No Reserve: All lots will sell to the highest bidder without reserve.
No Buybacks: The seller is prohibited from bidding on lots they have consigned to the auction.
Buyer's Premium: A buyer's premium of ten percent (10%) of the high bid will be added to the high bid to determine the final selling price for the auction lot.
Payment: All buyers must pay for their purchases in full when the items are picked up on the load out days. No items removed until payment has been received by auction company. Musser Bros. accepts the following forms of payment: Cash, Credit Cards, Cashiers Check, Personal or Company Checks. ALL CREDIT CARD PAYMENTS WILL HAVE A 3% SURCHARGE ADDED. All out of state checks must be accompanied by a irrevocable Bank Letter of Guarantee, unless know by the auctioneers. Merchandise becomes the full responsibility of the buyer at time of payment and the buyer assumes all risk of loss and damage to property at that time. Musser Bros. Inc. reserves the right to resell any property not paid for in full by the conclusion of the stated pickup period. In any such event, the Buyer will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property.
Sales Tax: 5% sales tax will be collected
Shipping: SMALL ITEMS WILL NOT BE SHIPPED, ONLY FIREARMS IF NEEDED!! All firearms will be processed through Rocky Mountain Discount Sports, a local FFL dealer. Their phone number is (307) 527-6071. You can either pickup the firearms at their store, or they will ship to your local FFL dealer. You, the purchaser, will be responsible for coordinating the shipping and shipping payment and the transfer fee with Rocky Mountain Discount Sports. It will be a $35 transfer fee + shipping per gun. The buyer is responsible for providing insurance for shipping any firearms. Musser Bros. Inc. reserves the right to resell any property not paid for in full by the conclusion of the stated pickup period. In any such event, the Buyer will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property.
Inspection Dates and Time: THERE WILL BE NO PREVIEW OF ITEMS!! All the items in the auction are all located in Cody, WY. We have done our best to describe, determine what is new, used, etc. You are purchasing as-is, where-is, with no warranties or guarantees. If you are not comfortable purchasing without previewing the items, do not bid. We are sorry, but we cannot have preview on this auction.
Pickup: All items with the exception of the firearms, must be picked up from their current location once Musser Bros. Inc. has received and acknowledged payment in full. Buyers are responsible for rigging, loading, and moving all items purchased without assistance from Musser Bros. Inc.. An address of the items will be included on the invoice after the auction has concluded.
Pickup Date(s): November 29, 10 AM & November 30, 10 AM. All items must be removed by November 30! If items are not removed by this time, Musser Bros. Inc. reserves the right to resell the items and retain all sales proceeds as payment for accumulated, unpaid storage and handling.
Auction Ending: Beginning at the stated closing time, the auction software will conclude bidding for one lot each fifteen seconds in catalog order with the following exception: if a bid is placed in the last two (2) minutes remaining for that auction lot, bidding for that lot will remain open for an additional two (2) minutes. Some lots may be grouped together so that a bid on one lot will extend the time on all lots in that group.
Debt Collection and Interest Charges: The buyer agrees to pay all reasonable attorney fees and other costs incurred by Musser Bros. Inc. in its efforts to collect unpaid funds from the buyer. The buyer agrees that a fee of 2% of the outstanding balance per month be added to any unpaid balance due Musser Bros. Inc.. Any debt collection or dispute proceedings will be heard in Park County, Wyoming. Limitation of Liability: If, for any reason, Musser Bros. Inc. is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of Musser Bros. Inc., if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser.

Bidder Information and Security: All registration information the bidder provides to Musser Bros. Inc. shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Bidders must notify Musser Bros. Inc. if they believe that their bidder number and password have been compromised.
Tie Bid or Uncertainty: In the event of a TIE BID or any uncertainty as to offered last and highest bid the Auctioneer has a right to resolve any such at the time by accepting the Bid that the Auctioneer believes is in good faith and was the last, highest and best bid. Auctioneer may open the bidding between the parties at his discretion and option and such decision will be final and binding on affected parties.
