Terms and Conditions Effective Date: 09/08/2024 1. Introduction Welcome to JNA Distributions Auction. By registering in our auction, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before participating in any auction. 2. Eligibility You must be at least 18 years old to participate in our auctions. By registering or bidding, you represent and warrant that you meet this age requirement. 3. Registration a. Bidders must complete the account registration on HiBid.com and submit any required documents. b. Bidders are required to register for our auction prior to bidding. A credit card verification is done prior to being approved to bid on the auction. c. By registering to bid, you are representing a natural person, a legal established entity or individual with the capacity to enter into a binding contract. d. We reserve the right to reject any registration application at its sole discretion. 4. Auction Item Descriptions All items offered for auction by JNA Distributions Auction are sold "as is" and "where is," without any warranties or guarantees, either express or implied, regarding the condition, authenticity, or description of the items. We make reasonable efforts to describe the items accurately, but descriptions are provided for informational purposes only. We do not guarantee the accuracy or completeness of any descriptions, photographs, or other information provided. The items for auction customer returned merchandise. Some may be new, used, in box, or out of box. Contents and accessories in the box may be missing. All items are sold without any warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We expressly disclaims any and all warranties, representations, or guarantees, whether oral or written, related to the items sold in the auction. 5. Bidding a. Buyer’s Premium: A buyer’s premium, also known as buyer’s fee, is charged on all winning lots. The buyer’s premium will be 15% of the winning price of the lot. b. Bid Submission: All bids are final. Once placed, a bid cannot be withdrawn. c. Bid Increments: Bids must be placed in increments as specified on the auction page. d. Automatic Bidding: You may choose to place a max bid (maximum bid) representing the highest amount that you're willing to pay at the moment. Our automatic bidding technology will then place bids on your behalf. It will always place the lowest bid necessary and never go higher than your max bid. 6. Auction Duration Soft Close: The auction will run for a specified period as indicated on the auction page. If a bid is placed in the last few minutes for a specific item, the end time is extended. This process continues until there are no more bids made within the last few minutes. The auction ends when the timer reaches zero, unless otherwise extended or interrupted by technical issues or other factors. 7. Payment Payment Terms: At the conclusion of the auction, the credit card on file will be automatically charged for winning bid amount, applicable buyer’s premium, taxes and other charges as specified in the auction terms. 8. Limitation of Liability JNA Distributions LLC shall not be liable for any damages or losses arising from or related to the purchase of auction items, including but not limited to, damages resulting from the items' condition, use, or subsequent resale. Bidders acknowledge that they assume all risks associated with the purchase of items sold "as is." 9. Delivery and Shipping We do not offer any shipping. Please do not bid if you are from another city or state. You will have to pick up or forfeit the bid. Pick up days are Monday – Thursday 9am – 4pm. Any items not picked up will be considered forfeited. 10. Cancellation and Refunds Cancellations: All bids are final. Bids cannot be withdrawn once they have been placed. Refunds: All items with the winning price above 50 dollars are guaranteed on site. Anything below that is sold “as-is”. Bidders are encouraged to inspect their items (that are over 50 dollars) and dispute anything on site. Once a bidder leaves with the item, any guarantees on that item is voided. 11. Changes to Terms We may modify these Terms at any time. Any changes will be effective immediately upon posting to the Site.
