Tom Hall Auctions - CONDITIONS OF SALE: 1. All items are sold "AS IS, WHERE IS" with all faults. Written descriptions are our opinions and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of items being sold. Tom Hall Auctions attempts to catalog every lot correctly and will attempt to point out defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. The Auctioneer encourages all bidders to attend the scheduled preview/inspection which will take place on the dates and times listed above. 2. The successful bidder is the highest bidder acknowledged by the auctioneer. In the event of any dispute between bidders, or in the event of doubt, the auctioneer will have the final discretion to determine the successful bidder. If any dispute arises after the sale, Tom Hall Auctions sale record is conclusive. 3. The purchaser assumes full responsibility for items at the close of the auction. 4. There will be a 13% Buyer's Premium added to the purchase price of each lot and it will be considered a part of the total purchase price. 5. Sales tax - A 6% sales tax will be added to the purchase price on all lots unless the Buyer files a properly completed tax exempt form with our company prior to the auction, unless stated otherwise in the auction terms. 6. PAYMENT - Items purchased through online bidding will be paid for in the manner described. Master Card, Visa, Discover and American Express are the only forms of payment we Accept for purchases. NO PAY PAL, CASH OR CHECKS. HOWEVER, YOU MAY PAY USING MONEY WIRE TRANSFER IF YOU EXCEED YOUR CREDIT CARD LIMIT. We will charge your credit card and you will be emailed a paid receipt by 8pm Wednesday, August 11th, 2016. 7. SHIPPING - THERE IS ABSOLUTELY NO SHIPPING ARRANGED BY TOM HALL AUCTIONS, INC. 8. AUCTION PICK UP: Pick Up 10-4pm August 12, 13 & 14. THE WINNING BIDDER IS RESPONSIBLE FOR REMOVING THEIR ITEMS AND FOR PROVIDING THE NECESSARY VEHICLE AND PERSONNEL DURING THE TIME FRAME LISTED ABOVE unless other arrangements have been made. You MUST have a paid receipt at time of pick up. NO ITEMS WILL BE RELEASED WITHOUT A PAID RECEIPT. NO EXCEPTION. ALL ITEMS MUST BE REMOVED DURING THE ESTABLISHED PICK UP HOURS UNLESS OTHER ARRANGEMENTS HAVE BEEN MADE WITH TOM HALL AUCTIONS. In the event the Buyer fails to remove purchased items, or comply with any other condition herein contained or agreed to, the purchase shall be forfeited to the Auctioneer and the Auctioneer shall retain a possessory lien on all items or lots of the Buyer. The auction deposit and any payment made by the Buyer shall be retained by the Auctioneers for application against such deficiency. The Buyer agrees that the Auctioneer and/or Seller may retain all monies received pursuant to any such resale and apply that money toward any deficiency without further notice. 9. Tom Hall Auctions shall not release the internet bidder from payment under any circumstances. All internet bids are binding. No Exceptions. 10. All perspective bidders must be registered and be approved by Tom Hall Auctions, Inc. There will be "NO" exceptions. If you are not preregistered you will "NOT" be permitted to bid.
