Terms and Conditions of Sale:
REAL ESTATE TERMS: Welcome to our Auction, we hope you enjoy your experience. Please take a moment and read our terms and conditions. If you have questions regarding these terms, please call our office. If you have a Realtor we are paying a Co-Op to the agent if they bring a buyer to this property. This home will be sold subject to the owner's confirmation. By registering in our auction today you agree to our terms & conditions and will be bound by those Terms and Conditions. The successful high bidder on this property will be required to sign a Real Estate Sales Contract, Terms & Conditions, and any other documents needed immediately upon conclusion of the bidding and will make a 10% deposit. A ten percent (10%) buyer's premium will be added to the high bid to establish the total sales contract price. Payment may be made by personal check; cashier's check or cash. The balance is to be paid in full at closing within 30 days. If buyer fails to close within the 30 period the 10% deposit is forfeited. Current taxes will be prorated at the date of closing. Seller will provide the deed. Buyer is responsible for title opinion, title insurance and recording fees. Customary closing costs will be paid by the buyer. Buyer is to obtain their own financing. The contract will not be contingent upon financing, inspections or any other contingencies. Weiss Lake Auction and Leading Edge Realty and its auctioneers and agents are representing the sellers as the sellers' agents. Weiss Lake Auction and Leading Edge Realty gives notice that the auctioneer or agent can bid on behalf of the seller upto the reserve price. All properties are sold "AS-IS, WHERE-IS and WITH ALL FAULTS," without any warranties expressed, implied or guarantees of any kind. Agent represents the seller only and does not inspect properties on bidder's behalf. All measurements, square footage and age are approximate and not guaranteed. Seller and or agent makes no warranty as to the accuracy of information. All information is deemed reliable, but not guaranteed. Buyer to verify all information to their satisfaction prior to bidding. Alabama Residential property exemption notification and lead-based paint disclosure will be a part of the sales contract.
Bidder understands and agrees that this agreement and all rights of the parties there-under, shall be governed by the laws of the County of Madsion, State of Alabama and any action brought by either party shall be brought in the Courts of the State of Alabama. In the event, that for any reason, the forum is deemed to be sufficiently inconvenient or the agreement on the forum selection is unenforceable it is still the intention of the parties that the Laws of the State of Alabama govern the parties agreement and their rights attended thereto. Buyer agrees that any legal filed action will take place within the county of Madison, City of Huntsville, State of Alabama.
If you are bidding online please note, the auctioneer may without notice, withdraw, extend or rearrange any property, and or item at their sole discretion at any time and will not be liable for any computer, internet or website malfunctions. In an online only auction bids that are placed within the last minute, will cause bidding to automatically extend to prevent bid sniping. Payment must be made within 24 Hours after you are the winning bidder. Weiss Lake Auction and Leading Edge Realty will have up to 7 DAYS to provide the Buyer with any documents to be signed after the auction has ended. Lead Based paint- This home was built before 1978. A Lead Based paint disclosure is not required to be provided to the winning bidder.

Personal Property AUCTION TERMS AND CONDITIONS:
1. All items auctioned are sold AS IS, WHERE IS with no warranties or guarantees. Please read all descriptions and inspect photos thoroughly before bidding.
1a. Auctioneer makes every effort to provide accurate information about the items being sold. However, neither Auctioneer nor its Client will assume responsibility for Buyer's bidding errors. It is Buyers' full responsibility to confirm the accuracy of items offered for sale. Buyers are recommended to inspect all items. Descriptions and photos are offered as a guide only, ask questions if you are unsure about an item.
2. ALL SALES ARE FINAL. A successful bid at auction, whether live or online, constitutes a legally binding contract of sale. All sales are final. There will be no refunds, returns or exchanges.
3. Bidder's Number. The bidder's number is nontransferable. All bids, online or in-house, made using the bid number will be the responsibility of the Buyer.
Buyer's Premium:
There will be a 20% buyer's premium added to all winning bids
Payment:
1. By agreeing to our terms and conditions, you agree to allow us to charge the credit card on file if you are the winner upon close of the auction.
2.Local bidders may pay with a personal or cashier's check. You must contact the office prior to the close of the auction and indicate that you will pay with cash or check. You may also pick up your items or have them shipped.
3. Any purchases exceeding $1,000 may require wire transfer as payment.
Shipping:
S1. Buyers are to pay all shipping charges. Shipping will be added to the total cost of the item(s) (hammer price + buyer's premium + sales tax (if applicable). There will be a minimum $5 handling fee for all shipping invoices.
S2. Large, extremely fragile, freight shipping
Buyer has five (5) business days to contact the office (256-927-8765) with shipping arrangements. All exceptionally large, fragile, or irregularly shaped items will be packaged through UPS Packing and shipped via UPS. Furniture, large signs, or extra large pieces may require freight (anything over 110lbs packaged). Uship.com is a reliable shipping option for large pieces (i.e. furniture)
S3. We offer in-house shipping for coins, jewelry, and rugs ( weighing under 70lbs) ONLY. All other items will be taken to the UPS Store for shipping. These items will be sent via USPS
S4. Non-Payment for Shipping
If the buyer refuses or does not wish to pay for shipping or will not pick up the winning items, Weiss Lake Auction LLC will not, for any reason, refund the Buyer. The buyer may then become a consignor for Weiss Lake Auction LLC. A contract will be sent via email for the buyer to review and sign. The contract must be scanned and emailed back to us or mailed. The buyer has five (5) days to return the signed contract. When the contract is received, Weiss Lake Auction will lot the item in an auction. If the contract is NOT received within five (5) days, the items will be deemed abandoned and become the sole property of Weiss Lake Auction LLC.
S5. There will be a minimum $20 handling fee added to invoice total for any item that the buyer requests to be transported back to our warehouse for pick up at a later date. Your invoice total must be paid in full for items to be removed from the estate. All items not picked up from our warehouse within 14 days will be sold for storage fee and you will forfeit your items.
S5. International buyers are responsible for any and all customs fees in addition to shipping charges.
