Terms and Conditions for Superior Auction Gallery 1. Acceptance of Terms: By registering to bid or placing a bid with Superior Auction Gallery, you agree to be bound by these terms and conditions, which are subject to change at any time without notice. It is your responsibility to review these terms before bidding. 2. Items Sold "As Is": All items, including firearms, vehicles, coins, knives, precious metals (gold, silver, etc.), ammunition, weapons, and antique items, are sold "AS IS, WHERE IS" with all faults. No warranties or guarantees are made regarding the condition, age, authenticity, or grade unless explicitly stated. Bidders are encouraged to inspect items or request additional information before placing bids. This includes antique items, which are often in used condition and may exhibit wear, repairs, or damage consistent with age. 3. Firearms, Ammunition, and Weapons: • Firearms purchases require adherence to all local, state, and federal regulations. Buyers must provide valid identification and relevant permits. For out-of-state buyers, firearms will be shipped to a licensed FFL dealer in your state. • Ammunition will only be sold to buyers who can provide proof of age (18 for rifle/shotgun ammunition, 21 for handgun ammunition). • Antique firearms are sold as-is and may not require permits in some states. It is the buyer’s responsibility to verify local laws regarding the purchase and ownership of antique firearms. • Restocking Fee for Ineligibility: If the buyer cannot legally own a firearm in their state and the sale cannot be completed, the buyer is responsible for a restocking fee of 25% of the total sale price. This fee will be deducted from any refund issued, and the sale will be considered void. 4. Vehicles: Vehicles are sold as-is without any implied warranties. The buyer is responsible for all taxes, title, registration fees, and transport. Superior Auction Gallery does not offer vehicle inspections or guarantees beyond the description provided in the auction listing. 5. Coins, Precious Metals, and Antiques: All coins, precious metals, and antique items are sold as authentic unless otherwise specified. We do not guarantee the grade or condition of coins, precious metals, or antiques; grading is subjective. Antique items may exhibit age-related wear, and bidders are responsible for verifying the condition of these items before placing a bid. 6. No Returns or Chargebacks: All sales are final, and no returns or exchanges are allowed. Bids placed cannot be retracted, and credit card chargebacks will not be accepted under any circumstances. Superior Auction Gallery is not responsible for any buyer dissatisfaction due to the condition or quality of items, including antique items, after purchase. 7. Shipping and Handling: Buyers are responsible for shipping and handling costs, including insurance. Superior Auction Gallery is not liable for any damage during shipping. Items, including fragile antique items, will be shipped only after full payment is received. Local pickup is available by appointment only. 8. Payment Terms: Payment must be made within 3 business days of the auction closing. Accepted payment methods include credit cards, wire transfers, and cashier's checks. 9. Bidder Disclaimer and Binding Obligation: By placing a bid, you are entering into a legally binding agreement to purchase the item under these terms and conditions. Once your bid is placed: • You acknowledge and accept that you have fully reviewed and understood these terms and conditions, including all disclaimers about item condition, shipping, and payment terms. • You accept that all items are sold "AS IS" and that no warranties or guarantees apply unless explicitly stated. • You acknowledge that once a bid is placed, it cannot be retracted, modified, or canceled under any circumstances. • You agree to be financially responsible for the item if you are the winning bidder, including paying the full hammer price, taxes, shipping, and handling fees. • You agree that failure to pay in full within the allotted time may result in penalties, forfeiture of the item, and potential legal action, including but not limited to the recovery of fees for re-selling the item. • You confirm that you have read and understood all specific item descriptions, including any additional conditions related to the sale of firearms, vehicles, coins, precious metals, knives, ammunition, weapons, and antique items. • You agree that Superior Auction Gallery is not responsible for any misinterpretations or misunderstandings on your part, and you fully assume all risks associated with bidding and purchasing items through this auction. By placing a bid, you expressly waive any right to dispute, challenge, or contest the sale of the item, except as otherwise provided by law. 10. Buyer's Responsibility: It is the buyer's responsibility to research and understand all applicable laws for purchasing, owning, and transferring items such as firearms, vehicles, knives, precious metals, antiques, and other goods.
