Description
After three seasons, The 1812 Store is having an inventory reduction auction to make room for new inventory for the upcoming season. Many of the items have been on the store floor for a period of time, while other items are from estates and were held in storage. There is much to choose from including antique parts and pieces, modern collectibles, and everything in between.
PARTICPIATION: In order to participate in this auction with The 1812 Store, LLC, you must accept the following terms and conditions (If you do not agree please do not register to bid.): - All bidders are required to register prior to bidding on any item. - Bids cannot be retracted or changed once the auction begins, all bids are binding. - Everything is sold “AS IS” with no guarantee or warrantee of any type including warrantee of merchantability and the purchaser by bidding on said item accepts that item without any such warrantee or guarantee and in an "AS IS" condition. - It is the responsibility of the bidder to assure condition of items prior to bidding. - We recommend an inspection of the lots prior to bidding. It is recommended that you attend the open house to familiarize yourself with the items you wish to purchase. (Example: color, size, shape, age, or overall condition). - If there is no open house offered, please feel free to call us if there is a question about the condition of a lot prior to bidding. - All condition reports given by the The 1812 Store, LLC are subjective and we will not be held responsible or liable for any errors in description including age, size, measurements, condition, rarity, importance or provenance. We strive to give true, accurate descriptions on items but realize reports are subjective and are for informational purposes only. - A BUYER’S PREMIUM OF 15% will be added to ALL purchases. - Registration requires a credit card for verification of identification only. We will not add any charges to your credit card until auction pick up is over. Therefore, you can pay with a check or cash if you wish. - 15% buyer’s premium and NYS SALES TAX (NO MATTER WHERE YOU LIVE) added to all items purchased. - If you are tax exempt, YOUR tax information MUST be entered BEFORE the auction closes. NO refunds will be made. BIDDING: Once you have registered now it is time to bid. Go to view catalog. Click on an item inside the catalog that you wish to bid on. After reading the description you can now bid. Click on the "bid button". You can bid to the next increment or place a max bid. If you choose max bid the computer will bid for you up to your max amount. Preset bidding increments have been set up. As the price of an item increases the bid amount increments will increase. It is not necessary to enter a decimal point and zeros to your bid amount. The computer software will enter them for you. Some items will be sold "times the money". If it is a sold "times the money" item it will look like this "X5". Example: If an item sells for $2 dollars each and it is a X5 lot then the price will be $10. Bidding Live: You can also bid live as the auction closes. 30 minutes before the auction closes click on "enter live auction" button. Place your bids as the increments increase. Auction Closing: Our Internet auctions use a "soft close" format. An item will close every 10 seconds after the beginning of an auction. This gives the bidder the opportunity to bid on more than one item. If there is an advance bid inside of 2 minutes to close the bidding, that item will be extended by 2 minutes. This process will continue until there is no more bidding activity. By bidding with our auction company, you are entering into a contract with our terms and conditions. You are accepting responsibility to perform your duties as winning bidder, and agreeing that The 1812 Store, LLC, its employees, officers, owners, representatives, agents, and consignors will not be held liable for any losses, claims, liabilities, judgments, expenses, fees, or other damages arising from the use of our services, website, auction property, and this site, including property damage, injuries, dispute with another bidder, or breach by bidder of this site. All successful bidders will sign their receipt at the time of pick up indicating that all items are accounted for and in satisfactory condition. There will be No returns, refunds, or exchanges on any items as this is an auction and not a retail situation. The 1812 Store, LLC will not be held responsible for any delays or interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the site. The 1812 Store, LLC has the right to suspend bidding, re-sell any item/lots for any reason and void any sale. PAYMENT: A 15% premium will be added to the final purchase price of each item. Payment is expected on pick up day. We accept most major credit cards, cash, or good check. *If you fail to attend pick up, your purchases will be charged to your credit card that you registered with. If we must move your purchases back to our office there will be a $20 no show fee charged. Items can then be picked up at our office when balance due and no-show fee is paid. Items will be stored for 3 days. After that point there will be a $1.00 per day fee per item. After 30 days, the items will be considered abandoned and resold. All monies will be retained by Bid-N-Buy Realty and Auctions, Inc. and any loses will be owed by delinquent buyer. All sales are subject to appropriate NYS SALES TAX (no matter where you LIVE) and buyer’s premium. Buyer’s premium is 15% of purchase price on every item and is subject to sales tax. If you are tax exempt, you MUST indicate this when you REGISTER and provide a recent copy of the form BEFORE THE AUCTION CLOSES or you will be charged sales tax. NO STOP PAYMENT ORDERS OR CREDIT CARD CHARGEBACKS: No stop payment orders or credit card chargebacks. Each bidder agrees that such bidder will not, under any circumstances, (i) issue a stop payment order with respect to any checks issued or in connection with the auction, or (ii) initiate a credit card chargeback with respect to any purchases at the auction. Each bidder further agrees that if, in violation of these terms and conditions, a stop payment order is issued or a credit card chargeback is initiated, these buyer terms & conditions will be conclusive evidence of the bidder's (i) waiver of any rights to issue a stop payment order or to initiate a credit card chargeback, and (ii) agreement not to issue a stop payment order or to initiate a credit card chargeback; and each bidder acknowledges and agrees that the auctioneers presentation of these bidder terms and conditions to the bank, credit card company, or other financial institutions against which a check was drawn or that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse any stop-payment order and/or reverse or deny any credit card chargeback, and will re-credit all amounts to, or for the account of auctioneer. If, in violation of these bidder terms and conditions, a bidder issues a stop payment order or initiates a credit card chargeback, such bidder, even if successful, will remain liable for all purchases made at the auction, and will be responsible for all costs and expense, including attorney's fees, incurred by or on behalf of auctioneer and/or seller in challenging the stop payment order or credit card chargeback and in collecting payment. Each bidder acknowledges and agrees that the covenant not to issue a stop payment order or initiate a credit card chargeback is a condition to the issuance of a bidder number to such bidder and is being made as an inducement for the auctioneer to accept such bidder's bidder registration, to issue a bidder number, and to permit the bidder to bid at the auction. Each bidder acknowledges and agrees that auctioneer is relying on the covenant not to issue a stop payment order or to initiate a credit card chargeback in accepting such bidder's bidder registration, in issuing a bidder number, and in permitting the bidder to bid at the auction. PICK UP INFORMATION: Pick up times are listed in the auction description. Items that are not picked up during the scheduled pick-up times will have a $20 no show fee added to the unpaid invoice. Items that are not picked up will be held for 30 days and you must schedule an appointment with our office to pick them up. If your items are not picked up within 30 days, they will be considered abandoned. Buyers will be charged for all items purchased whether you pick them up or not. It is your best interest to make an appointment during the scheduled pick-up times. Sales Tax: 8% New York State sales tax will be charged on all purchases and buyer's premium. If you are tax exempt, you must sign a resale or farm exempt form. Shipping: NO SHIPPING IS OFFERED FOR THIS AUCTION - PICK UP ONLY. If you choose to use a shipping company, the items are considered delivered, once the shipper signs for the item and any issues thereafter are between you and the shipper. The 1812 Store, LLC will NOT be held liable for any shipping issues. All items in this auction must be picked up in the scheduled time frame. Please take notice of pick-up time! If you cannot make pick up time, please have someone come on your behalf. There are no other times for removal. If you leave your items without making arrangements for pick up, after 14 days, the item(s) becomes the property of The 1812 Store, LLC and will dispose of or resell and no refunds will be issued. The 1812 Store, LLC is NOT liable for any damage to property left on the auction premises after the auction and pickup timeframe has concluded. The 1812 Store, LLC is NOT liable for any damage to property transported or stored, past the auction day and pick up time. No refunds will be issued for any items damaged after the auction and pickup time frames have ended. No refunds or returns on any items sold in this auction.
