Klaassen Auction is a licensed FFL. Any transfers of firearms will follow Federal FFL guidelines. All property is sold as is, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. Klaassen Auction may attempt to describe the merchandise in advertising, on the internet and or at a live auction but makes no representations. In no event shall Klaassen Auction be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. This is not an absolute auction unless specifically stated in the auction heading. Specifically, but without limitation, Auctioneer makes no representation or warranty that any of the lots conform to any standard in respect of safety, pollution or hazardous material, or fit for any particular purpose. The Auctioneers, sellers, or any member of their staff make no guarantee as to the authenticity, of any particular age, year of manufacture, model, make, mileage, hours, condition, or defect of any lot or item being sold. Bidders are encouraged to make their own physical inspection and rely solely on that inspection before bidding. Failure to inspect does not negate that Bidders responsibility to perform under the auction terms and conditions. You acknowledge that you have the right and responsibility to inspect the item(s) personally, or to have a third party representative inspect the item(s) for you. REMOVAL OF PROPERTY / SHIPPING TERMS: All items can be shipped. We deliver delicate or bulk items to a professional packing and shipping store where the items will be professionally packed, insured and shipped. The cost of using professionals is high but we use them to ensure that your items are handled properly and with the utmost of safety. Shipping available to US addresses only for this auction. Some non-delicate items may be shipped by our own staff to keep your costs lower where possible. Insurance required for at least amount of purchase or shipper minimum. All packing, shipping and insurance costs will be paid by buyer. Merchandise and default and or remaining at auction site after pickup date will be considered forfeited merchandise and will become the possession and property of Klaassen Auction and the purchaser will be charged any and all costs to remove, sell or dispose of items. The purchaser will also be charged an additional $20.00 per item disposal fee. No refunds will be given. ADDED TERM: $25 staffing fee for pickup after the advertised date and time, only by appointment during business hours and within 72 hours after advertised pickup. All property remaining after that time may be subject to forfeit at the discretion of the auction company. We charge $10 on our end per invoice for packaging, materials and labor, and choose the most economical rate between USPS, FedEx and UPS and required insurance (this is in addition to the $10 we charge on our end). Shipping to US based bidders only. Ammo will be shipped through UPS only. PAYMENT OPTIONS: accepted forms of payment for this auction are CREDIT CARD ONLY. There will be a 3.5% electronic fee on all credit card purchases. Only VISA, MasterCard, American Express or Discover are accepted. Purchaser grants a security interest in purchased items. If, for any reason, payment is not made in full, Klaassen Auction has the right to repossess items, even from private property. PAYMENT TERMS: Sales tax, when applicable, will be charged on both the purchase price and buyers premium. (No sales tax for this auction). Taxes, fees, shipping, handling, insurance, storage and security charges are Buyers expenses, and will be calculated and rendered due at the sale of the property. Payment must be made in full by the Buyer, immediately upon the completion of the auction by VISA, MasterCard, American Express or Discover. If you are from another country other than the US, you must pay in US funds. If action is necessary to enforce the terms of this agreement, purchaser agrees to pay attorney fees and costs associated with collection or action. Interest on overdue amounts will be paid by purchaser at a rate of 2% per month/24% annual, or at such other maximum rate allowed by law. BUYERS PREMIUM: A Buyers premium will be charged on each purchase. A buyers premium, an advertised percentage of the high bid or flat fee added to the high bid will be added to the high bid and become part of the purchase amount at settlement. TERMS GENERAL TERMS: All prospective buyers must be at least 18 years old and are required to register prior to bidding. By placing a bid, the bidder acknowledges he has received, read, and understands and agrees to be bound by the terms and conditions of the auction. The bidder whether acting as principal, agent, officer or director of a company or otherwise, in any capacity whatsoever, and the company they represent, both jointly and severally agrees to indemnify and save harmless Auctioneer and its officers, directors, emplyees, agents, attorneys and its consignors, from any and all actions, causes of action, suits, damages, costs, and losses of any nature, including injury and death, arising from the purchase or use of any items, or the attendance or participation of bidder, his/her agents or employees, at the auction and/or on the auction site whether before, during, or after the auction. Auctioneer reserves the right to periodically change the terms and conditions of the Agreement, which shall be effective immediately upon posting. It is the Bidders responsibility to review any and all changes made to these terms and conditions prior to bidding on property. Auctioneer reserves the right to add or withdraw property from the auction, and/or regroup items. Auctioneer reserves the right to sell property absolute or with reserve, at Seller discretion. The Seller does have the right to make the final bid and the Auctioneer does have the right to bid on behalf of the Seller. The auctioneer reserves the right to open the bid as the result of a tie bid or discrepancies in the bid. Bidder must submit information found to be current, complete, and accurate for proper identification. Auctioneer does not sell or rent this information. Auctioneer uses email mailing lists to notify customers about online and live auctions. Customers who do not wish to be notified should contact the office of the Auctioneer and request removal from the email mailing list. Bidder is responsible for security of his/her bidding number/user name and password, and any and all bids placed under the assigned number/ID. Auctioneer should be notified immediately if Bidder believes number and/or password have been compromised. Auctioneer reserves the right to terminate registration, deny any person for any reason permission or access to bid, to reject any and all bids, and to suspend or ban Bidder from bidding, at Auctioneers sole discretion. BIDDING IN THE ONLINE AUCTION: Once you are registered and have your User Name & Password, you may place bids as soon as a lot opens for bidding. Your bids are FINAL and constitute a binding contract. Please be aware that lots will close at various times and possibly different days and may be extended. You are responsible for monitoring these close times. Please bid early to avoid disappointment. Bidder acknowledges that hardware malfunctions, software malfunctions, viruses, and similar issues do occur and are beyond the knowledge, scope, and control of Auctioneer. We are NOT responsible for your system malfunctions, connection to the internet or your e-mail client stopping any of our e-mails to you in regard to bid confirmations and/or outbid notifications. An invoice will be sent to your registered e-mail address within 24 hours following the conclusion of the auction. This auction has what is called an "auto-extend" feature, meaning the auction will not close until all bidding parties are satisfied. If any bids are placed within the last 3 minutes of the auction, the bid on lot(s) will extend an additional 3 minutes. The bidding will extend in 3 minute increments from the time the last bid is placed until there are no more bids, and the lot sits idle for 3 minutes. The auction company may, at their discretion, adjust the auto-extend time increment. Auction company employees and/or auction company may bid on auction items. This auction will be a timed online auction with bidding closing as the items are closed. NO CHARGEBACKS - Buyer agrees to the following - no chargebacks returns refunds shall be filed with the bank or credit card company. Buyer agrees refunds will be issued solely at the discretion of the auction house on a case by case basis. Issuing a chargeback against Klaassen Auctions will result in suspended bidding privileges. Buyer agrees to the following - make sure you bring the proper loading vehicle or trailer and adequate labor. For extremely heavy equipment, we recommend a professional equipment mover. Buyer agrees not to engage in unsafe practices and agrees the auctioneer has the right to stop any unsafe practices. AUTHENTICITY - buyer agrees that Klaassen Auctions cannot verify fake items. Buyer agrees that there are no refunds, warranties or returns if items are purchased and later discovered as fake. If you are not confident items are authentic or genuine, DO NOT BID. We are not free authenticators and do not warranty items. NOTICE: For bidders who are new to our website and are unknown to our company, we will likely ask you for more information to verify your identity for purchases exceeding $500. Nonpayment Consequences: Buyers who fail to complete payment within 48 hours will be reported to HIBID and will be ineligible to participate in future auctions. 3. Local Pickup and Shipping Options: Local Pickup: Items won in the auction can be picked up at our auction office at 120 9th Street, Sibley, Iowa on Saturday, April 13 from 9-12. Firearms will require FFL guidelines to be followed. We will NOT conduct background checks. In-person pickup will only be with valid Iowa permit to purchase OR valid Iowa permit to carry OR FFL. A valid photo ID is also required. Shipping: Alternatively, you have the option to ship your purchased firearms to your chosen FFL Dealer. It's the buyer's responsibility to contact the FFL dealer of choice and they only are allowed to provide license copy and address for shipment to their establishment. Transfer Fee - A $25.00 Transfer Fee will be applicable for operating firearms and any ammunition requiring shipment to FFL. Buyers FFL must provide receiving FFL Information within 5 days from the auction finish date to joshe@klaassenrealty.com. Failure to do so within 5 days will result in items being considered abandoned without reimbursement. 4. Shipping Costs: Items that meet USPS shipping specs can be shipped using our in-house shipping. In-house fee is actual shipping plus insurance and $10 per ship invoice no matter how many items. 5. Compliance and Background Checks: We strictly adhere to ATF Requirements for all firearm sales. -Buyers are required to have FFL, Iowa Permit to Purchase or Iowa Permit to Carry. WE WILL NOT CONDUCT BACKGROUND CHECKS, SO YOU MUST HAVE ONE OF THE ABOVE, OR PURCHASE THROUGH FFL OF YOUR CHOICE, TO PURCHASE ANY FFL TRANSFERING FIREARMS. Firearms can only be shipped to other licensed FFL dealers. FFL or FOID NEEDED TO SHIP AMMO TO THE FOLLOWING STATES NO EXCEPTIONS: NEW YORK CONNECTICUT ILLINOIS MASSACHUSETTS NEW JERSEY If you do not wish to have your ammunition ship to you a licensed dealer and you are from one of the previously mentioned states please refrain from bidding. LIMITATIONS: The limited guarantee covers major discrepancies in condition reports, such as error in fact, visible repairs or restorations, or major differences in percent of finish or bore(+/- 20%). This limited guarantee is only available to the buyer of record. Except as stated in the limited guarantee above, Klaassen Auctions will not be held responsible for typographical errors or errors of omission. This limited guarantee does NOT cover imperfections, patina, slight damages, handling marks, natural imperfections, undisclosed minor blemishes, finish differences, wood-to-metal fit issues, surface cracks or chips in wood, dings and dents, unverifiable age, and other similar differences that are inherent in the firearms or other antiques and collectibles offered for sale. Firearm internal mechanisms and moving parts are not inspected, and guns are not test fired unless otherwise noted. If mechanical or other working parts are inoperable, even if working at the time of sale, Klaassen Auctions is not liable due to the inherent nature of the age of these used items. FIREARMS TRANSFER AND ELIGIBILITY: All firearm transfers will be in strict accordance with all Federal laws. Buyer is responsible for adhering to all country, state and local laws before bidding. If a bidder is unable to import, purchase, own, or receive a firearm or ammunition for any reason, they should not bid on these items. If a buyer later determines they cannot legally own a firearm or ammunition to accept delivery, the bid is still a valid contract, and the buyer is still obligated to remit payment in accordance with payment terms. Klaassen Auctions does not offer returns, refunds or cancellations on the basis of ineligibility or failure to facilitate transfer. BUYER OF RECORD: All firearms must transfer to the registered buyer on record OR the cooperating FFL of buyer's choice. Klaassen Auctions will not modify or re-invoice any firearms for another party. IN-PERSON PICKUP: Only the person to whom the bidder number is registered may accept transfer of the firearm(s) at the conclusion of the sale – Federal Law disallows anyone else from accepting the transfer. Buyers may not bid on or pay for modern firearms on behalf of another party. Non Iowa Residents (without FFL) may not pick up modern or NFA firearms in person at our Iowa Facility. Antique Firearms Can be picked up in person with valid photo ID by persons over the age of 18. No background check required, all states of residence eligible. Non-Guns may be picked up by any eligible buyer (or buyers agent) with a valid photo ID.
