Starcliff Resale LLC does not give or make any type of guarantee or warranty regarding the lots to be sold, implied or otherwise. Expect imperfections. Please read the lot descriptions for details/damages on items. All buyers are urged to physically inspect the item prior to bidding during the inspection period. No bids can be withdrawn once submitted before, during or after the auction for any reason. BUYER also agrees that any oral representation made by the Starcliff Resale LLC shall not modify these "AS IS - WHERE IS WITH ALL FAULTS" terms. BUYER understands that any description given, written on the equipment, or advertised by any other means is not guaranteed, and BUYER will rely entirely on their own inspection. All information and descriptions contained in advertising this sale are believed correct, but no responsibility is assumed by Starcliff Resale LLC for any errors or omissions. Stock photos are sometimes used to show a product for sale. We try to include a photo of the actual item being sold. NOTE: even though a stock photo is used, please be sure to view ALL photos and read the entire item description BEFORE placing a bid. An item may have a defect that would be shown in those photos or explained in the item description. Buyer's Premium & Sales Tax: A buyers' premium of 15% will be added to the high bid to determine the final selling price for the auction lot. Sales tax is calculated on total sales price which includes Buyer's Premium (therefore Buyer's Premium is also taxable). Michigan 6% sales tax applies to all in-state invoices unless a valid Resale Tax Exemption form is placed on file with our office. Payment: Payment is due upon the auction's closing. Your card on file will be charged immediately after the auction closes. In the event that a card is "declined", buyer will be responsible for any fee occurred by Starcliff Resale LLC. No items will be removed from premises until payment has been received. Starcliff Resale LLC reserves the right to resell any property not paid for in full by the conclusion of the stated pickup period. In any such event, the Buyer will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property. PICK UP Dates/Times Load out will take place the following Friday, Saturday, Sunday after auction closes. Friday - 9:00am - 5:00pm Saturday 9:00am - 3:00pm Sunday by appointment only Pickup: All items, must be picked up on the published move out date(s). Buyers are responsible for rigging, loading, and moving all items purchased without assistance from Starcliff Resale LLC and staff, so please bring appropriate help upon pickup. Auction staff will not have tools available for disassembly. Please bring any necessary tools with you at time of pickup. Items NOT removed within pick up deadlines will be considered abandoned and forfeited. NO STORAGE AVAILABLE. IF YOU CANT PICK UP YOUR ITEMS DURING SCHEDULED LOAD OUT HOURS PLEASE DON'T BID RESALE: Starcliff Resale LLC reserves the right to resell any property not paid for in full on auction day. The Buyer shall be responsible to Starcliff Resale LLC for any expenses of resale and collection and damages resulting from the resale. **Very important: You MUST pick up your items on the specified date(s). If not, you understand and fully agree that you will be charged $10 per day (per item) for storage and any additional charges such as labor and hauling fees. Auction Ending: Beginning at the stated closing time, the auction software will conclude bidding for one lot each 10 seconds in catalog order with the following exception: if a bid is placed in the last 3 minutes remaining for that auction lot, bidding for that lot will remain open for an additional 2 minutes. Some lots may be grouped together so that a bid on one lot will extend the time on all lots in that group. Debt Collection and Interest Charges: The buyer agrees to pay all reasonable attorney fees and other costs incurred by Starcliff Resale LLC in its efforts to collect unpaid funds from the buyer. Limitation of Liability If, for any reason, Starcliff Resale LLC is unable to make available or deliver any purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of Starcliff Resale LLC if any, shall be the return of monies paid to purchaser. Non Paying: We have zero tolerance for non-paying bidders and we will proceed aggressively to rectify such situations. In addition, non paying bidders information will become public information and distributed through multiple venues. Buyers agree to not conduct a credit card dispute in the event that Starcliff Resale LLC charges your card and you do not pick up your items. In the event that the buyer disputes a credit card transaction, buyer agrees to pay a $200.00 fee to cover the costs incurred to take legal action against buyer. Bidder Information and Security: All registration information the bidder provides to Starcliff Resale LLC shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Please contact HiBid in the event that your account may have been compromised. We do not sell or rent your personal information to third parties for their marketing purposes. Bidding Errors / Software Malfunctions: Starcliff Resale LLC will not assume any bid is an error. No bids can be withdrawn once submitted before, during, or after the auction for any reason. In the event there is a software malfunction, the bidder will not hold Starcliff Resale LLC accountable. Buyers will not be refunded for any bidding error that is not the result of a software malfunction. In the event there is a software malfunction, Starcliff Resale LLC reserves the right to pause, cancel, extend and/or reopen the auction. We are looking forward to working with you!
