All items, including firearms, will be transferring to on-site buyers with a valid Ohio driver's license. Any out-of-state on-site buyers will go thru an FFL dealer. Payment Instructions: Accepted forms of payment are MasterCard, VISA or Discover. Your credit card on file with HiBid will be charged immediately following the auction if you are the successful bidder. If you are an Ohio resident and also tax exempt, you must submit a legible copy of your Vendor License and a Tax Exemption Certificate BEFORE the sale begins with your paddle number and sale name. SPECIAL TERMS FOR FIREARM LOT #40 - ITHACA AUTO & BURGLAR - Seller will complete an ATF form 4 and send to buyer, or for a non-Ohio buyer, to your dealer. Buyer is responsible for completing requirements for fingerprints, photo, and paying a fee of $5.00 as well completing applicable portions of the reverse side of the form 4. Estimated approval time from ATF is 6-8 months. Buyer is fully responsible for payment immediately, regardless of whether or not the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) approves their taking physical possession of the firearm. Whipple Auction will NOT cancel the sale due to BATFE disapproval for any reason.
Shipping fees will be as follows:
$40.00 per long gun
$30.00 per handgun
$15.00 + actual cost of shipping for any other item. Lots will be combined, if possible.
Shipping will be charged separately on your credit card. To save on shipping fees, pick-up is available in Ohio by appointment only. Call 330.477.9365 for non-firearm pickup and 330.495.9990 for firearm pickup to set an appointment. Shipping will begin as soon as packages are prepared and any other terms, if any, have been completed, so we need to hear from you prior to packaging if you are picking up any purchases!

Special Terms and Conditions
1. All persons attending the preview, sale, or removal of merchandise assume all risks of damage to person or property, and specifically release and indemnify Whipple Auction & Realty Inc., auctioneers, employees and third-party vendors from any liability.
2. All property is sold AS IS, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the buyer's responsibility to determine condition, age, genuineness, value or any other determinative factor. Whipple Auction & Realty Inc., hereinafter referred to as Whipple Auctioneers may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Whipple Auctioneers be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. All advertising is derived from sources believed to be correct but is not guaranteed.
3. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Whipple Auctioneers shall endeavor to describe in detail each item and any pertinent information about it. Whipple Auctioneers will not be responsible for any errors or omissions in the description of the merchandise. Bidder agrees that everything is sold "AS IS" and that they may not return any item they purchase for any reason.
4. Whipple Auctioneers is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the Auction. Under no circumstance shall Bidder have any kind of claim against Whipple Auctioneers or anyone else if the Internet service fails to work correctly before or during the live auction. Whipple Auctioneers will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged are encouraged to use the proxy bidding feature and leave their maximum bid 24 hours before the Auction begins. Whipple Auctioneers reserves the right to withdraw or re-catalog items in this Auction.
5. The Auctioneer shall advance the bidding at his own discretion. Whipple Auctioneers may withdraw any item before or during the Auction. The record of the Auction made by Whipple Auctioneers shall be conclusive.
6. When the Auctioneer says "Sold", Bidder assumes full responsibility for the merchandise. Everything MUST be paid for in full at the conclusion of the Auction. Payment shall be made by MasterCard, VISA, Discover. If you are an Ohio resident and also tax exempt, you must submit a legible copy of your Vendor License and a Tax Exemption Certificate BEFORE the sale begins with your paddle number and sale name to office@whippleauction.com prior to bidding. Otherwise tax will be added to the sale if applicable. Unless exempted by law, the purchaser shall pay any and all applicable taxes. Bidder agrees to indemnify Whipple Auctioneers against any claim if sales tax is collected on Bidder's purchases. Bidder agrees that under no circumstance will he/she initiate a chargeback on his/her credit card.
7. Packing, shipping and insurance costs are the responsibility of the buyer. We will ship using USPS or UPS or FedEx. Shipping of oversized items is the responsibility of the buyer. Firearms will be shipped to your local FFL dealer. Please have your FFL dealer email a copy of his/her license to office@whippleauction.com. THERE ARE NO EXCEPTIONS TO THIS RULE! 8. For Pre-1898 and Percussion Firearms, a FFL is not required, but buyers need to email copy of driver's license before shipping of firearms.
9. Whipple Auctioneers may refuse a buyer's number to anyone for any reason. Bidder agrees to provide any identification that Whipple Auctioneers may request, including but not limited to: Driver License, photocopies of credit cards, Social Security card, or Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items.
10. We want you to be happy with your purchases! If you have any questions about the merchandise the time to ask questions is well in advance of the live auction. No returns are allowed.
11. Any controversy or claim arising out of, or relating to this contract, or the breach thereof, shall be settled by arbitration in accordance with the rules of American Arbitration Association, and judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction thereof. Any and all disputes, whether by arbitration or otherwise, shall be venued, heard and decided in Stark County, Ohio.
12. All firearms transfers will be in strict accordance with all Federal, State and local laws. Be sure to check your state and local laws before bidding. If you are unable to purchase or own a firearm according to your residency laws, do not bid on these items. If you bid and find out later you cannot legally own/accept delivery, the bid is still a valid contract that the bidder must pay.
13. Checkout and pickup at our location: The same person to whom the bidder number is registered must be the person to pay for AND pick up the firearms(s) at the conclusion of the sale. Federal Law disallows anyone else from accepting the transfer.
14. Any shipped firearms are legally required to be shipped to an ATF licensed dealer within your state of residence for transfer and pickup. You will be responsible for all shipping and transfer costs incurred. Buyer must have their FFL Dealer email the FFL with the purchaser's name to office@whippleauction.com. Repeat of previous disclosure: No firearms sales will be made to residents of California or Massachusetts for this auction.
15. Long guns will only be sold to persons 18 years of age, or older. Handguns will only be sold to those persons 21 years of age or older. Dealers are bound by these minimum age requirements. Since all firearms sold are collectible items, Whipple Auctioneers does not test the safety or warrant functionality of these firearms. All firearm purchases should be examined by a certified gunsmith prior to shooting. Whipple Auctioneers reserves the right to deny the sale of a firearm to any buyer.
