By bidding with our auction company, you are agreeing to the following:
-All sales are final. Everything is sold "AS IS" with no guarantees unless otherwise stated by the auctioneer. It is the responsibility of the bidder to assure him or herself as to the condition of items prior to bidding. Condition reports given by the staff of Bontrager’s Auction Service are subjective, and while we strive to be honest, we will not be held responsible or liable for any errors in description. Buyer is responsible for examining items before bidding. Auction company does not take responsibility for buyer's failure to examine. Merchandise is not subject to adjustments once the item has been sold. Because live preview is not currently possible due to COVID protocols, it is the buyer's responsibility to contact the auction company prior to the last day of the auction with any questions or requests for information/pictures at 585-343-4529 or todd@bontragerauction.com.
-Bontrager Real Estate & Auction Service and its staff will not be held responsible or liable for any errors in absentee/left bids or phone bids, nor for the possible failure to execute left bids for any reason.
-Payment is due in full within the time limits posted in the auction. All bidders will pay by credit card (MasterCard, Discover, Visa). Late payment will result in a $25 late fee.
-By bidding with our auction you are entering into a contract with our terms and conditions. You are accepting responsibility to perform your duties as winning bidder, and agreeing that Bontrager Real Estate & Auction Service, its employees, officers, owners, representatives, agents, and consignors will not be held liable for any losses, claims, liabilities, judgments, expenses, fees, or other damages arising from the use of our services, website, auction property, and this site, including property damage, injuries, dispute with another bidder, or breach by bidder of this site. Any liability to a purchaser will not exceed the purchase price actually paid.
-Bontrager Real Estate & Auction Service will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. By bidding with our company you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.
-Bontrager Real Estate & Auctio Service has the right to void any sale, suspend bidding, re-sell any item/lots for any other reason.
-All sales are subject to appropriate sales tax and buyer's premium of 13% of the purchase price. Successful bidders' credit cards will be charged at the close of the auction.
-Bids cannot be retracted once the auction begins.
-Buyers are responsible for making arrangement to pay for and pick up items within the time frames listed for the auction. Bontrager’s Auction Service is not liable for any damage to property left on the auction premises after the auction, whether or not payment has been made. We reserve the right to impose a storage fee of $10 per month for property not picked up within stated deadlines. Merchandise left 1 month after the auction is subject to sale with the proceeds covering storage and auction fees due to the auction company.
-In the event of legal proceedings arising from this contract or from the auction in connection therewith, buyer consents to being subject to the personal jurisdiction of the courts of the State of New York, Genesee County.
-Buyer pays all shipping costs, and is responsible for paying attention to our shipping policies for specific lots. All merchandise shipped is subject to a $10 - $25 packaging/handling fee.
Firearms purchasers must produce current driver’s license, pistol permit (for the purchase of handguns), complete a 4473 Firearms Transaction Record and submit to a NICS background check.
Firearms are sold as-is: The firearm listing is believed to be accurate; however you are encouraged to inspect any firearm you wish to bid on, to confirm specific details. All firearms are sold as-is. Because there is no live preview, you are encouraged to contact the auction company with any specific questions, at 585-343-4529 or todd@bontragerauction.com. It is understood that all sales are as-is, and the failure of the buyer to adequately obtain the information needed, does not negate this policy. After the firearm leaves the building, there will be no refunds, exchanges, or returns.
Requirements for Firearms Purchase: Unless indicated otherwise, all firearm purchases require a Criminal Background Check of the buyer. Purchasers must be over 18 years of age to purchase a rifle or shotgun and over 21 years of age to purchase a handgun. Non-New York State residents can purchase firearms only if they are a Federally Licensed Firearms Dealer (FFL) or if they are having the firearm sent to an FFL holder in their state for transfer.
Purchasers of firearms will be required to fill out one ATF 4473 form (no matter how many firearms are purchased) and submit it to auction staff so that a Criminal Background Check can be conducted. This is in accordance with federal and New York State Law. Please check the dates of the auction to determine when the background checks must be completed for this auction. Dealers must present a copy of their Federal Firearms License (FFL) with an original signature the in order to purchase firearms without complete a background check. Purchasers will not be charged extra for the Criminal Background Check to be completed. There will be no surcharge or fee (other than shipping/handling fees) for firearms to be shipped to an FFL in another state. If any firearm is shipped to another FFL holder for transfer, all shipping charges, materials and labor will be charged to the buyer. Purchase of a handgun requires that the buyer present a valid NY State pistol permit and a valid pistol coupon must be exchanged in order to obtain the gun.
In NY state it is illegal to purchase a firearm for another person. For that reason we ask that all bidders obtain their own bidding number and complete the background check themselves, as the firearm will be registered to the bidder.
If a purchaser is unable to receive a firearm due to a “Denied” status following the Criminal Background Check (or for any other reason), the firearm will be resold , as we have an obligation to pay the consignor regardless of the status of the purchaser. It is illegal for individuals to purchase firearms for someone else. A purchaser must be of legal age, purchase the firearm for him or herself, pass the background check him or herself, and present the required documentation for him or herself.
ID Requirements: Purchasers of firearms must meet both federal and state requirements. A photocopy of your driver’s license as well as other documents used to meet the ID requirements will be made and kept with your records for your transaction:
-Purchaser must provide a government issued photo ID with name, residence address (not PO Box) and date of birth. If the photo ID provides a PO Box, then a combination of government-issued documents may be provided to satisfy the above requirement. The ID must provide the purchaser’s name, gender and date of birth. The issue of the photo ID must be 30 days (or more) prior to the transfer of the firearm. Handgun purchasers must present their original New York State pistol permit. If Bontrager Real Estate & Auction Service staff are uncertain as to whether or not the presented documentation meets the requirement set above, the transfer of the firearm will be delayed until the New York State Police and/or the ATF can be contacted for clarification. Federal Firearms Dealers must present a current copy of their license.
Payment and Terms: All firearms must be paid for in full by the close of the auction. Online bidders will have their credit cards (MasterCard, Visa, or Discover) charged at the close of the auction and will be charged 13% buyers premium and 8% NY state sales tax . There will be no discount in buyer's premium for any other payment type. Sales tax exempt buyers must present valid and current tax exempt paperwork at the time of registration. Tax exempt numbers are routinely checked by the auction company and you will be required to pay sales tax if your paperwork is incomplete or your information is not cleared by the state.
Absentee Bids: All absentee bidding for this auction will take place via internet bidding. Individuals who have a good bidding history with this auction company may call our office to leave absentee bids, which will be uploaded to compete with the internet auction. These bidders must have lot numbers and max bids ready when they phone us. Absentee bids cannot be taken the last day of the auction. Successful absentee bidders are subject to the same pickup/payment guidelines as all other bidders. Absentee bidders will also be required to comply with all state and federal laws regarding firearm purchases, including the completion of ATF form 4473 and Criminal Background Check. All absentee bids are executed competitively.
