TERMS & CONDITIONS:
The below terms of use is a legally binding agreement between you the "Bidder" and Mulrooney Auction Co, its agents employees, representatives and owners, herein refered to as "Auctioneer". The auction the Bidder is registering for is governed by the Terms set forth within the the below agreement., and any additional announcements by the Auctioneer on the day of the auction take precedent.
By using this website your are agreeing you are over the age of 18 and with the legal capacity to enter into this agreement .
Everything must be paid in full on the day of the auction regardless of when it is removed. Cash, Wire Transfer, Visa & Mastercard are accepted. A 15% Administrative Fee is applicable to online purchases. Applicable sales tax rates will apply.
Everthing will be sold "as is, where is" with all its faults regardless of any statements of condition made from the auction block. All bidders are strongly encouraged to rely entirely on their own inspection and information. No guarantees or warranties of any kind are expressed or implied. The Auctioneer will not be held liable for discrepancies in the description of the item/lot.
Descriptions of items to be sold are believed to be accurate but are not guaranteed nor waranteed. Bidders should rely on their own inspection of the item. The Auctioneer will not be held liable for discrepancies in the description of the item/lot to be sold. Bidders MUST rely on their own inspectionof the item/lot.
The Bidder is responsible for knowing which item he/she is bidding on, if the Bidder is unsure DO NOT BID.
By placing a bid, the Bidder signifies that they have inspected the item to their satisfaction or they have chosen not to personally inspect the item. The Bidder acknowledges the risks involved in bidding on an item they have not personally inspected.
The Auctioneer reserves the right to accept bids in any increment he/she believes is in the best interest of his/her client, the seller. The Auctioneer RESERVES THE RIGHT TO REJECT ANY BID AT THEIR SOLE DISCRETION. The Bidder acknowledges by submitting a bid, that their bid may be rejected.
Sales Tax will be added to all the purchase of all taxable items as required by CA State law. Dealers who purchase for resale must file their resale permit numbers with the auction company or a Bill of Lading must be presented upon payment.
Any reserve price is at the descretion of the Consignor. The Consignor of the item/lot reserves the right to bid on their item/lot in the public auction up to the reserve price that the Consignor has set.
LOCAL PICK UP ONLY from the auction site. The site is open 8:00 am. to 4:00 p.m. PST. All items/lots must be removed by Wednesday November 6th, 2024, at 4:00 p.m. PST Items/lots that are not removed by the deadline will incur storage fees at the rate of $250.00/day plus additional moving costs.
Mulrooney Auction Company will not arrange shipping.
In the event that litigation is entered into by the Auctioneer and the Bidder both parties agree that this above Agreement has been entered into, and any conflicts will be resolved in the jurisdiction and continuing venue in San Joaquin County, California.
