When placing a bid via phone or email, reference the vehicle lot number, vehicle make and model, your name, and maximum bid amount (in US Dollars). *LIST SUBJECT TO CHANGE UNTIL 8 AM ON AUCTION DAY*   The starting price for all vehicles varies. Bidding increments will begin at $50.00 and will increase based on interest, activity, and how the auctioneer sees fit.  Please give us your maximum bid when placing a bid before the auction.  If other bids are received for the same vehicle, Milne Towing and Cal-Nevada Towing (the Company) will bid up the vehicle for you, on your behalf, until a highest bid is obtained.  If there are two or more identical maximum bids for the same vehicle, we will attempt to contact the bidders and ask for updated bids.  Otherwise, we will accept the first bid received.  Winners will be notified via email or phone if they are not present. For in person bidders, do not sort through vehicles on the property that are not yours, and do not go through the vehicles until paid in full. The Company may reject any bid for any reason and has the right to refuse the highest bid if it is significantly below its perceived market value and may do with the vehicle as it sees fit, including but not limited to holding for the next auction.  If an error is made, the Company will attempt to resolve such error.  If that is not possible or feasible, the Company will remove the vehicle from the auction and inform all appropriate people.   For Nevada vehicle sales, Nevada Titles will be processed as soon as possible by Nevada Department of Motor Vehicles (NV DMV), but please be aware that The Company is not in control of the NV DMV process and delays are greater than 90 days. Expedited titles are not available from NV DMV.   A $100.00 refundable deposit is required before placing any bids. Bidders with a history of non-payment will not be allowed to bid any amount above their deposit. If the bidder does not win any vehicles in the auction, the $100.00 will be refunded when the deposit receipt is turned in. Any deposit not redeemed within 30 days after the auction will be forfeit. AS IS, WHERE IS:  Bidders are responsible for closely inspecting each lot/vehicle.  Buyer understands the he/she is buying the property entirely upon his/her own examination or opinion and should inspect the item carefully before bidding.  Each lot is sold “AS IS, WHERE IS” and with all faults and defects, at buyer’s risk.  Vehicles may contain dangerous or hazardous goods/fluids/materials, to include: used needles, broken glass, drug remnants (including fentanyl), and/or drug paraphernalia, biological fluids, etc. Neither the Company, its employees, nor the auctioneer make any guarantee or warranty expressed or implied as to, but not limited to, conformity to any safety design, pollution standard, law, regulation, fitness for any particular purpose, authenticity, merchantability, age, year of manufacture, model, serial or other numbers, condition or mileage, or vehicle condition or cargo within. All required emission control equipment (SMOG) related repairs and certificates are the sole responsibility of the buyer. It is the explicit responsibility for the buyer to comply with any safety and emission control equipment requirements prior to operating any vehicle purchased. Vehicle information provided is for informational purposes only and vehicle odometer readings may not be actual, true, or correct. All sales are final: no refunds or returns.  The buyer shall pay all costs of any repairs, the removal, loading, and transport costs, and shall be responsible for any and all damages incurred as a result of vehicle transport. Buyer is aware that any lot sold has the possibility of being categorized as a Salvage/Rebuilt/Total Loss/etc. vehicle according to the federal National Motor Vehicle Title Information System (NMVTIS), before or after the auction date, without prior notice or warning.  The Company makes every reasonable effort to maintain an updated vehicle title condition list prior to the auction date but cannot be held responsible or liable for delays in processing by NMVTIS or other third parties reporting to NMVTIS for salvage, rebuilt, total loss, etc. vehicle updates that occur after the publication of the vehicle title condition list.  Due to the enormous variation in situations and paperwork requirements, Buyer should not invest money or resources into lot/vehicle until a title is in hand.  The Company shall not be liable for lost money if a problem or delay occurs with title issuance.  The Company reserves the right to bid on all vehicles and accept or reject any bid or refuse admittance to any bidder for any reason, at its sole discretion without notice. Bidder understands that you (any anyone else in your party/group) are in the Company’s yard at your own risk and agree to hold the Company and its employees harmless if any injury should occur. Any person who removes parts or property from an auction vehicle will be subject to expulsion from the sale and possible arrest and is not eligible for a deposit refund. CALIFORNIA VEHICLE SALES ADDITIONAL TERMS: All vehicles appraised under $4,000.00 are sold under Civil Code Section 3072. Should the vehicle amount exceed $4,000.00, Civil Code Section 3071 dictates and the vehicle will be re-liened through DMV to be sold at a later date. All vehicles appraised $4,000.00 and over are sold under Civil Code Section 3071. Although vehicles must be paid for in full at time of purchase, there is a 10-day redemption period in which the vehicle must remain at the Company yard. During these 10 days, the legal owner, registered owner, or properly interested party may redeem the vehicle for the amount of the sale, plus 12% interest per annum which will be refunded back to the buyer. If the legal owner, registered owner, or properly interested party does not redeem the vehicle within 10 days, then the CA DMV lien sale documents will be completed and available to the buyer at 10:00AM on the 10th day following the date of sale. If that day falls on a weekend or holiday, it will be the Monday. Buyer must register the vehicle with California Department of Motor Vehicles (CA DMV) within 10 days after purchase. Buyer assumes full responsibility for compliance with DMV transfer of ownership. Buyer is responsible for all CA DMV Fees, penalties, and past due registration; buyer is NOT responsible for any outstanding parking violations.   BUYER INFORMATION REGISTRATION: Upon successful highest bid, bidder becomes the buyer for the vehicle(s). You must register your full name, cell phone number and email prior to leaving the property. The information will be used by the Company in case staff needs to get in touch with you for any reason relating to the auction. PAYMENT:  In person: CASH, DEBIT or CREDIT CARD.  Online: XPRESS Pay – additional transaction fee may apply. Local Sales Tax applies to all purchases unless a valid re-sale certificate is presented at time of payment, and all outstanding balances must be collected before any vehicle is removed from Company property.  The Company has keys made for certain vehicles as it sees fit, the price for which is noted on the vehicle list.  Buyer is responsible for the cost of all taxes, fees and keys, as applicable.  The $100.00 deposit will be applied to the final purchase price of the vehicles. Note that Buyer is usually purchasing the Company's lien on the vehicle and the lien packet is submitted to Nevada DMV for a Nevada Title within 30 days of the auction close date.  If there is a problem with lien paperwork, the Company will assist with the Nevada DMV.  If no title can be obtained, the Company’s liability shall be limited to the actual purchase price of the vehicle, keys, fees, and taxes paid.   REMOVAL OF VEHICLES:  Buyer may remove their vehicle after full payment is made and after all required new vehicle owner information is submitted.  If the vehicle is placed on the street and remains stationary for 6 days, the Company will consider the vehicle abandoned and the auction sale cancelled – no refunds will be issued.  The Company will move the vehicle back on Company property and will re-sell the vehicle.   DEADLINES: Buyer has 2 business days (until Tuesday at 5:00 PM) to complete the following: (1) pay for their vehicle(s) (2) provide all new vehicle owner information, and (3) remove vehicle(s) from the property or arrange for a re-tow.  If any of those criteria are not met within the deadline, the auction vehicle sale will be cancelled. This bidder sheet serves as proof of the $100.00 deposit has been paid for any non-permanent bidder number. If no vehicles have a winning bid, then the $100.00 deposit will be refunded when this physical receipt is turned in. If any vehicles are won with this bidder number at the auction date listed above, then this deposit will be applied to the total purchase price when this physical receipt is turned in - no refund will be issued at that time. If this deposit is not applied to a vehicle and there is no money owed for any vehicles, the deposit may be redeemed for $100.00. Any deposit not redeemed within 30 days after the auction will be forfeit. Failure to follow any of the rules above will be grounds for immediate removal from the auction site, and may cancel any vehicle purchase made, if applicable. Your participation in the auction is your acknowledgement of these terms and conditions and agreement to abide by them.
