By placing a bid, the bidder hereby acknowledges they have READ and AGREE TO these Terms & Conditions: “Lot(s)” or “item(s)” refer to any item or collection of items sold by Nine Lives Auction, LLC, directly or through a third party auction platform. “Bidder” refers to any person bidding on lot(s)/item(s) in an auction. “Buyer” may be used interchangeably for the purposes of these terms and conditions. The bidder agrees to provide accurate and current contact information to Nine Lives Auction and/or their assigns, and accepts responsibility for any issues created due to incorrect or incomplete email address, mailing address, phone number, and/or payment information. The winning bidder of lot(s)/item(s) agrees to pay the COST (hammer price), ANY APPLICABLE TAXES, SHIPPING (if applicable) and ANY FEES associated with the lot/item. Payment will be immediately charged at the close of bidding to the payment method provided by the buyer upon auction registration. The winning bidder accepts and assumes all risks and liabilities associated with bidding on, picking up, and use of lot(s)/item(s) won in the auction. Unless stated specifically in the lot(s)/item(s) description, Nine Lives Auction does not provide shipping services. The bidder understands that all lot(s)/item(s) sold by Nine Lives Auction are considered to be “AS IS, WHERE IS” with NO GUARANTEE and NO WARRANTY of any kind. The bidder is responsible for determining how much they are willing to pay for any lot(s)/item(s). ALL SALES ARE FINAL. NO REFUNDS. NO EXCHANGES. PAYMENT: Please make sure the payment information on file with your HiBid account is current and accurate. The billing address on file with HiBid MUST MATCH the billing address of the payment method. All winnings will be immediately charged to the payment method on file with HiBid. Any applicable shipping charges will be charged separately to that same payment method upon order processing. Declined payments for either winnings or shipping will result in: - Cancellation of the purchase transaction - A refund of any amount charged less a 20% restocking fee. - Revocation of bidding privileges on future auctions LOCAL PICKUP: The winning bidder agrees to PICK UP lot(s)/item(s) WITHIN 3 BUSINESS DAYS of the close of the auction. Failure to pick up lot(s)/item(s) in the allotted time will result in: - Cancellation of the purchase transaction - A refund of any amount charged less a 20% restocking fee. - Revocation of bidding privileges on future auctions SHIPPING: The winning bidder agrees to provide all necessary information and paperwork necessary to process and ship their winnings WITHIN 3 BUSINESS DAYS of the close of the auction. Failure to provide the necessary information in the allotted time will result in: - Cancellation of the purchase transaction - A refund of any amount charged less a 20% restocking fee. - Revocation of bidding privileges on future auctions SHIPPING FIREARMS: The winning bidder agrees to provide a PDF copy of a valid FFL license for shipping emailed to info@ninelivesauction.com WITHIN 3 BUSINESS DAYS of the close of the auction. IF YOUR DEALER REQUIRES OUR FLL you must provide us with the dealer’s email address. Failure to provide any of the required information in the allotted time will result in: - Cancellation of the purchase transaction - A refund of any amount charged less a 20% restocking fee. - Revocation of bidding privileges on future auctions The winning bidder agrees that failure to pay for, pick up, or provide necessary information for shipping lot(s)/item(s) in the stated time frame(s) is considered forfeiture of the lot(s)/item(s) and will be subject to a 20% restocking fee. All bidders and other parties, such as but not limited to visitors and guests, agree not to hold Nine Lives Auction, its staff, and/or real property owner(s) responsible for ANY DAMAGE, HARM, LOSS, or INJURY resulting from being present on any property in use by Nine Lives Auction. All bidders and all other parties assume all liability when handling or picking up lot(s)/item(s). Bidders and all other parties agree not to hold Nine Lives Auction, its staff, and/or real property owner(s) responsible for ANY DAMAGE, HARM, LOSS, or INJURY resulting from bidding on, transporting, or using lot(s)/item(s). At their own discretion, Nine Lives Auction retains the right to refuse service to anyone at any time. ALL LOT(S)/ITEM(S) SHOULD BE ASSUMED TO HAVE A RESERVE. Pursuant to UCC § 2-328 and applicable state law, Nine Lives Auction may maintain reserves on lot(s)/item(s) by bidding on behalf of the seller or other vested party using one or multiple bidder numbers to place bids, until the lot or lots have reached a bid amount that is acceptable to the vested party. Nine Lives Auction, its sellers, and employees may have an interest in certain lots or items and retain the right to bid on those lots or items. Additional Terms & Conditions for Firearms All BATFA, State, and local laws apply. By placing a bid on a FIREARM, the bidder certifies that they will be the actual purchaser of the firearm. The bidder’s name on their IDs and payment information MUST MATCH. Firearms, ammunition, and/or other related items will NOT be shipped to California, Cook County(IL), New York City, or any municipality where prohibited. ALL OUT OF STATE BIDDERS who purchase FIREARMS from Nine Lives Auction must have them shipped to an FFL licensed dealer/entity and a.properly signed, clearly legible copy of the FFL must be emailed to info@ninelivesauction.com WITHIN 3 BUSINESS DAYS of the close of auction. Failure to provide the necessary information in the allotted time will result in: - Cancellation of the purchase transaction - A refund of any amount charged less a 20% restocking fee. - Revocation of bidding privileges on future auctions We will NOT ship any firearms to a Class 3 C&R licensee. The bidder is responsible for paying actual shipping costs (insurance, signature, etc.), which will be invoiced separately. Dealers who bid and win on FIREARMS are encouraged to submit a copy of their FFL to info@ninelivesauction.com immediately after receiving their invoice. FIREARMS will be shipped within 2-5 Business Days after receiving both payment and any required licensing and documentation. Nine Lives Auction, LLC reserves the right to refuse bids on or the sale of any FIREARMS or AMMUNITION to any bidder for any reason. Bidders and other parties agree that all legal disputes will be arbitrated on an individual basis in Phoenix, AZ using an accredited arbitration service to the fullest extent allowed by federal, state, and local laws. Bidders and other parties agree that the arbitrator cannot consolidate claims unless it is agreed upon by the claimant and Nine Lives Auction. Bidders and other parties agree the arbitration service will be selected at the sole discretion of Nine Lives Auction. Bidders and other parties agree to abide by the Rules of Arbitration, to the fullest extent allowed by federal, state, and local laws. Bidders and other parties agree to abide by any judgment, ruling, award, and/or agreement made during arbitration and accept it to be FINAL, non-appealable, and legally binding. Bidders and other parties agree that these “Terms & Conditions” are subject to change and that these “Terms & Conditions”, Nine Lives Auction’s website, and any information pertaining to specific lot(s)/item(s) cannot be used, shared, or stored without the express written permission of Nine Lives Auction.
