HOLT & ASSOCIATES, LLC AUCTION TERMS AND CONDITIONS 1. All announcements made on auction day shall take precedence over previously distributed information and/or advertising. 2. All bidders and others attending this auction agree that they have read and fully understand these terms and conditions and agree to be bound hereby. 3. There shall be no guarantees or warranties, expressed or implied, statutory or otherwise of any nature whatsoever in any respect of the lots offered at the auction. Each and every lot shall be sold 'as is, where is.' And 'with all Faults' Specifically, but without limiting the generality of the foregoing. Auctioneers make no representation or warranty that any of the lots: a. conform to any standard in respect of safety, pollution or hazardous material or to any standard or requirement of any applicable authority, law or regulation, or b. are fit for any particular purpose, or c. are merchantable or can be financed, or d. are of any particular age, year of manufacture, model, make or condition. Bidder agrees that he has satisfied himself and is not relying on the Auctioneers, nor are the Auctioneers liable for any matter in respect to the above. ALL SALES ARE FINAL. NO REFUNDS, EXCHANGES OR REFUSALS. 4. The price recorded by the auction clerk on the clerking form takes priority and will be official. 5. Auctioneers shall settle any dispute arising as to any bidding at their sole discretion and the Auctioneers may put the lot in dispute up for sale again. Auctioneers may, without giving any reason, refuse to accept the bidding of any person. 6. Auctioneers reserve the right to refuse any applicant for a bidding card and the privilege of bidding at this auction and may revoke such privilege at any time. Holt & Associates LLC has attempted to provide the correct item description and/or pictures however any errors or omissions in any provided format, description, or picture, does not affect/or void the sale. 7. Purchases become the responsibility of and shall be and remain at the risk of Purchaser immediately upon acceptance of his/her bid. It shall be the responsibility of the Purchaser to insure his purchases immediately. Auctioneers shall not be responsible for any loss or damage to any lot. NO EXCEPTIONS. 8. Complete and full payment for all purchase must be made on the day of the auction. Unless exempt by law, Purchaser shall pay any and all applicable sales tax. 9. REMOVAL shall be at the expense, liability and risk of Purchaser. LIVE BIDDERS: ALL ITEMS MUST BE REMOVED NO LATER THEN MARCH 30th AND BY 6:00pm MDST. ITEMS REMAINING AFTER THIS DATE WILL BE FORFEITED AND RESOLD WITH NO REFUNDS. NO EXCEPTIONS. INTERNET BIDDERS: ALL ITEMS MUST BE REMOVED NO LATER THEN APRIL 5th AND BY 6:00pm MDST. ITEMS REMAINING AFTER THIS DATE WILL BE FORFEITED AND RESOLD WITH NO REFUNDS. NO EXCEPTIONS. NO ITEMS MAY BE REMOVED UNTIL ALL ITEMS ARE PAID IN FULL. Failure to remove any item within allotted time will result in notification to the purchaser that the ownership will revert to Seller with no refunds extended. Auctioneer reserves the right to set the bidding increments at his discretion and may reject a nominal or fractional advance and reserves the right to withdraw any item before or during auction. Where there is a reserve, the Auctioneers shall have the right to bid on behalf of the Seller. 10. Persons attending the preview, auction or during removal of goods assumes all risks of damage or loss to person and property and specifically releases HOLT & ASSOCIATES, LLC from liability therefore; HOLT & ASSOCIATES, LLC nor its principal(s) shall not be liable for any reason of any defect in or condition of the premises on which auction is held. 11. HOLT & ASSOCIATES, LLC is acting as agent only and is not responsible for actions and/or representations made by any seller. 12. A handling charge of $50.00 plus all costs related to collection will be assessed on any returned check. 13. A Buyer's Premium of 10%, as advertised, will be added to all purchases.
