TERMS AND CONDITIONS 1. The highest bidder shall be deemed the Buyer at the option of the Auctioneer. 2. This shall be an auction with reserve, whereby the Seller reserves the right to accept or reject any or all bids received. 3. Neither the Seller nor the Auctioneer make any warranties whatsoever concerning the condition of this property. The Buyer is buying this property based on his own inspection of the property and not based on any printed or verbal descriptions made by the Seller or Auctioneer. 4. The Auctioneer reserves the right to declare recess at any time during the proceeding of the auction that he deems necessary. 6. These "Terms and Conditions" shall become a part of the Sales Agreement attached hereto, which the Buyer herein is required to sign. All property appurtenant to premises, including electrical fixtures, heating and plumbing fixtures, piping and wiring, refrigerator, elec. range, dishwasher, washer and dryer is included in this sale. 4. All electric utility charges and lot rent will be apportioned as of the date of performance of this Agreement. 5.. Possession shall be delivered December 10, 2021 upon final payment.. 6. Buyer(s) acknowledges that the premises have been inspected by Buyer(s), that the property is being purchased "AS IS" as a result of such inspection and not as a result of any representations made by SELLER; and that SELLER shall not be liable or responsible for any agreement, condition or stipulations relating to or affecting the physical condition or the use of the property or any physical defect in the property not specifically set forth in this Agreement. 7. The Seller will continue, until final payment, Seller's existing policies of insurance, if any, which insure the property against damage by fire or other casualty or loss. Any loss or damage to the premises from and after the date of said auction sale shall not in any way void or impair any of the conditions and obligations of the Buyer, but proceeds received, if any, shall be credited by the Sellers on account of the purchase price. It shall be the Buyer's responsibility at Buyer's own cost and expense to carry such insurance on the premises as Buyer shall deem desirable. 8. Real Estate taxes upon the premises shall be apportioned as of the date of final payment. 9. The Buyer herein shall pay at settlement a 5% Buyer's Premium, an amount equal to five percent, 5% of the purchase price herein. 10.. This agreement shall be binding upon the parties hereto, their respective heirs, and personal representatives. Should the Buyer fail to perform as provided, the sum paid on account shall be retained by the Seller as liquidated damages and all rights of the Buyer herein shall cease. Zettlemoyer Auction Co.
