All buyers herby certify that they have read and fully understand the terms and conditions listed below and they agree to be bound thereby. It is the buyer's responsibility to understand all the terms and conditions prior to submitting any/all bids.

Additional $25 Fee required for all vehicles/trailers, must be paid by cash at time of pickup. If it has a title, the title will be mailed to purchaser within 30 days of purchase.
Invoices over $500 must be paid by cash or wire transfer only.
Any items/lots left after checkout dates will be considered abandoned. Removal is the buyer's responsibility, please bring manpower for large items as there may not always be someone there to assist you. We will do our best to have your winning lots together and brought outside prior to your pickup appointment, with the exception of large/heavy lots.
Each item and/or lots sell in an "As Is" condition, no guarantees, no refunds. Please review all lots prior to bidding, once a bid has been placed it cannot be retracted. Auction company makes no guarantee, we will do our best to show defects and provide condition to the best of our knowledge.
If you are the winning bidder on any lots, you will receive an invoice to the email address you registered with. The pickup location and times will be provided on your invoice. If you do not receive this email please check your junk/spam folder. The pickup times are also provided on the Auction Description, if you are unable to meet these requirements please do not bid. There will be no refunds.
Bidder acknowledges that an auction site is a potentially dangerous place. Every person at the auction site at any time, shall be there at their own risk with notice of the condition of the premises and the activities thereon and Bidder shall so advise his agents and employees. No person shall have any claim against auctioneers, their agents, employees, and/or principals for any injuries sustained, nor for damages to or loss of property which may occur from any cause whatsoever.
Auctioneers, at any time, and at their sole discretion, without notice or liability to buyer may:
(a) withdraw or cancel the sale of any lot,
(b) offer any Lots in groups or with privilege,
(c) have hidden reserve on any lot, or
(d) bid on any lot personally.
We reserve the right to cancel and/or reopen the auction in the case of system failures.
Bidding:
When you bid your max, the current bid price does not automatically go to your max bid. In the case there is a reserve on the item, then the current price will go to your max or the reserve price, whichever is lower. When another bidder bids it will increase your bid automatically up to your max in the increments specified. If two (2) people bid the same max bid, on the same lot, the 1st person to place the bid will be the winning bidder.
Soft Close: All bids placed (that outbid the current winner's maxbid) within two (2) minutes of the lot closing will increase the time by an additional two (2) minutes.
Maher Auctions is not responsible for any bids that did not go through. To insure your bid was successful we strongly encourage you to enter a max bid prior to lots closing.
There shall be no guarantees or warranties, expressed or implied, statutory or otherwise of any nature whatsoever in respect of the lots offered at the auction. Each & every lot will be sold "As Is, Where Is'. Specifically, but without limitation, Auctioneers make no representation or warranty that any of the Lots:
(a) conform to any standard in respect of safety, pollution, or hazardous material to any standard or requirement of any applicable authority. law or regulation, or
(b) are fit for any particular purpose, or
(c) are merchantable or financeable, or
(d) are of any particular age, year of manufacture, model, make or condition
Bidder agrees he/she has satisfied theirself and is not relying on Auctioneers, nor are Auctioneers liable, for any matter in respect of the above. Bidder further agrees to repair, at their cost, any lot purchased at the auction to a safe operating condition and, without limitation, to a condition which meets any standard or requirement of any applicable authority, law or regulation. Including those concerning any use to which the Lot may be put.
All sales are final, with no guarantee, no refunds, no exceptions. Please preview items before bidding.
When using online auction services, you are making a firm commitment to purchase items into a legal binding contract. Bids may be not cancelled or retracted for any reason. Nonpaying bidders or fraudulent bidding will subject you to legal recourse. Maher Auctions may refuse any bids for not complying with these terms and conditions.
Payments:
If you are paying cash please put this in the "note to auctioneer" box at registration or let us know prior to auction closing. *$10 Minimum for all credit card transactions.*
If charges are declined by the credit card processor, a non-sufficient funds charge for $25.00 will be charged each time processing is denied. The buyer will be notified by email and/or text of NSF transaction and you will have 24 hours to contact us with an alternative payment method. All nonpaying customers will be flagged as nonpaying and not be allowed to bid on future auctions.
In the event that you bid and are deemed the winner of an item by Maher Auctions, but fail to make payment in accordance with the invoice sent to you, or claim a dispute with any third-party payment intermediary, such as a credit card company, you will be assessed a charge of 15% of the hammer price as liquidated damages. By bidding on any such lot you hereby agree to the payment of such liquidated damages as a result of the irraparable harm that will be sustained by Maher Auctions. Furthermore, in the event that a winning bidder fails to make any payments under these terms and conditions, including the liquidated damages described herein, we reserve the right to report such nonpayment to the credit and collection agencies in our sole discretion.
No items will be released until payment is received in full.
Any items not paid for and/or picked up within 2 days of the concluded auction we be deemed abandoned and sold at a future auction or returned to the seller. Refunds will not be given on abandoned items. Item(s) could be subject to $10 per lot/per day storage fee. It is possible other arrangements can be made as long as we're contacted prior to the auction concluding.
Purchases become the responsibility of the Purchaser. Auctioneers shall not be responsible for loss or damage to any purchase.
If in its sole discretion Maher Auctions agrees to refund a purchase, you will be still be responsible for all shipping and handing charges, as well as return shipping. The previously paid buyer's premium is not refundable. Please bid responsibly and direct any questions you may have prior to placing a bid.
Lots that require shipping will only be shipped to the address listed through hibid. Due to fraud, we cannot ship to a different address. Also your name and address listed through hibid must match with the credit card used for payment.
