1. BIDDER REGISTRATION. Prior to placing a bid on MSF Equipment Auctions, you must be approved as a bidder. This approval is within the sole discretion of MSF Equipment. 2. BIDDING CREATES A CONTRACT. By placing a bid on MSF Equipment Auctions, you are agreeing to purchase the item at your bid price and subject to all terms and conditions of this auction. 3. ITEM CONDITION. All items sold by MSF Equipment are sold “AS IS, WHERE IS” with NO WARRANTY OR GUARANTEE, EXPLICIT OR IMPLIED. We photograph and describe items to the best of our ability, and we offer the opportunity to preview items in person on scheduled preview days; therefore, it is the responsiblity of each bidder to determine prior to bidding whether an item meets that bidder’s particular needs. 4. BUYER PREMIUM. There is a 15% Buyer’s Premium on all items sold by MSF Equipment Auctions. For example, if you bid $100.00 for an item, you are agreeing to pay $115.00, plus any applicable sales tax. 5. SALES TAX. We collect sales tax on all taxable items, as required by the Texas Comptroller. If you have questions regarding sales tax, please contact the Texas Comptroller’s office. If you are a reseller OF THE TYPE OF ITEMS YOU ARE PURCHASING, or are claiming a tax exemption for any other reason, please complete and sign Form 01-339 from the Texas Comptroller’s website and forward it to us PRIOR to placing bids. If you fail to provide your tax-exemption information prior to bidding, we will not refund sales tax charged, and you will need to file for a refund on your sales tax return. 6. PAYMENT. Auction payments are by credit card registered with Hi-Bid.com only and are processed by Global Payments after auction closes. It is Bidder’s responsibility to ensure that all payment information is current and correct prior to auction closing. 7. PICK-UP ADDRESS AND DATE. Pick-up location is MSF Equipment, 5051 Boyd Blvd, Rowlett, TX 75088. There are scheduled pick-up days designated for auction pick-up. Any pick-up AFTER the designated date(s) is subject to a late pick-up charge of $100.00 per day. Items not picked up after 7 days will be considered abandoned and any payments will be retained by MSF Auctions as liquidated damages for Bidder’s failure to remove items. 8. ITEM REMOVAL. It is Bidder’s responsibility to make all necessary arrangements for removal of items, including, but not limited to load-out assistance, rigging materials, and transportation. We do NOT LOAD or RIG LOADS. We DO offer forklift loading for a separate charge of $25.00 per item. 9. ALL ITEMS ARE SOLD WITH RESERVE. Seller and/or Auctioneer reserves the right to bid on any and all items.
