Shipping, Payment & Auction Policies Acceptance of Terms: Buyers registering for and placing bids online agree to the following Terms of Sale. Before you place your first bid, YOU MUST accept the Terms & Conditions to which you agree when you check the box to register and place your first bid. TERMS Please do not bid on a firearm if you cannot legally own one. If you do not pass a NICS background check, the firearm will NOT be transferred to you. The item will then be sold to the next higher bidder or the next auction before you receive your refund. An Immediate refund will be less incurred credit card fees. Please be ready to pay for any items you win directly. Buyer’s Premium Fee is 15% * All buyers will be charged 15% buyer’s premium and 8% NYS sales tax if you are a NY buyer. If you are tax exempt, you must send us a copy of your resale certificate PRIOR to the auction starting, once cards are run, we cannot refund sales tax. We accept all credit cards for payment. Magazines that are not state legal will not be shipped to a state with those restrictions. Check with your local FFL prior to the auction if you are unsure of your state’s firearms regulations. Bid accordingly. NYS Residents, Background checks will be conducted on ALL firearm purchases. Firearms must be paid in full prior to the background check. Failure to pass the background check will result in the buyer consigning the item to an upcoming Auction or to the next highest bidder. Any out of state firearm purchases must be shipped to an FFL Dealer. No Exceptions. NO REFUNDS. As a precondition of participating in this auction, the buyer agrees to release the seller and SafeShoot LLC from all liability arising from the purchase, ownership, possession, use or misuse of this item. All firearms should be inspected by a certified gunsmith prior to loading or firing. All items are offered for sale AS IS, WHERE IS, and no special warranty or guarantee is made or implied as to condition,¬ authenticity or era of any described item. ALL SALES ARE FINAL, NO REFUNDS, NO EXCEPTIONS. NO CHARGE BACKS. It is the Bidder’s responsibility to determine condition, age, genuineness, value, or any other determinative factor. NYS Sales Tax and internet sales tax will be charged when it applies. Dealers must provide a valid Tax-Exempt Certificate prior to bidding to be tax exempted. PAYMENT TERMS: ONLINE ONLY AUCTIONS ARE CREDIT CARD ONLY SALES. SafeShoot LLC accepts Visa, MasterCard, Discover, American Express. All merchandise must be paid for in full within 72 HOURS of the date of the invoice. It is the bidder’s responsibility to submit any additional information necessary, including an FFL, to initiate transfer and shipping. All goods not retrieved by Buyer within 30 days after the invoice date, shall be subject to a storage fee of $20 per item per month. The Buyer authorizes SafeShoot LLC to sell at their standard commission and consignment contract terms, any goods not retrieved after a 90-day period in any manner deemed appropriate by SafeShoot LLC and the proceeds will be applied to any outstanding balance due from the buyer. The Credit Card link for online credit card payments will be listed on the buyer’s invoice. Credit Card payments are subject to the full buyer’s premium of 15%. Credit Card payments are only accepted from the buyer’s name listed on the invoice. SafeShoot LLC reserves the right to refuse to ship to a different address than the billing address on the credit card being used. SafeShoot LLC does not allow credit card chargebacks for any reason and any delivered firearms subject to a chargeback will be considered as a stolen firearm and reported immediately to the authorities. Credit card information is not stored and payment for invoices is the buyer’s responsibility. SALES TAX: SafeShoot LLC is required to collect sales tax where applicable. All Lots are subject to all applicable state and local taxes, unless the bidder has an exempt status. A Tax-Exempt Certificate must be filed prior to the auction. SafeShoot LLC needs to verify the exempt status prior to all bidding. PICK UP INFORMATION: *You agree to pick up dates and times per Terms and Conditions, please be aware of dates and times, we cannot keep holding items past pick up dates. * Firearm purchases require an appointment; links will be sent with your invoice after the auction. * If your county requires special paperwork, please send an email requesting the pistol paperwork * All Ammo & accessories pickup is also by appointment only. * If you are purchasing any firearm, please be sure you are buying it under YOUR NAME. No one else can buy or pick up a firearm, only the name of the purchasing bidder. SafeShoot is an FFL and NYS DEALER. All paperwork for firearms will be done on site. There is a NYS Background Fee of $9.00 for firearms and $2.50 fee for ammo. *NY ONLY* If you purchase a handgun that needs to be added to your pistol permit, PLEASE contact your county for information. You can print out the paid invoice we email you and bring it (or send it, whatever your county’s rules are) to your pistol permit office. If you need a specific form for your county, please provide it. They will add the handgun to your permit and issue you a purchase coupon for your handgun. You will then come to pick up your handgun at SafeShoot. Be sure to bring NYS pistol permit, receipt, and purchase coupon purchase coupon). All firearm purchases require a Federal Background Check (NICS Check) unless you have a Federal Firearms License. All pistols require a NYS pistol permit unless you have a federal firearms license. Some firearms are not NYS compliant. Read the descriptions prior to bidding. SHIPPING: Local New York Residents can pick up directly from us by appointment. We are an FFL, Federal Firearms License dealer. All firearms and ammo picked up at SafeShoot require a NYS NICS background check. All others are shipped UPS, Fedex or USPS to FFL Dealers. Shipping Instructions: We ship anywhere in the USA., WE DO NOT SHIP FIREARMS OUTSIDE THE USA. All shipping will be at the buyer's expense. Whenever possible we will try to use a flat rate shipping fee. Sometimes additional shipping costs can occur due to certain shipping zones or territories. You will be notified in advance. Your credit card will be charged the day of shipping. Shipping is the responsibility of the Buyer, and the Buyer must make all Shipping or Delivery arrangements. All firearms except those considered antiques with be shipped to an FFL dealer selected by you. We charge a $10 transfer fee for all firearms. Insurance is included in the shipping charges. All items, fees and shipping charges must be paid in full before any item is released or shipped. All Paid orders upon completion will be send an email containing a PDF invoice, you will receive a secondary email from us with a tracking number. This will go to the email on file with us. NEW NYS Residents Picking Up at SafeShoot: Effective Sept. 13th, 2023, prior to transfer a firearm, rifle, shotgun or ammunition to a purchaser you MUST go complete a NYS NICS Background check process. ** $9.00 per firearm transaction ** 2.50 per ammunition transaction. If picking up multiple firearms or ammunition, you will only be charged (1) fee. If you purchase a firearm and ammunition on one invoice you will be charged $11.50 by NYS. * These charges will be added on your invoice as a line item. All ammo shipped to NYS residents will be to an FFL dealer, not a residence. ANTIQUE FIREARMS: Per BATF: The term “antique firearm” means: any firearm (including any firearm with a matchlock, flintlock, percussion cap, or similar type of ignition system) manufactured in or before 1898; or any replica of any firearm described in subparagraph (A) if such replica is not designed or redesigned for using rimfire or conventional centerfire fixed ammunition, or uses rimfire or conventional centerfire fixed ammunition which is no longer manufactured in the United States and which is not readily available in the ordinary channels of commercial trade; or any muzzle loading rifle, muzzle loading shotgun, or muzzle loading pistol, which is designed to use black powder, or a black powder substitute, and which cannot use fixed ammunition. For purposes of this subparagraph, the term “antique firearm” shall not include any weapon which incorporates a firearm frame or receiver, any firearm which is converted into a muzzle loading weapon, or any muzzle loading weapon which can be readily converted to fire fixed ammunition by replacing the barrel, bolt, breechblock, or any combination thereof. FFL: Federal Firearms Licensee with a current and valid license to be a firearms Dealer / Manufacturer / Importer CURIO & RELIC HOLDER: FFL type 03 or C&R license or Collector NFA (National Firearms Act of 1934) Weapons (commonly called “Class 3 BIDDING TERMS: The auctioneer will determine the highest bidder. The auctioneer alone has the right to reopen the bidding of an item at any time if deemed necessary due to a dispute. SafeShoot is not responsible for any errors in bids, omissions of bids, or failure to execute bids and shall have no liability to any bidder for any technical or other failure associated with internet, absentee bidding, or telephone bidding. In the event of an on-site utilities or internet services interruption, the auction will be suspended until such a time that the utility can be restored. Consignors are not allowed to bid on their own merchandise nor have any agent bid on their behalf. If the Auctioneer recognizes such bidding, the Auctioneer reserves the right to withdraw any or all items consigned by the offending consignor. ABSENTEE BIDDING: SafeShoot will accept absentee bids if pre-authorized by email. Absentee bidders must use the absentee bid form and clearly mark the lot number, title and maximum bid amount. If there are two (2) identical bids placed on the same item, priority will be given to the first bid received. All bids must be left in increments as published for that auction. If a bid is “out of increment” the auctioneer will automatically round the bid down to the next correct increment. Seller(s) agrees to allow the Auctioneer to accept and execute absentee bids in a competitive manner for potential buyers and under the SafeShoot absentee bidding terms and conditions. During the live sale, the auctioneer will execute absentee bids competitively (starting with the lowest possible bid point) up to the maximum amount indicated. ONLINE BIDDING: Online bidding through Autionflex 360 link, Hibid or other bidding platforms may be available. These terms and conditions apply, as well as additional terms and conditions for each third- party platform. These Terms & Conditions will take preference over any posted online terms, and agreements. Due to our fast-paced auctions, phone bidders, Internet bidders and absentee bids, the auctioneer has the final word on all item(s) sold. The bidder assumes the risk of winning an item online and discovering the item has sold to another bidder. This is due to the final call of the auctioneer and the operator not being able to re-open that lot. Registered Online bidders are fully responsible for accidental bidding as if they bid normally. *Your bid must adhere to the bid increment schedule.
