I HEREBY AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS.I FURTHER AGREE TO BE RESPONSIBLE AND PAY FOR ALL PURCHASES. ALL ITEMS ARE SOLD "AS, IS: WHERE IS" WITH NO GUARANTEES WRITTEN OR IMPLIED. ELITE AUCTION COMPANY IS NOT RESPONSIBLE FOR ERRORS OR OMISSIONS IN THE TITLES, DESCRIPTIONS OR PHOTOGRAPHS. A 15% BUYER'S PREMIUM WILL APPLY TO EACH LOT SOLD IN THIS AUCTION AND IS SUBJECT TO CHANGE FOR FUTURE AUCTIONS.
Fees & Payment:
Buyer's Premium of 15% will be added onto purchase price of each lot. An additional 4% credit card convenience/processing fee is applied to all invoices that are to be paid by credit card. All credit cards will be automatically processed for full invoice amount immediately following the close of each auction. You will be sent a winner notification and shortly after an invoice with specific information regarding pick-up days, times and location. To request payment via cash, certified cashier's check or wire transfer ($30 fee) buyer will need to email admin@alaskaeliteauctions.com. Cashier's checks can be issued by your bank and made out to Elite Auction Company LLC. If using any method other than credit card, payment is due within 48 hours of auction closing. If you live outside the Anchorage/Matsu area your credit card will be automatically charged and shipping will be added to your invoice unless otherwise requested. Any invoice totaling $2,500 or more will need to be paid in Cash, Certified Cashier's Check or a Wire Transfer($30 fee).
Invoices:
Invoices will be mailed out immediately following the close of the auction. If you do not see your invoice in your email inbox, please search in your "junk/spam" folder. To avoid having your invoice sent to your junk folder please add Admin@AlaskaEliteAuctions.com to your email contact list. If you are still having trouble locating your invoice, please contact us. If you were bidding in the auction and believe you won something but do not see your invoice, please first check your junk folder, if you are still unable to locate your invoice, please then call us immediately at 907.201.3731. It is the bidder/buyer's responsibility to ensure they have their invoice and pick their winning lot(s) up within the designated pick-up days. Storage/Late payment fees will apply to anyone who has not made prior arrangements agreed upon by Elite Auction Company.
Shipping & Pick-Up:
If your address is out of state or outside of the Anchorage/Matsu area we will automatically assume they are to be shipped, if this is not the case, please contact us at: shipping@alaskaeliteauctions.com. Your items will be shipped within 10 business days following the close of the auction. Tracking information will be sent to you via email. If you live outside the greater Anchorage area and DO NOT want your items sent, please email or call (907) 201-3731. For all local bidders please pick up your items the 2 days immediately following the close of the auction. After the allotted time you will be charged a $20 per day storage fee or items will be considered forfeit at EAC's discretion. Auction personnel are not always available. You will need to make an appointment if you can't pick up during normal business hours and are going to miss the deadline. Thank You!
Delivery:
Elite Auction Company can deliver items to people who live in the Anchorage & Matsu Area. Deliveries will be done on the weekends and can be done contactless with your written permission. Minimum delivery is $25 within Anchorage and $50.00 within Wasilla. Deliveries will be charged on a case-by-case basis depending on the number of items, size and weight. Storage Fees:
Any items that have not been picked-up within the designated days & time frame listed for that auction, will be subject to our regular storage fees of $20 per lot, per day. Larger items and furniture will be a case-by-case basis, not to exceed $100 per lot, per day. If you know you are unable to pick-up during the designated time frame, please give us a call immediately and we can arrange a "Flat-Rate" storage fee.
Late Payment Fees:
All invoices are to be paid in full within 48 hours of the auction closing. We will attempt to contact you by email. You can update your payment through your hibid account or call us to process your payment over the phone. Any invoices left unpaid 48 hours after the close of the auction will be subject to $20 Late Payment fee per day. This fee will be charged daily, until the invoice is paid in full.
Credit Card Decline Fees:
Immediately following the close of the auction all cards will be processed, unless you have requested cash, certified cashiers check or wire transfer payment at least 24 hours prior to the auction closing. If you any reason your card is declined, you will be charged a $15.00 credit card decline fee. We will attempt to process the invoice 1 time per day until it is paid in full.
Cash Buyers:
If you would like to pay in cash, certified cashier's check, or wire transfer please email: Admin@AlaskaEliteAuctions.com at least 24 hours before the close of the auction. Anyone who has not requested an alternate payment method at least 24 hours before the close of the auction, will have their card on file through hibid immediately processed and charged.
Certified Cashier's Check:
Any item over $2,500 will have to be paid in cash or certified cashier's check or wire transfer ($30 fee). In this case we will not process your credit card and we will contact you regarding how you would like to pay. If you are under $2,500 and would like to pay with a certified cashier's check, please contact us 24 hours prior to the auction closing.
Wire Transfer:
Any item over $2,500 will have to be paid in cash or certified cashier's check or wire transfer ($30 fee). In this case we will not process your credit card and we will contact you regarding how you would like to pay. If you are under $2,500 and would like to pay through wire transfer, please contact us 24 hours prior to the auction closing. Please not that if you opt to pay through wire transfer there is a $30 fee.
Bidder Registration:
All persons who wish to bid in the auction or want to purchase must register by creating an online account. To register, the Bidder must provide all the registration information requested. Then sign the Agreement by checking the 'I AGREE' box. By checking this box, you acknowledge that you are binding yourself to this contractual agreement. Bidders must be 18 years of age or older and have a valid driver's license. Elite Auction Company reserves the right to refuse to register or admit any person at its sole discretion. Invoices and correspondence relating to purchases will be sent in accordance with the information on the bidder's registration. Your registration will be accepted but your information will be verified, and your account may be disabled until the necessary information is provided to verify the account. Bidding:
You must be a registered user to bid on items. By bidding, you are stating that you are ready and willing to purchase that item for your bid amount, plus any shipping charges disclosed in the listing. If you are outbid, or your bid does not meet the reserve price, you are under no obligation to buy. But in all other cases, you are entering a contract to buy the item, and to deliver payment within the time period specified (48 hours from auction closing). If you cannot pay, please don't bid. Your bids are final and non-retractable. We will not accept e-mail bids.
Starting Bid:
Elite Auction Company will predetermine the number of Item(s) in an auction. Elite Auction Company will set the starting bid on each item. The Starting Bid is designed to encourage bidding. If an item is incorrectly described online, Elite Auction Company reserves the right to rectify such error and email to all active bidders the correct description.
Reserve Auctions:
Unless explicitly stated otherwise, some lots are being sold with reserve. These terms are applicable to all reserve auctions. Elite Auction Company maintains the right to withdraw any property before and during the sale of such property. The reserve price may not be disclosed. All bids are raised in a minimum of $5.00 increments, Elite Auction Company, at its sole and complete discretion, may reject a nominal bid advance.
Reserve Bidding:
All Lots are being sold with a "reserve," a price below which the Lot will not be sold. Any bid submitted below the reserve price will not result in the purchase of a Lot. Reserves may be decreased or removed at any time.
Bidder Rights:
All rights granted herein are personal and exclusive to the registered bidder and may not be assigned or transferred to another person or entity, by operation of law or otherwise. Any attempt to assign or transfer any such rights shall be void and unenforceable. No third party may rely on any benefit or right conferred herein or granted to any Bidder. If you have any questions, please Elite Auction Company immediately. Elite Auction Company reserves the right to include in the auction any Lot and the right to withdraw any Lot any time while the auction is running. High bidder of said lot(s) will be given a courtesy call to be made aware of any changes. Elite Auction Company may combine, subdivide, regroup or reorganize any Lots.
Internet Bidding:
(A) Buyer acknowledges that Elite Auction Company does not have any responsibility or liability for the website(s) used for Internet bidding. Seller acknowledges that the Elite Auction Company may not have any control over the website(s) and cannot guarantee its operation or performance. There are occasional interruptions and delays relating to the use of the Internet and the Website. Furthermore, Elite Auction Company shall not be held liable (for lost profits or special damages) or responsible for the function of the website or its inability to function. Buyer acknowledges that hardware malfunctions, software malfunctions, viruses, and similar issues do occur and are beyond the knowledge, scope, and control of Elite Auction Company.
(B) The website is administered by Elite Auction Company from its offices in the United States of America. Individuals must reside within the United States of America to register to bid online. Elite Auction Company will not accept bids from individuals who reside outside of the United States of America and its territories. If you access the website from a location outside of the United States of America and its territories, Buyer consents to exclusive and continuing jurisdiction in the United States of America and agrees to be bound by and comply with all applicable laws.
(C) Elite Auction Company reserves the right to deny any person for any reason permission or access to bid online.
(D) Winning bidders will be notified via email at the auction close.
Elite Auction Company disclaims any liability for damages, whether direct, indirect, consequential, or incidental, resulting from bids not spotted, executed, or accepted. Bidders should also be careful to bid on the correct lot and ensure that his/her bid is for the amount intended Elite Auction Company is not responsible for computer or human error which may result in any customer dissatisfaction. We reserve the right to accept or reject all bids or bidders. Elite Auction Company reserves the right to request a deposit at any time for what Elite Auction Company considers excess bidding to continue to bid in a specified auction. The sale is complete when Elite Auction Company so announces.
Authentication:
Each Lot shall disclose what authentication accompanies it. The buyer should not bid on a Lot if they are uncomfortable with the authenticator. We will issue refunds on items, under certain conditions that have been legally found to be fraudulent, or unauthentic.
All items are sold "as is, where is" and all bids are considered purposeful and will be considered as final. We are here to offer Customer Service to our clients and returns may accepted under certain conditions which will be determined by the company.
Lotting:
Elite Auction Company will sort and list items as they see fit into lots. Each lot will have a starting bid which will be predetermined before the auction is live for bidding. The lot will go up in increments based on the last placed bid. Elite Auction Comapny makes it best effort to describe all items accurately, however, it is the resposibility of the bidder to request further information or make to schedule a preview. Once a lot has been bid on the bid is considered purpouseful and final. All items are sold "as-is, where-is". Most lots will have measurements or a dollar bill for size. Measurements are as follows: Height" x Width" x Depth". If bidder is unsure of anything pertaining to a lot we encourage them to contact Elite Auction Company before placing any bids.
