Please do not bid if you do not understand auction terms or procedures as you are legally responsible to pay for every bid that you win and pick up your purchases per the terms of this agreement.
Before you become a bidder of Country TreaZures, you must read and accept all of the terms in this User Agreement. By registering, you accept the User Agreement and you agree that this User Agreement will apply whenever you use Country TreaZures sites or services. You will indemnify and hold us ( our members, agents, and employees) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party. You agree and understand that while using Country TreaZures services and tools you will: be responsible for paying all fees and applicable taxes associated with our sites and services after the auction ends with a valid payment method. We only accept Cash, Cashier's Check, Pre Approved Personal Check, and PayPal (PayPal payments must be done online); pay a 10% Buyer’s Fee and pay an additional 5% Courtesy Fee if paying with PayPal (PayPal accepts credit cards, debit cards, etc); pay the Wisconsin sales tax (5.5%) unless item is being shipped out of state or you are registered as exempt); pay $3.00 Transfer Fee for orders being transferred to Wausau, Antigo, Stanley & Chippewa Falls; Transferred item invoices MUST be paid prior to items being transported to pick up locatoin.
You agree, understand and accept that all items are sold “As-is, where-is” with no returns. We are unable to test or thoroughly inspect every item we list and sell. If damage or defects are found we try to the best of our ability to alert bidders in the item descriptions. You must closely examine the photographs as we show what item defects we find (if any) to the best of our ability. By registering, bidders agree Country TreaZures shall be held harmless against responsibility of notification of any defects either known or unknown. Buyer is responsible to verify condition prior to bidding and bid accordingly. Buyers have no recourse if damage is visible in photos. We offer no warranty of any kind whatsoever. Details and information may be supplied by third parties.
Please bring your own packing materials and help when picking up your winnings. We will not assist in supplying packing materials, packing, or moving large items. We will not be responsible for picking up items that you win. You will have one (1) week to pick up and pay after the auction ends. Please notify us if you cannot pick up items within that time frame and we will try to arrange an alternate pick up day. Items not picked up within the 1 week time frame are subject to a $3.00 per day storage fee and your bidding account will be suspended. If items are past 2 weeks late, they then become the property of Country TreaZures and you will be blocked from further bidding.
You agree and understand that while using Country TreaZures services and tools you will not: use our sites, services or tools if you are not able to form legally binding contracts; are under the age of 18; or are temporarily or indefinitely suspended from using our sites, services or tools; fail to deliver payment for items purchased or damaged by you, Unless we say otherwise (Country TreaZures reserves this right, and may use it at our own discretion); manipulate the price of any item or interfere with listings; post false, inaccurate, or misleading content; transfer your Country TreaZures account to another party without our consent; distribute or post spam, unsolicited, or bulk electronic communications, chain letters, or pyramid schemes; distribute viruses or any other technologies that may harm Country TreaZures, or the interests or property of Country TreaZures users; harvest or otherwise collect information about users, including email addresses, without their consent; circumvent or manipulate our fee structure, the billing process, or fees owed to Country TreaZures. You will be responsible for any and all of the aforementioned fees. Which if not paid or your account is past due, we may collect fees owed using other collection mechanisms. (This includes but is not limited to: charging other payment methods on file with us, retaining collection agencies, and legal counsel) The members of Country TreaZures work hard to keep Country TreaZures sites and services working properly and the Community safe. Please report problems, offensive content, and policy violations to us. Without limiting other remedies, we may limit, suspend or terminate our service and user accounts, prohibit access to our sites and their content, services and tools, delay or remove hosted content, and take technical and legal steps to keep users off the sites if we think that they are creating problems or possible legal liabilities (for example, and without limitation, policies related to shill bidding, conducting off-Country TreaZures transactions, circumventing temporary or permanent suspensions or users who we believe are harassing our employees or other users). Additionally, we may, in appropriate circumstances and at our discretion, suspend or terminate accounts of users who may be repeat infringers of intellectual property rights of third parties. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time, or to modify or discontinue Country TreaZures sites, services or tools.
If you have a dispute with Country TreaZures, you release us (and our members, and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. Country TreaZures is located at W2094 County Road B, Dalton, WI 53926. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to act with respect to a breach by you or others doesn't waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this Agreement. We may amend this Agreement at any time by posting the amended terms on this page. This Agreement sets forth the entire understanding and agreement between us.
