1. I understand that I am liable for all purchases made on my registered number and further agree to make settlement in full for said purchases, including applicable sales tax, buyer premium, and title handling fees, on auction day or a late fee will be added to my invoice and due. Online bidders' payment is due by the end of the next business day. Please be prepared for prompt payment.
2. I understand that I have the opportunity to inspect all items prior to the auction and agree to pay for all bids I win. I also understand that I am buying AS-IS, a used item with faults, and that the item may or may not run/operate and that there are NO REFUNDS and agree to inspect purchases before leaving Martin Auction. All makes, models, years, serial numbers, etc. are subject to bidder/ buyer verification. Buyer Beware!
3. I agree to make payment in full on the day of auction and prior to removal from the auction site. Cash preferred. Handling charges may apply on credit card charges. All personal/business checks must be accompanied by a bank letter. Wire transfer accepted by the end of the next business day (items remain on lot until payment is confirmed); wire instructions are emailed with invoice. The online only bidder agrees to the credit card on file with the third-party platform being charged within 24 hours of invoicing and agrees to pay with no chargebacks. Non-executing bidders will not be allowed to register at future auctions.
4. I understand any item with a title is subject to tax of 6.25% of purchase price IST (Illinois Sales Tax) or tax based on model year VUT (Vehicle Use Tax). I agree that all TITLE & REGISTRATION FEES ARE NOT REFUNDABLE after submitting application to the state; bidders must request a refund by directly contacting the Illinois Secretary of State. Bidder appoints Martin Auction Services LLC as the lawful attorney in fact, to sign all papers and documents required to secure Illinois title and/or registration of, or transfer interest in, any vehicle listed on the paid invoice. Bidder understands there is a title handling fee applied per title.
5. All auction lots are sold "As Is - Where Is". Warranties or guarantees are strictly between buyer and seller - not Martin Auction. Any warranty issues that may develop would be arbitrated with the item returned to Martin Auction for a refund; the bidder is responsible for all hauling expenses. Buyer must sign for Items noted with having a waiver before release of said item.
6. Items located off-site will be listed in the description box and will be picked up from that listed location.
7. Martin Auction assumes no responsibility for accidents, stolen or damaged property. Items left at the auction site are at the owner's risk and should be insured to the degree of protection desired by the bidder on the day of sale.
8. Auctioneer in charge will settle any disputes as to bids and that decision will be final. Auctioneer also reserves the right to accept or reject bids at his discretion. All announcements made on auction day will take precedence over all printed materials. Any item may be removed from auction without notice.
9. I understand any personal or business information disclosed can be used for (email, phone, text, etc.) communication and marketing purposes. We will NOT sell your personal information.
10. I agree that any litigation due to an issue arising from the auction must be filed and tried in DeWitt County, Illinois.
11. I understand that Martin Auction (or any of its divisions) shall have the right to collect attorney fees, interest and/or collection costs and disbursements in the event that I shall default on any transaction(s) at this auction on this date in accordance with the "Terms and Conditions" set forth. Further, I agree to pay the same.
12. Any items remaining after 7 days may be resold or disposed of by Martin Auction. I agree that those items are forfeited with no reimbursement to me or those I represent. If an item remains beyond 7 days, I agree to pay $10.00 per day- per item and that amount may be deducted from the auction proceeds when the item/ items are sold and agree that typical commission may be deducted. This time frame can vary per auction and will be noted in the auction information provided; please be aware.
13. Martin Auction DOES NOT SHIP! As a courtesy we have invited a shipper to assist our buyers. We are NOT affiliated with the shipper; Martin Auction is not responsible for shipping.
14. Buyers premium is 5% in person and 8% online.

Loader assistance will be available for 5 business days after a regularly scheduled auction from 9 am to 4 pm, Monday through Friday.
