Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Cerny Auction Services shall endeavor to describe in detail each item and any pertinent information about it. Cerny Auction Services will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Hour meter & odometer readings reflect what is shown at time of consignment, but make no guarantees that the hours and miles are accurate. - Bidder agrees that everything is sold AS IS with no guarantees or warranties. All sales are FINAL with no returns after purchase. - Successful bidders must be in contact with Cerny Auction Services within 24 hours of the completion of the auction to verify payment and discuss pickup. Online Buyer’s Premium: 5% Sales Tax: 7% - Sales tax applied to invoice total, including buyers premium. Participation Requirements: Proper I.D at registration. Valid Credit Card required for online bidding approval. Payment Instructions - All items must be paid for by Cash, Check, or Wire Transfer on Auction Day or within 48 hours of the auction, or the next banking business day. Cerny Auction Services will email all winning bidders wire transfer instructions and invoices at the conclusion of the sale. If you do not see this invoice in your inbox, please check your spam folder. - IN-PERSON payments must be paid ON Auction Day, Saturday, May 11, by Cash or Check. - Registered credit cards will be accepted on any purchases under $1,000. - ANY ONLINE PURCHASES OVER $1000 WILL REQUIRE PAYMENT BY WIRE TRANSFER. - No equipment will be released until payment is approved and made in full. Title Fees - There is a $25 title processing fee on all items that will be charged to the buyer. Titles will be mailed certified. Allow up to 30 days for titles to be mailed. Cerny Auction Services is not responsible for lost titles. Removal and Pickup - PICKUP ARRANGEMENTS MUST BE MADE 24-48 HOURS IN ADVANCE!!!! - The Removal/Transportation of Equipment is the sole responsibility of the BUYER. Any and all methods of lifting, towing, dismantling or any other requirements for the removal and transport of equipment is the sole responsibility of the Buyer. - Loading assistance will be available on Auction Day and Sunday, followed by appointment between either Seller or Auction Company and Buyer. The loading assistance is only what the loader can safely lift & is offered as a courtesy. - Items must be removed within 14 days of auction conclusion unless prior arrangements WITH the auction company have been made. Any items not picked up 14 days after the auction concludes may be subject to storage fees ($25.00 per day). The Auction company may move equipment to a different location after the auction for later removal. - After 30 days, the item will be considered abandoned and Cerny Auction Services will resell the item with no compensation to the buyer! - Loading time & dates will be agreed upon by the auction company and buyer, no exceptions. Auction company is not responsible for any potential loading fees charged by the seller. Risk of Loss - MAKE SURE YOU INSURE YOUR ITEM!! - It is the buyer’s responsibility to have all items picked up within 14 days of purchase. Ownership of the item will transfer upon payment. The buyer assumes full responsibility for theft, vandalism, fire, lack of security, loss from accident, and all acts of God. - By bidding you accept these terms. - Please call with any questions before bidding. 1. Any & all announcements made on sale day take precedence over all printed material & advertising. 2. All Property is offered in 'AS IS, WHERE IS' condition. No guarantees or warranties are implied. 3. Once the Auctioneer says 'SOLD', the equipment becomes the sole responsibility of the buyer. 4. The Auction Company reserves the right to reject the bid of anybody. 5. All descriptions are believed to be accurate but all conclusions will be determined by the buyer. 6. In a case of a wire transfer, payment is required within 48 hours of the auction, or the next banking business day. 9. No property removed until settled for. 10. All Arrangements for Removal MUST be made with the Auction Company. 11. No Sellers or the Auction Company are not responsible for any accidents or theft. Buyer will not subject seller or Auction Company to litigation or enduring losses. 12. Cerny Auction Services is not responsible for any technological issues. 13. By making a bid, regardless of how the bid is made, Bidder agrees to these terms.
