BIDDING; CONDUCT OF SERVICES In order to participate in an auction on the website, you must first register. To do so, you will need a valid drivers license, a credit card, a photo ID, and specific information about yourself. Kindly make this available when you register. We reserve the right to reject any bid without prior notice or justification. All sales are final, and no returns, exchanges, bid retractions, or refunds will be accepted. A reserve or opening bid, which is the secretly acceptable seller's minimum price, may be placed on any and all auction-offered items. Auction City has complete discretion over how an auction is conducted on the Website. You are able to personally inspect things that are up for bidding (called "Lots," and you should do so if you want to know how it looks, how big it is, and if it has been fixed or restored. You agree that you have either inspected the Lot in question or waived your right to do so by placing an online bid. Cash, Visa, MasterCard, debit, and e-transfer are all acceptable forms of payment. The bid price will be reduced by taxes and a buyer's premium of 18%.On the same day as the auction, full payment must be made on all items. At any point during the auction, a minimum deposit equal to fifty percent of any winning bid can be requested. Check with the Auction City clerk and comply with any deposit requests made at the time of purchase are your responsibility. The full payment will become due immediately if you fail to make the requested deposit. When a deposit is required, you may be contacted via email if you bid online. To gain access to additional bidding privileges, a deposit must be made as requested. Throughout the auction sale, deposits will be charged to the credit card on file. During the auction sale, a preauthorization deposit can be taken from your card that is displayed on the Website at any time without prior notice as an additional deposit against your purchases. We will do our best to provide auction services to the best of our abilities if you choose to bid on a Lot via the website. However, we do not guarantee that you will be pleased with our services or products. In addition to the prices for the hammer and final purchase, you will be responsible for all shipping, insurance, and delivery costs. Unless otherwise specified on the day of the auction sale, all items will be shipped via PAKShip. On the same day as the auction, all items must be removed from the Auction City premises. By the time the auction sale is over, all items that need to be shipped must be organized. We reserve the right to bid on behalf of the sellers at any time during the auction sale without informing registered bidders. Additionally, we reserve the right to protect any items with a moderate reserve or opening bid by bidding on them or removing them from the sale at any time during the bidding process. The buyer will be the highest bidder acknowledged by Auction City. We reserve the right to select the winning bidder, cancel the sale, or re-offer and resell the contested item in the event of disagreement between bidders or doubt on our part regarding the bid's validity. Our sales record is final in the event of a dispute that arises after the sale. When the auctioneer hits the hammer, title to the offered Lot will pass to the highest bidder who has been acknowledged by the auctioneer. This means that the highest bidder (a) assumes full risk and responsibility, including liability for damage to frames or glass covering prints, paintings, or other works, and (b) immediately pays the full purchase price as required. We will charge interest on overdue accounts at a rate of 24% per year, compounding monthly. Once all outstanding invoices owed to Auction City have been paid in full, the buyer will not be permitted to take possession of any lot they have purchased from Auction City. You may be sent to collections and/or sued in the Small Claims Court and/or the Superior Court if you do not pay the full purchase price for any lot(s) within the stipulated time frame or abide by any of the "Terms of Sale." In addition, the purchaser may use any money paid for prior invoices and lots that are not in their possession as a deposit toward outstanding invoices without prior notice. If they are not already on the Auction City premises, all items purchased by back bidders or on a second chance offer can be picked up through your own delivery arrangements for the designated distribution center. With advance notice to the buyer, any items offered for auction that are not in the Auctioneer's possession or on the premises will be delivered. By bidding, you grant us, the sellers, and any other affiliated businesses permission to charge your credit card the full amount of any purchases made and/or assigned to your registered Website account if you fail to pay the full price within the specified time frame. You are aware and agree that your deposit will be returned to you, but that it can be used to cover any outstanding obligations. Items will be considered abandoned and resold in a subsequent auction sale without notice if they are not paid for in full, claimed, shipped, or picked up in accordance with the terms and conditions of sale and within seven days of the sale's conclusion. Buyers and bidders who do not comply will be blacklisted from future auction sales and all deposits will be forfeited. All sales will be due and payable at the time of failure if the electronic component fails for any reason during the auction. If the electronic failure cannot be fixed within a reasonable time, we reserve the right to cancel the remainder of the auction sale. In a subsequent auction sale, items might be offered again. Without prior approval from Auction City, no cameras, video, or recording devices of any kind are permitted in the auction sale. Specifications for Services and Products PRICING; Typographical errors Auction City does not guarantee that the website's product and service specifications, pricing, or other content is complete, accurate, or error-free, though we promise to do our best to ensure its accuracy. Auction City reserves the right to reject or cancel orders in its sole discretion in the event of pricing or product specifications errors. Auction City will credit your account for the amount of the charge if your credit card is used before you cancel. All items are subject to withdrawal from preview, from advertising and from the auction sale at the sole discretion of Auction City without notice at any time. No representations or warranties regarding merchantability, fitness for a particular purpose, the correctness of any catalogue or other description, or the physical condition, size, quality, rarity, importance, medium, provenance, exhibitions, literature, or historical relevance of any property are made by the Auction City, its staff, or the consignor. Furthermore, no statement, whether oral or written, in the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, or elsewhere, shall be deemed a warranty The consignor and Auction City neither explicitly nor implicitly guarantee that the buyer will acquire any copyrights, including but not limited to reproduction rights in any property. Errors and omissions in any catalogue or additional materials are beyond our and the consignor's control. Any written or verbal appraisals, certificates of authenticity, values, or retail replacement prices that may accompany an item or be stated verbally by an auctioneer or employee prior to, during, or after an auction sale are not guaranteed by us. During the auction, Auction City reserves the right to make additional verbal announcements regarding any and all Terms and Conditions. The terms and conditions between the seller and the bidders include all verbal announcements and terms. The buyer will be in default if any of the terms aren't followed. In addition to the legal remedies that the auction company, its agents, and consignor have, the auction company has the option to (i) resell the purchased property at auction or private sale, (ii) cancel the sale of that lot or lots sold to the defaulting purchaser, or (iii) effect any combination thereof. Any deficiencies, costs, handling fees, late fees, expenses, sales commissions, legal costs, collection costs, and incidental damages will fall on the buyer's shoulders. All unpaid items will be subject to a non-refundable service charge equal to 35% of the bid price and the registered bidder's buyers premium, in addition to any other legal remedies we may have.
