Closing will be held at Greer, Greer, and Whitfield 114 S Poplar St Paris, TN 38242. - PAYMENT: 10% non-refundable down payment made the day of the sale with the remainder due at closing within 45 days after auction. Acceptable forms of payment are as follows: Cash, Check ( with bank letter to gaurentee funds), cashier's check, or wire transfer. Please note that a transfer fee will be charged to the buyer if that is the preffered payment method. - All sales are final. The property is being sold "as is, where is" without warranties or gaurantees by Kail Auctions, LLC Tennessee Real Estate Company, or the sellers. - Real Estate will sell with a marketable title. - Country taxes will be prorated - Acreage and square footage of the real estate has been obtained from Tennessee Property Data and is believed to be accurate. No warranties or gaurantees are made to this effect. - Possession of the property will be given at closing. - There are tenants that rent a RV hook up on the property. There is not a written contract with said tenants. Buyer is responsible after closing for establishing rent and utilities with the tenants. - Bid(s) accepted by the auctioneer create(s) a binding contract. No one should make a bid that he/she does not intend to honor or is not financially able to honor. There will be no contingency in the contact subject to the purchaser obtaining long term financing. - Failure to pay the balance will require the purchaser to forfeit his/her earnest money and be subject to all legal remedies and terms stated in the contract. - The purchaser does hereby acknowledge that the real estate is being sold at public auction, and that a prerequisite to bidding is that all property is purchased absolutely "as is" with no warranties whatsoever either expressed or implied. - Purchaser has had the opportunity to inspect this property and will make all bids and purchase of said property as a result of their inspection. - All bids will be settled from the auction stand by the auctioneer and his decision will be final. Property shall be displayed for thorough public inspection and sold as is, where is, and without recourse for any refund or reduction of the sale price. On the fall of the auctioneer's hammer or other acknowledgment of a successful bidder on a lot, title to the property in that lot will pass and the successful bidder there upon assumes full risk and responsibility for the purchased property. The highest bidder shall be the buyer. If any dispute arises, the auctioneer shall have absolute discretion to settle it and put any disputed lot up for sale again.
