Auction Terms & Conditions TERMS OF SALE 1. Please read the following terms and conditions carefully as they are a legal binding contract between you (the Bidder) and utauctions.com. To register and bid in this auction you must agree to these terms and are bound by them as a bidder. 2 All items are sold AS IS, WHERE IS, with NO WARRANTY expressed or implied. It is the responsibility of the buyer to determine the condition of the items and bid accordingly. All items must be considered used or previously owned. Even if labeled as new in box, we cannot guarantee the item will be in full retail condition. Place your bids accordingly and read all descriptions and Terms prior to placing your bids. No refunds will be issued. 3. The bidder is responsible for knowing which item he is bidding on. If he is unsured, he should inquire or not bid.. When you become the winning bidder at auction you have effected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor "Mistakes". 4. The Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of his client or seller. The Auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels are not in the best interest of the seller. 5.Collusion will not be tolerated. In accordance with the Sherman Act, it is unlawful to agree not to bid against another buyer, punishable by fines and imprisonment. 6. Every effort is made to "guard" mechandise throughout the auction and on pickup day, however, the bidder becomes solely responsible for all items purchased by him immediately following his winning bid. Therefore, he is advised to further guard his items at his own discretion. 7. 10% buyers premium will be added on each item purchased. 8. Purchaser will pay all legal state sales tax, unless exemption requirements are met. PAYMENT 9. Payment for all purchases is due immediately at the conclusion of the auction unless specifically outlined otherwise. Your credit card listed with Hi Bid will be charged within 24 hours after auction closes. utauctions.com will charge Purchase price, a 10% Buyer’s Premium and any applicable handling fees to the credit card that you have recorded in your profile with Hi Bid up to $1000. Any invoice amount over $1,000.00 will require a bank wire transfer. Credit Card will not be accepted for invoices over $1000. Buyers who choose to pay CASH on pickup must call 435-757-2343 before auction ends and let us know so your card is not charged. Cards that are declined will be charged a 20.00 fee. 10. Buyer may or may not recieve a email invoice. May Have Won emails usually mean the bidder has won that item. Bidder can call 435-757-2343 to verify items won if you so choose. PICK UP Specific times that are listed for pickup are the strict start and end times, per contractual agreement with the seller. We will not facilitate pickup BEFORE the start time. All buyers are expected to be FINISHED removing their items by the time the pickup is scheduled to end. You need to arrive on time to pack and remove all your item(s) within the stated pick-up times. We may assess a charge to any buyer that requires our staff to stay longer than the scheduled time. 11. If you are unable to pick up at the agreed to terms, you must send a representative to pick up for you or forfeit your items. Any item(s) utauction.com or the seller has to remove from sale site due to the buyer missing pickup time or abandoning part of a purchase may be subject to additional service fees. 12. Buyers who do not pick up their item(s), or leave any items behind, at the specified pick-up time may be subject to additional service fees. Ownership of those items will return to the seller and the buyer will forfeit any and all rights to the item including payments and refunds. 13. You MUST bring your own packing materials, moving equipment, and adequate manpower to safely and properly remove your items during the specified pick up time. We will not wait for your additional help to arrive if it is outside the pickup times. Also, you may be asked to wait at the end of the line if you are not prepared to move or load your items in a timely manner, we reserve the right to help those buyers who came prepared first. This policy is designed to keep pickups speedy and efficient. We need our buyers to come prepared out of fairness to other buyers and to our seller. 14. If a buyer violates the contact/terms agreed to, we may access the following additional charges: Pick up NO SHOW, Leaving Lot OR Partial Lot behind $25.00 / Lot Plus forfeiture of item Load out assistance $25.00/Lot Staff IS NOT for hire to help. This charge is initiated if YOU fail to bring adequate help. Bringing Lot back to Office for pick up. $20.00/Lot plus 20.00 storage fee for one week (7 days) Any lot(s) not picked up after 7 days will be forfited as abandoned with NO refund. This service is NOT available for large items. Not completing Pick up Process within the proper timeframe $30/ First Half hour $30.00/Hr After first Half hour. Arrange Special Pick up Time w/Staff outside of time outlined in TERMS $30/Hr Clock starts when staff leaves office until return to office Per Staff member SHIPPING 15. Most small items can be shipped. Shipping will be paid buy the buyer. A handling charge of 3.00 or up may be charged for items requiring extra handling for packing. Insurance is extra if its buyer requested. We will ship the cheapest way possible USPS, UPS, Fedx. NO GLASS with out prior approval 16. Use of Site: utauctions.com or it's sellers can not, and will not be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continuous uninterrupted or error free service or use of the site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.utauctions.com, at its sole discretion, may void any sale temporarily suspend bidding or reschedule the closing date of a auction and resell any items/lots that were affected by any malfunction. The decision of utauctions.com is final. 17. By registering to bid, and by submitting bids with Hi Bid / utauctions you agree to have read terms of the auction and agree to all listed terms and conditions. 18. Firearms and ammo are cash only and must be picked up in person NO SHIPPING. Buyer must be 21 years of age or older.
