the series of obligations and rules below.
All bidders are responsible to become familiar with the terms used on this website and for this auction. Some of these terms include, but are not limited to, the following: Sold "AS-IS, WHERE IS", warranties, expressed or implied; merchantability; with any and all faults and defects; abandoned property, absentee bid, and buyer's premium.
All personal property items in this auction are located in the general vicinity of Topeka, Kansas.
ALL WINNING BIDDERS MUST PAY BY CREDIT CARD UNLESS OTHER ARRANGEMENTS HAVE BEEN MADE WITH AUCTION COMPANY / AUCTIONEER PRIOR TO THE CLOSE OF THE AUCTION. OTHER CONDITIONS MAY APPLY. FOR MORE INFORMATION PLEASE CALL RICK GARVIN AT 785-224-4492.
Additional Terms and Conditions include the following:
1. NOTICE TO ALL ONLINE BIDDERS: All bidding will take place online via Internet-Only auction or as outlined below. Bidding will begin to close on: Tuesday, December 1, 2020 at 6:00 pm Central Time. IF YOU HAVE A QUESTION OR A PROBLEM CONCERNING THIS AUCTION, DO NOT EMAIL YOUR QUESTION - CALL RICK GARVIN AT 785-224-4492. THIS IS PARTICULARLY TRUE AS THE AUCTION BEGINS TO CLOSE!
2. RJ's Auction Service reserves the right to set the bid increments of this auction.
3. Shipping: Shipping is available for the coins in this auction. If you have any questions about shipping please call Rick at 785-224-4492. In addition to expenses for shipping, insurance and signature confirmation there will be a $7.50 handling fee per packaged shipped.
4. Due to COVID-19 there will be NO preview of items in this auction. Bidders are responsible for ascertaining actual current condition careful review of the description, pictures and other supporting documentation. Please bid accordingly.
5. It has been brought to my attention that several of the coins in this auction have been cleaned. Therefore it is highly recommended that you carefully review all the photos and bid accordingly.
6. Every bidder agrees that his or her decision to bid and the amount he or she bids have been based solely on his or her own independent inspection and evaluation of the auction assets regardless of whether that inspection was in person or by use of written description and photos.
7. Bidders are strongly advised by RJ's Auction Service to take care to satisfy all questions or concerns about the auction process, bidding process, availability of shipping of auction assets before placing a bid.
8. If the pictures displayed with descriptions do not appear to match, contact Rick Garvin by calling 785-224-4492 to report the differences.
9. ASSETS DEEMED ABANDONED - CONSEQUENCES - Assets not claimed, or paid for, by the buyer within the time specified in the auction's "Terms and Conditions", if any, may be deemed "abandoned property," regardless of whether payment has been received by RJ's Auction Service or the seller, the transaction between the seller and buyer may be cancelled without further notice or process and those assets may be resold at the sole discretion of the Auction Company.
10. Pickup dates and times for items in this auction will be Friday, December 4, 2020 from 11:00 am to 5:00 pm and Saturday, December 5, 2020 from 11:00 am to 5:00 pm. All times are Central Time. Exact location will be provided to winning bidders but will be in the Topeka, Kansas area.
11. ABSENTEE BIDS - While RJ's Auction Service will make every effort to assist bidders, we general do not accept phone absentee bids. Exceptions may be made on a case-by-case basis. The decision to make, or accept, a phone bid is at the sole discretion of the Auctioneer / Auction Company.
12. BID RESCISSION AND REJECTION - RJ's Auction Service reserves the right to rescind or reject any and all bids.
13. BID RETRACTION - Buyers agree not to retract any bid they place on the site.
14. BUYER'S PREMIUM - A tiered Buyer's Premium will be in effect for this auction, which means, for each lot that sell for $700.00 or less a 10% Buyer's Premium will be added to the high bid to establish the final selling price for that lot. For each lot that sells for at least $700.01 a 5% Buyer's Premium will be added to the high bid for each lot sold to establish the final selling price for that lot.
15. SALES TAX: THERE WILL BE NO SALES TAX CHARGED OR COLLECT FOR THIS AUCTION.
16. AUCTIONEER'S DISCRETION - RJ's Auction Service has full discretion to modify the date and time, order, and any other detail(s) of the sale of any asset, or conduct, of any auction for any reason or no reason at all, including but not limited to technical issues, emergencies, and convenience of RJ's Auction Service or the seller.
17. CHOICE OF LAW AND VENUE; WAIVER - In any matters in which RJ's Auction Service and/or any of its employees, officers, directors, shareholders, agents or assigns is made a party, the law of the State of Kansas shall apply, without regard to its law pertaining to conflict of laws, and any dispute shall be decided in the courts of Shawnee County, Kansas. All claimants consent to the personal jurisdiction of those courts.
18. Auctioneer may waive any provision of these Terms and Conditions. No such waiver shall effect any other provisions of these Terms and Conditions, nor shall it amount to a permanent waiver of that particular provision.
19. If there is anything relevant to these "Terms and Conditions" of auction that you do not understand, please contact RJ's Auction Service before placing a bid.
20. By placing a bid indicates full understanding and acceptance of these terms, along with the agreement to be so bound.
21. Persons registering for this auction acknowledge and agree that their contact information can be added to our data base so they can be notified of upcoming auctions.
22. Disclaimer for all lots with rolled coins; There are several rolls of Lincoln Cents, Jefferson Nickels and Kennedy Half-Dollars. We have not inspected or counted any of these rolls. We are not responsible if the roll is short. They all appear to be full In some cases it is apparent that the rolls / tubes are not full in these cases the coins have been counted and that number will be given in the lot description.
23. Notice to coin buyers: In an attempt to protect you, our Sellers and the Auctioneer / Auction Company the following Terms and Conditions will apply in addition to any other Terms and Conditions listed for this auction. (A) Depending on a number of factors including, but not limited to, first time buyer, buyer not familiar to Auction Company, or amount of purchase you may be required to pay in cash or by wire transfer. (B) For those that are NOT being asked to pay in cash or by wire transfer you MUST pay for your purchases by credit card. IF paying by credit card you MUST enter your own credit card information when your invoice is sent requesting payment. We will no longer take your credit card information over the phone. RJ's Auction Service does not retain any credit card information on file. (C) If you will need your purchases shipped they will ONLY be shipped to the address that you provided when you registered for this auction. If you will need your purchases shipped the following expenses will be added to your invoice: (1) cost of USPS Priority Mail Box / Envelope or actual cost of FedEx or UPS shipping. (2) Cost of insurance for the total amount of your purchase, unless you decline insurance in writing or via email. (3) Cost of signature confirmation to identify person accepting delivery of your package. Please Note: if you DO NOT want your items sent by USPS Priority Mail, or DO NOT want your items insured, or want signature confirmation you MUST notify us in writing or email. (D) Winning bidders will receive an invoice after the auction has ended but please DO NOT pay it if you will need your purchases shipped. You will be sent a final invoice with the total amount due once shipping and other expenses have been added. If you plan on picking up your purchases during the scheduled pickup for this auction please pay your invoice when sent and payment is requested. (E) If you are being asked to pay in cash or by wire transfer we will call you make arrangements to you to pick up your purchases or to provide you with wire transfer instructions.
