Conditions of Use Please read these conditions carefully. By registering for our auction, you agree, on behalf of yourself and all members of your household and others who use any service under your account, to the following conditions. Whether this is your first auction, or you are an experienced bidder, please note the following terms prior to bidding in our auction. Payments Credit Card: Immediately after the close of each auction we will process your payment method on file for any lots you have won. This will include a 15% buyer’s premium and applicable sales tax. You will receive a confirmation email with a copy of your paid invoice. HiBid gives you the option to store multiple cards in your profile. When registering for each auction you can select the card you would like to use the time of registration. For any cards that fail to process we will send an invoice that can be paid online or in-person. Your invoice will come from csphoenix@atxauctions.com. If you do not receive an invoice, please check your junk/spam folder. Cash Buyers: We allow cash payments on a limited basis solely at our discretion. If you prefer to pay cash, please notify us in advance so we do not attempt to charge your card. You can email us at csphoenix@atxauctions.com. If you elect to pay cash and do not make the payment or pick up your item within the allotted pick-up times, your card on file will be charged on the last day of the scheduled pickups. Any misuse of the cash buyer payment option will result in the suspension of the bidder’s ability to pay with cash. We reserve the right to remove the ability to pay in cash for any lot at any time. Item Descriptions At ATX Auctions, we strive to provide accurate information for each lot in our auction. We inspect each item and sort them into one of the following categories: New Factory Sealed- A new item with no signs of use. All original manuals and hardware are present in intact bags, and cords have not been untied. Protective packaging is still in place, but there may be limited damage to the outside packaging. Factory sealed items are inspected by our staff and may be opened as part of the inspection. We use stock photos for items in this category unless otherwise noted. New Open Box- A new, unused item, possibly with slight wear due to handling. Original manuals may be missing, and hardware bags opened, but all parts are present. New open box items will generally be tested for function by our staff prior to listing on the auction. Unused retail returns and display models could fall into this category. We use stock photos for items in this category unless otherwise noted. New Cosmetic Blemish- A new, unused item, with obvious damage due to shipping or handling. The defect is not something that affects function or safety, and the item still works as intended. Items in this category would be classified as New Factory Sealed, or New Open Box if not for the defect. We make every effort to test products in this category to ensure function prior to listing. The listing for items in this category will include photos of the defect as well as a description of its condition. Used, Like-New- A retail return that was used prior to being returned. To qualify for this category an item must look new, but have faint signs of use such as dirt in a vacuum cleaner. Original manuals may be missing, and hardware bags opened, but all parts are present. Items in this category are usually retail return that were used once and then returned. We will include photos on the listing for items in this category and provide a description of their condition. Used, Good- A retail return that shows obvious signs of consistent use. Items in this category are those that were used several times prior to being returned and show obvious wear. Some parts may be missing, which will be noted in the description and photos on the listing. Item still works as intended and every effort will be made to ensure functionality prior to listing. We will include photos on the listing for items in this category and provide a description of their condition. Picking Up Your Items Items will be available for pickup at our warehouse located at 3001 N 29th Dr., Suite 12, Phoenix, AZ 85017. We are available for pickups 6 days per week on the following schedule: Monday - Friday 10a-5p Saturday- 2p-5p All items that are not picked up by Monday one week from when the auction closes at 5:00 PM will be considered abandoned and are subject to disposal unless other arrangements have been made. A refund will NOT be issued for abandoned items. If you are unable to pickup your items during the dedicated pickup days then other arrangements must be made immediately following the close of the auction. You can make alternative arrangements by emailing us at csphoenix@atxauctions.com. Refunds/Returns At ATX Auctions we stand by our products. If we make an error and list an item incorrectly, either due to the misidentification of the item itself, or the omission of important details related to the item’s condition, we will provide a refund of the hammer price for the item and any applicable sales tax. We cannot for any reason refund the 15% buyers premium charged for the item. Due to the nature of our business (high-volume and deep discounts), we don’t offer returns or refunds in any other circumstances. All sales are considered final, “as-is” and “where is”. All items have a 3-day guarantee against misrepresentation from the date of pickup. Privacy Just like you, we are not fans of junk mail and spam texts. We commit to only send you text and emails necessary to keep you informed about your bids and the progress of current and future auctions. Additionally, we will send our newsletter twice per year. By registering for our auction, you agree that we can send you text messages and emails. STOP/Unsubscribe: Each ATX Auctions location maintains its own text and email list. Phone numbers and emails will only be added to locations that you have registered. If at any time you wish to stop receiving our text messages, reply STOP and you will be removed from the list. If you do not wish to receive messages from a specific location you must unsubscribe from that location. Unsubscribing from a location's text list will only ensure that you do not receive any messages from that location. At any point you wish to be added back on the text list you can text ATXPAZ to 298298. HiBid emails are not controlled by ATX Auctions. If you would no longer like to receive emails from HiBid you may make adjustments to your notification and communications settings in your HiBid account.

Checkout Date/Time Checkouts will begin Saturday, April 27th at 2:00 PM. All winning lots will be charged to the card on file at the conclusion of the auction unless other arrangements have been made. If you are shipping the items, your card on file will also be charged for the shipping & handling charges unless other arrangements have been made.

This Auction will consist of NEW in-the-box overstock, packaging damaged, and some customer returns inventory from Amazon. Items will include mattresses, furniture, computers, lawn tools, ladders, home decor, toys, cleaning supplies, electronics, household goods, and other general merchandise. Important Information for Bidders Whether you're a first-time bidder or a regular participant, here's some important information you should know about our auction. Once the auction is finished and invoices are generated, you will receive an email and text message confirming your status as a winning bidder. This usually takes about one hour after the auction concludes. Pickup days are on Saturday from 2:00 PM to 5:00 PM, and Monday through Friday from 10:00 AM to 5:00 PM the following week. Please note that we are closed on Sundays. Any items not picked up one week after closing will be considered abandoned and may be disposed of, unless alternate arrangements have been made. We do not offer refunds if you require shipping*** Item Conditions We receive inventory from various sources, and our staff inspects each item to the best of their abilities. The second photo in the listing shows the item's condition. Please note that not all items can be visually inspected, but we test products for functionality when possible. Returns and Refunds We stand by our products and take responsibility for any errors or misrepresentations in our listings. If we make an error, we will replace the item or provide a refund. All items have a 3-day guarantee against misrepresentation or manufacturer defects. However, please ensure that you are bidding on the right size, color, shape, and model. Email/Text Communication We understand the annoyance of junk mail and spam texts. At ATX Auctions, we commit to sending only essential messages. You will receive text messages to remind you that the auction is closing in one hour and to notify you if you are a winner. Our emails are infrequent, with only two newsletters sent per year. By registering for our auction, you agree to receive text messages and emails from us. If you wish to unsubscribe from our text or email list, reply with STOP. Note that each ATX Auctions location maintains its own list, and you will only be removed from the specific location you unsubscribe from. To stop receiving messages from all ATX Auctions locations, you must unsubscribe from each one individually. Standard message and data rates may apply.
