Preview Date/Time In-Person Preview for this Auction will be 2 DAYS ONLY, and will be held on Monday, September 28th and September 29th from 10:00am - 3:00pm. ***COVID-19 health and safety protocols are in effect for preview. Masks are mandatory and must be worn during the duration of the preview. You will be required to sanitize your hands upon entry of the facility as well as when you exit the facility. A limit of 10 people will be able to preview the sale at any given time. Social distancing is required for all prospective customers and staff.***

All registration information the Bidder provides to the Auctioneer must be current, complete, and accurate. Otherwise the Auctioneer has the right to decline your registration for the sale, until information is updated and complete. 2. All bidders must be 18 years of age or older 3. As a Bidder you are responsible for any bids placed under your bidding number and password. The security of your Bidder information is your sole responsibility as you, the Bidder, will be responsible for any and all bids placed under your number. If at any time you feel that your Bidder number and password have been compromised due to lack of security on your part you must notify Auctioneer immediately. ITEM DESCRIPTIONS 4. THE ITEMS HAVE BEEN DISPLAYED AND EACH BUYER SHALL BE HELD TO HAVE SATISFIED HIMSELF AS TO THE CONDITION, IDENTITY AND AUTHENTICITY, AND SHALL NOT BE PERMITTED TO MAKE ANY OBJECTIONS AFTER THE SALE ON ANY GROUNDS WHATSOEVER. NEITHER THE AUCTIONEER NOR THE OWNER IS RESPONSIBLE FOR ANY ERROR ON CONDITIONS OF ITEMS. 4a. In-Person Preview is Monday, September 28th and Tuesday, September 29th from 10am - 3pm at 3715 Embro Road, Stratford, Ontario, N5A 6S3. 4b. All items are sold "AS IS, WHERE IS". Once the item is sold, the Buyer shall assume full risk and responsibility for the item. FAIR BIDDING 6. The bidder agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of any transaction being conducted on and during any auction sale. 7. Buyer acknowledges and agrees not to retract their bids. The Highest Bidder shall be the Buyer, and if any dispute arises during the Sale, then the Auctioneer, may at his discretion, put the Lot up again. The Auctioneer's decision is final. The Auctioneer reserves the right to accept or reject any bid and shall control the bidding at all times. ROLE OF THE AUCTIONEER 8. Shackleton's Real Estate & Auction Co. is acting as Agent for the Seller. 9. Auctioneer cannot, and will not, be held responsible for any interruption in service, errors and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void a sale, temporarily suspend bidding and re-sell any items/lots that were affected by any malfunction. The decision of the Auctioneer is final. 10. Despite efforts to avoid withdrawal of item/lots from the sale after they are listed it may sometimes be necessary. Auctioneer and the Owner/Seller reserve the right to do so at any time before or during the sale. The Owner/Sellers of property sold through this Site reserve the right to reject any and all bids in their sole discretion. If there is a reserve on a lot, the Auctioneer and/or the Seller have the right to bid on behalf of the Seller. PAYMENT 11. Settlement for payment for purchases can be made by Visa/Mastercard or E-Transfer. All sales are subject to a 15% Buyer's Premium and 13% HST (Harmonized Sales Tax) if applicable. If you are exempt from paying sales tax you must provide the Auctioneer a copy of your license or fill out a tax exemption form prior to the closing of the sale. Full settlement to be made at the conclusion of the sale. Nothing is removed until paid in full, and invoice received. 12. Merchandise becomes the full responsibility of the Buyer at time of PAYMENT. Any Buyer having someone, other than himself, pick-up his purchases must notify the Auctioneer. Buyer shall be at his own risk and liability at the Owners' property for pick ups, and shall hold the Owner/Seller and the Auctioneer harmless for the Buyer's negligence. Buyer shall also be held responsible for any damage to the Owner's property, caused by the Buyer. PICK-UP / SHIPPING 13. Buyer shall be responsible for making all arrangements for merchandise pick-up and /or removal per specific terms or conditions listed for auction. Please bring your own manpower for loading & moving items, boxes and packaging paper for packaging items. a. Contactless Curbside Pickup for this sale is available: Thursday, October 1st from 8:00am - 6:00pm and Friday, October 2nd from 8:00am - 6:00pm (2 Days Only!) 14. Any items purchased and not picked up within the final removal date (Friday, October 2nd at 6:00pm) will be considered deemed and abandoned and will become the property of Shackleton's Real Estate and Auction Co. 15. Auctioneer reserves the right to resell any property not paid for in full with all funds received by Auctioneer within two days on the online auction item/lots closing date. Failure to pay for item/lots won on this online auction may result in legal action against Buyer. 16. Auctioneer gathers information about Bidders and Owners/Sellers for the purposes of conduction online auctions only. Auctioneer does not, and will not, sell or rent this information. 17. Auctioneer uses email mailing lists to notify its customers about online and live auctions. We will be PROCESSING ALL CREDIT CARDS of successful bidders on file following the closing of the sale. Due to recent events regarding COVID-19 and social distancing measures, we will charge all credit cards on file Wednesday night after the sale closes to eliminate transfer of cash and multiple people using the debit terminal. Therefore, we invite you to get your finances in order so that there are funds available on your credit card by Wednesday night. If you do not receive an email, please check your spam/junk box before calling the office (519-271-2646) to enquire. If your credit card is declined, we will email you to let you know, and it will be your responsibility to make good on your payment within 6 hours of our initial email. Failure to make good on payment will result in being banned from all future online auctions and being banned from other auctions on Hi-Bid. ALL ITEMS MUST BE PAID IN FULL BEFORE YOU CAN PICK-UP OR HAVE YOUR ITEMS DELIVERIED OR SHIPPED TO YOU. We cannot accept cash or debit payments upon pick-up. CONTACTLESS CURBSIDE PICK-UP: Pick-up is available at Shackleton's Real Estate and Auction Co. (3715 Embro Road, STRATFORD, Ontario, N5A 6S3) on Thursday, October 1st and Friday, October 2nd from 8:00am - 6:00pm. In Order to reduce the risk of spreading COVID-19, we ask that you reconsider coming to pick-up your items if any of the following reflects how you are feeling at the time of pick-up: 1. If you should be self-isolating as a result of possible exposure to COVID-19 within the last 14 days. 2. If you have one or more of the following symptoms: fever/chills, cough, shortness of breath, loss of taste or smell, sore throat/hoarse voice 3. If you have had contact with a person who has had a confirmed case of COVID-19 4. If you have traveled within the past 14 days outside of the province of Ontario Should any of these apply to you, we are happy to make alternate pick-up arrangements. If you are unable to come and pick-up your items, we invite you to make arrangements to get your item(s) either delivered (if you live in Stratford,Ontario) or shipped to you. SHIPPING If you would like to arrange shipping, please email auction@shackletons.ca with the address you would like your items shipped to. There is a $10 packing fee per box/lot + shipping costs determined by the shipping company. Canadian Shipping is provided by various 3rd party shipping companies (ex. Loomis Express, Purolator, Dicom, etc.), for International Shipping (including shipping to the US) we use Canada Post. All shipping costs will be charged at the buyer's expense. Please note that we have received updated from our shipping partners and due to the growing concerns around COV-19, shipping may be delayed slightly and carriers will not be collecting signatures at the time of delivery Won lots, will be shipped out within 7 business days of the auction closing.
