PAYMENT: Payment by credit card/online payment. Cash payment must be approved in advance. All items must be paid for at the time of the auction end. Credit cards will be automatically charged at end of auction. Shipping fees will be charged to the same card in a separate transaction. South Dakota 4.2 % sales tax applies to price of merchandise as well as shipping charges.

PICKUP: Buyer is responsible for removal of items. Please bring your own help, equipment, and tools needed to remove your items
SHIPPING: Please check with auctioneer BEFORE bidding on items and whether they can be shipped. Purchase price does NOT include delivery. Winning bidder will be charged for insurance on the value of the property being shipped according to high bid amount and actual shipping charge. We only ship within the United States. There will be no shipping of furniture. Any item NOT picked up will be shipped to buyer if shipping is less than $10.00 and charged to the HiBid card on file.
The charge for shipped items will include the winning bid + buyers fee + applicable taxes + insurance + actual shipping amount.
AS IS, WHERE IS: All items sold "as is, where is" with no warranty and will all faults. All sales are final. There are no warranties, expressed or implied, statutory or otherwise, as to the merchantability or fitness for any particular purpose of any goods offered in this sale. The items are available to the public for inspection prior to the start of the auction closing. Online inspection will happen through posted photos. Additional scheduled previews can be scheduled. Inspection must occur during those hours. Bidder inspection is encouraged. Big D Auctions, Inc may attempt to describe the merchandise in advertising, on the internet, but makes no representations. In no event shall Big D Auctions, Inc be held responsible for having made or implied a warranty of merchantability or fitness for a particular purpose. Big D Auctions, Inc will neither be held responsible for accidents nor errors, deletions or omissions. No credit or adjustments will be allowed in any form or amount. The buyer relies exclusively on his/her pre-auction inspection and each lot is sold with all faults and defects therein. All descriptions are believed accurate, but not warrenteed. The buyer shall take full responsibility and assume all risk of said equipment and or items from the time the auction company accepts the final bid from the buyer. Please inspect before you bid and buy. By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them.
FAILURE TO PICK UP ITEMS: Items that do not get picked up on the scheduled pick up days become the sole property of Big D Auctions, Inc & no refund will be given. Any other arrangements for shipping, transportation or physical pick-up must be made PRIOR to the sale ending. Please note these assets are sold only one time with non-retractable bids. Any item NOT picked up on pick up day will be shipped to buyer if shipping is less than $10.00 and charged to the HiBid card on file. Any item that is not picked up on the day designated will be forfeited with NO grace period, phone calls or warnings. Alternate pick up arrangements must be made in advance of auction closeing.
FAILURE TO PAY: When you bid on any item, you are entering into a binding contract. If you fail to pay for items, you will be turned over to the District Attorney's office or our attorneys for collection, court costs, storage fees, and any other costs incurred by Big D Auctions, Inc.
ONLINE BIDDING PROCESS: Bidders understand and agree they are bidding over the internet and technical issues may occur that Big D Auctions, Inc h has no control over and is not responsible if your bid fails to be recorded. This is especially important near closing times due to high volume. Big D Auctions, Inc strongly suggests you take advantage of our max bid feature, so you are covered in the most efficient way possible. Big D Auctions, Inc reserves the right to reject any bid at our sole discretion. Big D Auctions, Inc will not be responsible for any omissions, errors, or misprints in the description of any merchandise or auction items. Auction lots can be removed from the auction prior to the first received bid. Bidder agrees that everything is sold AS IS - WHERE IS and that they may not return any item they purchase for any reason. Bidder agrees that if they cause any damage while picking up their items that it is their sole responsibility to pay for any and all damages including all interior and exterior damage.
Big D Auctions, Inc has full discretion to modify the date and time, order, and details of the sale of any asset or conduct of any auction for any reason, or no reason at all, including but not limited to technical issues, emergencies, and convenience of Big D Auctions, or the seller.
Any individual found tampering with items on this auction will be prosecuted to the fullest extent of the law. Buyer & bidder do hereby consent to the United States and state laws and penalties of failure to settle & pay. If buyer fails to pay in full, buyer (a) authorizes owner and/or auction company to resell such property at any time at public or private sale, (b) agrees to indemnify owner and/or auction company against all loss or damage upon sale, together with cost and expenses thereof, including attorney's fees and (c) agrees to pay auction company interest of 1.5% per month on unpaid balance. Buyer accepts full responsibility for all purchases made and holds the company free from any liabilities including theft of items. The bidder is bound by these terms.
Auction company employees and/or auction company may bid on auction items.
Bidders must be 21 years of old or older at the auction close in order to purchase alcohol, firearms, ammunition.
Big D Auctions, Inc reserves the right to alter this agreement at any time. This will take place by updating this site. Please check back and review these terms as every time you use this site you are agreeing to the terms as they are written at that time. Big D Auctions, Inc reserves the right to cancel any auction at any time for any reason. All sales are final. A bid is a legal binding contract between you and Big D Auctions, inc.. Big D Auctions, Inc reserves the right to reject any and all bids for any reason. Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. When using the website, you must obey any and all local state and federal laws. Violations will result in termination of web site use privileges. We gather aggregate information from this web site which may include but is not limited to number of page visitors, most visited pages, any and all correspondence. Registered bidders will be automatically added to Big D Auctions, Inc mailing lists for ongoing communication.
