TLC Auctions Terms and Conditions Any person participating in TLC Auctions (Ohio) shall be bound by the following terms, conditions, restrictions, and limitations as set forth below. Bidders acknowledge there are no representations, warranties, terms, conditions, undertakings, or collateral agreements except as herein provided. All buyers acknowledge and accept with their registration for the auction the terms and conditions of the sale as stated in this agreement. Payment Options: Cash, Certified/Bank Check (Payable to: TLC Auctions), or Credit Card (subject to 4% transaction fee). Credit card transactions limited to $2,500.00. " General Terms: The auction will be conducted by TLC Auctions; Tina Coulter, Auction Firm Mgr. dba Ohio TLC Auctions (Auctioneer) on behalf of the owners of the property, referred to as the Seller. Auctioneer is not responsible for the acts or representations of the Seller, nor the statements made by the Bidder, Buyer, or other parties. Auctions shall be held fully online and absolute unless otherwise stated. Auctioneer reserves the right to modify or supplement auction catalog at the website or by an official announcement made prior to start of sale. " Disclosures/No warranty: All property sold AS-IS, WHERE-IS, and with all faults and defects therein. ALL SALES ARE FINAL. No warranties whether expressed, implied, statutory, or otherwise, including without limitation, warranties, or conditions as to title, description, fitness for purpose, quantity, quality, merchantability, state, condition, location or otherwise. No sale shall be invalidated, and the auctioneer shall have no liability for a misdescription of any article or lot whether contained in a catalog, advertisement or otherwise. Descriptions have been prepared for guide purposes only and shall not be solely relied upon by the bidder for accuracy or completeness. It is the buyer's responsibility to verify condition, descriptions, and hours/mileage of equipment. Auctioneer reserves the right to add or withdraw property from the auction, and/or regroup items. Auctioneer reserves the right to sell property absolute or with reserve, at Sellers discretion. " Registration: Bidder's must be registered to participate in the online auction at HiBid.com prior to bidding. By registering, bidders are entering into an agreement to uphold the terms and conditions set forth and must be 18 years of age or older. Bidder must submit information that is current, complete, and accurate for proper identification. Bidder registration is not transferable or assignable. Auctioneer will use bidder registration information solely for promotional email listings and processing sales transactions. Registrants who do not wish to be notified via email should contact TLC Auctions at ohiotlcauctions@outlook.com and request removal from the email mailing list. TLC Auctions will not sell or rent bidder's information. " Bidding: * All items are sold AS-IS and all sales are FINAL. Bidders should carefully read the descriptions and view all pictures associated with each lot. Lots only include the items listed in the description and bidders should not assume an item is included because it is visible in the picture. * Bids are subject to the minimum bidding increments established by the Auction Manager through the online bidding platform. * Auction includes a staggered and soft close. A "soft" close means that if a lot bid is submitted and confirmed during the two minutes before bidding closes, the closing time will be extended two minutes on that item. This will continue until the full time passes without a new bid on that lot. Please note the closing time for each lot will vary. * Bids cannot be retracted and are binding contracts between Bidder and Auctioneer/Seller. * The winning bidder shall immediately become responsible for their winning lot. Responsibilities include: (1) the costs of insurance and the risk of loss or damage to such lot; (2) the payment of any applicable sales taxes and/or other applicable charges with respect to such lot; and (3) all transportation costs, including preparation, shipping, and insurance. Bidders are responsible for transporting each purchased lot from the auction pickup site within the removal period specified by TLC Auctions. All winning lot bids plus the applicable buyer's premium and applicable taxes/fees must be paid in full prior to possession of any lot contents. " Reserve: The Auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the Auctioneer shall have the right to bid on behalf of the Seller and the Seller has the right to bid on behalf of themselves. " Buyer's Premium: 10% Buyer's Premium shall be added to the total winning bid(s); for each bidder and shall be collected at the end of the sale, prior to removing any property. " Taxes: Taxes may be charged against the purchase price and buyers premium and shall be paid at the time of sale. Buyers claiming exemptions from taxes shall provide proof satisfactory to the auctioneer of their entitlement to claim such exemption. In the absence of satisfactory proof to the auctioneer, taxes shall be paid by the buyer. " Shipping: UNAVAILABLE " Payment: All bidding and invoicing will be in US Dollar ($). * Payment is due prior to removal of items at auction pickup location. All invoices must be checked on the day of the sale as no adjustments will be made thereafter. Any other arrangements must be made with TLC Auctions prior to bidding. * 10% Buyer's Premium Applies * Acceptable forms of payment include: * Cash (not to exceed $9,000.00) * Credit card (not to exceed $2,500.00; 4% transaction fee applies) * Cashier/bank check made payable to: "TLC Auctions" * Bidding in a TLC Auction is a binding contract. Registrants should not bid if they cannot pay for the item. Bidders are responsible for their bids. * The bidding ends when the item closes. Do not ask to cancel your bid after the auction closes. * TLC Auctions reserves the right to refuse any applicant the privilege of bidding and may revoke such privilege at any time. * TLC Auctions reserves the right to request financial information and/or a deposit during the bid process. **Payments not made by end of scheduled pickup window will be automatically charged to the credit card on file (plus 4% CC fee) for the invoiced items plus $25.00 disposal fee for each item that is not picked up by the agreed upon deadline. " Pick-up: Plan accordingly - TLC Auctions does NOT provide boxes, packaging, hand trucks or staff for loading furniture or large items. It is the buyer's responsibility for pick up & reminders will not be sent out by the Auction Company. Any items NOT picked up within the designated removal period will be charged $25.00 per item disposal fee to the bidder's credit card on file and returned to the Seller. NO REFUNDS will be issued. " Removal/Rigging: Rigging/Removal of sold equipment is the sole responsibility of the buyer and must be completed by the posted date. Rigging/Removal may not begin until payment has been made in full. All heavy rigging requiring the use of forklifts, cranes, etc. whether performed by the customer or a rigging company, must present a certificate of insurance for $1,000,000.00 naming TLC Auctions as the insured. Recommendation or approval of Riggers by TLC Auctions shall be done only as an accommodation to the buyer. Such recommendation or approval shall not cause TLC Auctions, or any affiliate to be liable in any way for any act or omission of any such Rigger. Selection of a Rigger is solely within the discretion of the buyer, and the buyer acknowledges and agrees that it shall have no rights or remedies against TLC Auctions, or any affiliates based upon any act or omission by a Rigger. " Titles: * It is the buyer's responsibility to be aware of their local motor vehicle regulations pertaining to titles and registrations prior to purchase of a motor vehicle. * Title to the lots purchased shall not pass until payment in full is received. * No purchaser may assign, transfer, or dispose of his rights in any article purchased before he has paid the purchase price in full and received title. In the case no title can be produced, no costs will be reimbursed for expenses incurred by the buyer. * The seller has up to 21 days to produce a valid title. * If valid title is not received within the 21 days, buyer has the option to return the item in the same or better condition than its original state at the time of purchase. The buyer must inform TLC Auctions the item is being returned due to no title. * The item must be returned within 5 days of the notification of no title for a refund of the sale expenses only. If the title is provided within that 5-day timeframe, and before the item is returned, the transaction to return the item for a refund is considered null and void. * The auctioneer shall have no liability to the purchaser, including without limitation, any damages for loss of profits or any expenses incurred by the purchaser. " Risk to Person and Property Indemnification: The buyer hereby assumes and does agree to indemnify and hold the auctioneer and seller harmless of any current or future claim, action, cost and/or expenses (including attorney fees) resulting from, rising out of or pertaining to the fitness, use, damage, safety, injuries to person or property that may have been caused by or during removal or use of item(s) purchased, or any other claim regarding the use of that asset as purchased. " Disputes: Bidding disputes will be settled at the sole discretion of the Auctioneer and the Auctioneer may put the disputed lot up for sale again to be resold to the highest bidder of the disputing parties. The Auctioneer's decision is final. " Disclaimer: TLC Auctions offers no guaranty or warranty of any kind regarding the online bidding services, or any property or lot offered at any auction. The bidder enters the sale at their own risk and shall not hold TLC Auctions or HiBid online services at fault should the online bidding platform or internet service stop working during a sale. TLC Auctions reserves the right to suspend, postpone or cancel any auction and/or to suspend or cancel access to online bidding services with respect to any auction, without notice.
