These terms, subject to periodic modifications or amendments, form a binding agreement between Bidwave Inc. ("Bidwave Inc.," "we," "us," etc.) and you ("you," "bidder," "purchaser"). We're your premier online auction platform offering a diverse range of products spanning electronics, household essentials, health & beauty products, home and kitchen appliances, tools, and much more! Our inventory comprises both sealed and open-box items sourced primarily from customer returns, overstock shelf pulls, and unclaimed packages from renowned online retailers. *** Age Restriction *** BidWave Inc. strictly prohibits individuals under the age of 18 from participating in our auctions. Bidders must be at least 18 years old or older to place bids or make purchases through our platform. By engaging in our auctions, you certify that you meet this age requirement. BidWave Inc. reserves the right to refuse bids or cancel transactions if we determine that the bidder is under the age of 18. *** Information Accuracy*** Ensuring accurate information regarding your credit card is crucial. The billing address provided must match the billing address associated with your payment method for successful transactions. *** Bidding *** All bids placed through Bidwave Inc. are considered final and cannot be reversed. We urge you to exercise due diligence to ensure your intention to bid on a product before placing a bid. Please be aware that bidding by mistake or error does not fall under our Return and Refund Policy. *** Invoices *** Invoices will be generated within 24 hours following the auction's conclusion. Each invoice will detail the quantity and description of items purchased, along with a comprehensive breakdown of payment. This breakdown will include the total extended price, buyer premium, handling fee, tax, and the overall invoice total. All invoices issued by Bidwave Inc. will feature a 12% buyer's premium + a $2 CAD per Lot handling fee and a 13% sales tax. *** Payment *** We accept Credit cards and Debit cards, Payment must be made at the time of the pick up. We accept Tap/Chip method. Incase of Cash, exact change must be brought in. *** Item Forfeiture*** For customers who have not completed payment, purchased items will be reserved for (3) days from the Auction closing date. Failure to remit payment within this timeframe grants Bidwave Inc. the right to restock the items won in your bid. If customers encounter special circumstances and require item pick-up after FIVE (5) days, they must submit a formal notice to Bidwave Inc. In such cases, a storage fee of $25 CAD per day will be applied. We sincerely hope for mutual understanding regarding our limited storage space and the fact that we are not a storage warehouse. *** PICK UP *** Pick up is only on Friday & Saturday between 11 AM - 5 PM. *** SHIPPING *** We do not offer shipping at the moment. *** TERMINOLOGY USED *** While Bidwave Inc. endeavors to present all items accurately in both photographs and descriptions, it's important to note that all items are sold on an 'as is, where is' basis, with all faults. We strongly advise bidders to thoroughly read the full description of each lot and carefully examine the in-house photos of the actual item(s) (those following the retail photos) before placing any bids. Neither Bidwave Inc. nor the seller assume any responsibility for errors or omissions. Please be aware that this is a Returned & Open box Merchandise Auction, and items may have missing parts, damage, may not match the exact item in the box, or could not be in perfect condition. References to the condition of items are subjective opinions. For instance, "FACTORY SEALED" means, that the item arrived sealed and has not been opened. "APPEARS USED" indicates that it is our opinion the item has been previously used, and "NEW" indicates that, to the best of our knowledge, the item appears to be unused (this does not necessarily mean it's factory-sealed) Lots with no condition means that we have no judgement on it. It's the bidder's responsibility to come to a conclusion based on the in house photos. While Bidwave Inc. makes efforts to inspect items, it's impossible to inspect every item thoroughly. All items are sold "AS IS" and are considered FINAL SALE. *** THIRD PARTY SERVICES *** If you choose to enable, access, or utilize third-party services, please be aware that your access and usage of such services are governed exclusively by the terms and conditions outlined by the respective service providers. Bidwave Inc. does not endorse, assume responsibility for, or hold liability regarding any aspect of these third-party services, including their content or data handling practices, including your data. By utilizing these services, you waive any claims against Bidwave Inc. related to such services. Bidwave Inc. bears no liability for any damage or loss, whether actual or alleged, arising from your use, access, or enablement of any third-party services, or reliance on their privacy practices, data security measures, or other policies. Please note that registration or login may be required on the platforms of these third-party services. By enabling such services, you expressly authorize Bidwave Inc. to disclose your data as necessary to facilitate their usage or enablement. *** REFUNDS *** At Bidwave Inc., we prioritize buyer satisfaction and uphold the quality of items offered to our valued members. We provide a 3-day guarantee for items in the event of misrepresentation in our descriptions, unless the item is explicitly sold "as-is". This guarantee ensures that our buyers can bid on our items with confidence and peace of mind. If you believe that an item does not match its description or if there are discrepancies, please contact us within 3 days of the auction closing date. We will work diligently to address your concerns and facilitate an appropriate resolution, which may include a refund or exchange. Please note that certain items may be sold "as-is", meaning they are exempt from our standard refund policy. It is important to carefully review item descriptions and conditions before placing your bids. Your satisfaction is our priority at Bidwave Inc., and we strive to ensure a positive experience for all our clients. *** LIABILITY*** Bidwave Inc. shall not assume liability or responsibility for any damage or injury to individuals or their property. By participating in our auctions, the buyer explicitly agrees to indemnify and protect Bidwave Inc., its affiliates, and their assigns from and against all claims, losses, expenses, damages, or liabilities, directly or indirectly resulting from an act, including negligent acts or omissions by Bidwave Inc. or anyone acting on its behalf in connection with or arising from the auction. *** MODIFICATION OF TERMS *** BidWave Inc. reserves the right to modify, update, or remove any items listed for auction, adjust auction start and end times, correct typographical errors, inaccuracies, or omissions in item descriptions or auction details, and make any other necessary modifications to ensure the accuracy and integrity of our auctions. These modifications may occur without prior notice and are at the discretion of BidWave Inc. Additionally, BidWave Inc. reserves the right to modify or update these terms and conditions at any time, effective immediately upon posting the revised version on our website. You agree to regularly review these terms to stay informed of any changes. Your continued use of BidWave Inc.'s services following the posting of any modifications constitutes acceptance of those changes. If you do not agree with the modifications, your sole recourse is to discontinue the use of our services.
