AUCTIONEER’S RIGHTS: Montana Pickin' reserves the unchallengeable right, at its sole discretion, to refuse any bid, bidder, or participant at any point during the auction process. The auctioneer holds the authority to reject bids deemed not genuine, as well as participants who fail to comply with the auction terms and conditions. This right extends to individuals with a history of fraudulent activity, violations of auction rules, or those who, in the auctioneer's judgment, may disrupt the integrity of the auction. Montana Pickin' may exercise this right without providing any explanation or justification for its decision. By participating in the auction, bidders acknowledge and accept the auctioneer's discretion in refusing bids or participants. BIDDING RULES AND PROCEDURES: In adherence to the bidding rules governing this online-only auction, participants are required to register on the auction platform, HiBid.com, providing necessary personal information and agreeing to the terms and conditions. Only registered bidders with approved accounts have access to place bids. The bidding process includes specified bid increments and starting bids for each item. The auction operates within a defined timeframe, featuring a soft closing mechanism that extends the auction's end time with each bid. Montana Pickin' shall not be held liable for any internet malfunctions, loss of connection, or system glitches that could hinder your ability to place last-minute bids or receive notifications from our company. Please read thoroughly!! BUYER'S PREMIUM: A 15% buyer's premium will be added to all purchases. REGISTRATION: Bidders must be 18 years of age. All bidders must register through the HiBid auction platform. Credit card authorization is required at the time of registration. PAYMENT METHODS: Accepted payment methods include Visa, MasterCard, Discover, and American Express. SETTLEMENT ISSUANCE: Initial settlements, which state the winning bid amount for each lot and the buyer premium charge (before shipping & handling or applicable storage fee charges), are emailed to the winning bidder within 24 hours of the auction closing. Bidder's are accountable for verifying the accuracy of their provided email address. Montana Pickin' holds no responsibility for undelivered settlement emails. In the event a winning bidder does not receive their initial settlement after the 24-hour mark, it is their responsibility to contact Montana Pickin'. Buyers have 36 hours following the auction’s closing to report errors or disputes on the initial settlement. Failure to do within the outlined time frame will waive the buyer’s right to contest the settlement. Following the full payment of charges listed in the initial settlement, a second settlement containing shipping, handling, and any applicable storage fees will be emailed to the buyer. Montana Pickin' will not entertain disputes concerning the fees outlined in the second settlement. A third and final settlement will be emailed once the applicable charges on the second settlement have been paid in full, indicating a zero balance. Following the issuance of the final settlement, lot(s) will be promptly shipped. PAYMENT OBLIGATIONS: If no errors or disputes are reported concerning the initial settlement, or if 36 hours have passed since the auction's close, the card on file will be charged. In the event of declined cards, the buyer will be contacted for an alternative payment method. Failure to provide an alternative card with sufficient funds will result in the immediate forfeiture of the item(s). It is the bidder's responsibility to ensure that their card on file has adequate funds. Please refer to 'Payment Failure Consequences' for more details. Following the calculation of shipping and handling, or any applicable storage fees, a second settlement will be emailed to the buyer. Upon sending the email with the second settlement, the card on file will be charged accordingly. A third and final settlement will then be emailed to the buyer. The conditions for a declined card are applicable to the second settlement as well. Lot(s), whether requiring in-person pick-up or shipping, will be made available or shipped upon reaching a zero balance in the final settlement. PAYMENT FAILURE CONSEQUENCES: Failure to make full payment (including shipping & handling and any applicable storage fee charges) will result in following consequences, including: Forfeiture of lot(s): If a winning bidder fails to uphold their responsibilities as outlined in the auction’s ‘Terms and Conditions’, Montana Pickin' reserves the right to deem the lot(s) forfeited. This forfeiture results in the buyer relinquishing any claim to the lot(s), empowering Montana Pickin' to take immediate and appropriate actions, including resale or disposal of the lot(s). No refunds will be provided for forfeited lot(s). Second-highest Bidder: Back-up bidders may purchase the forfeited lot(s) at the last bid amount. Legal Action: Montana Pickin' reserves the right to pursue legal action or engage collection agencies for unpaid balances, with buyers responsible for associated costs and fees. REFUNDS: Once a settlement payment is completed, it is considered final, and no refunds will be issued under any circumstances. Montana Pickin' maintains a strict no-refund policy to ensure fairness and consistency in all transactions. MODIFICATION OF PAYMENT TERMS: Montana Pickin' retains the right to modify payment terms without prior notice. Changes are effective immediately upon posting on the website. SHIPPING: Shipping for specific lots is available as indicated in item descriptions, excluding lot(s) marked "LOCAL PICKUP ONLY". Bidders are responsible for accurately providing their shipping address during registration. Shipping charges include the actual shipping costs for the shipping carrier chosen by Montana Pickin’ and a handling fee of $5.00 per lot for lot(s) that require shipping. Efforts will be made to combine lots for shipping to ensure the best possible shipping rate. Lot(s) are shipped promptly upon receipt of full payment. If the buyer deems that the value of the purchased lot(s) warrants additional shipping insurance coverage, it is the buyer's responsibility to request this extra shipping charge. Buyers will not receive shipping notifications with tracking information, they must email Montana Pickin' to obtain the tracking number. We offer international shipping to Canada, provided that the lot(s) are not subject to prohibitions or additional regulations that may impede shipping across borders. PICKUP: Buyers are responsible for personally collecting the lot(s) labeled 'LOCAL PICKUP ONLY' and must provide valid identification, such as a Driver's License, State Identification Card, Passport, Military ID, or Government-issued ID. Montana Pickin' does not provide assistance with palletizing and/or loading, so please plan accordingly. Buyers who have secured lot(s) requiring in-person pickup will receive an email invitation link for Sign Up Genius once payment has been confirmed. They must pick up their lot(s) during their Sign Up Genius scheduled time slots. Given that pickup dates are explicitly specified in the auction details, if there are any scheduling conflicts, Montana Pickin’ requires the bidder to communicate via email within 24 hours following the auction's close. In the event that a buyer necessitates alternative pickup dates/times or requires third-party shipping arrangements other than the dates/times provided, a daily flat-rate storage fee of $10 will apply. This fee accounts for the additional demands on storage space and staffing hours required to accommodate such arrangements. The storage fee will be calculated starting from Day 1 (the day immediately following the auction's close) up to the day of the approved rescheduled pickup date. Lots will not be released until the storage fee has been paid in full. Refusal to pay the storage fee will result in the immediate forfeiture of the lot(s), and no refunds will be provided. **If a buyer is not local, it is the buyer’s responsibility to arrange shipping through a third-party carrier at their own cost. Montana Pickin’ must be informed via email immediately following the auction’s closing about the intent to arrange third-party shipping. Finalize any third-party shipping arrangements only after receiving Montana Pickin’s approval on an alternate pickup date/time. Upon finalizing third-party shipping arrangements, email Montana Pickin’ a receipt confirming the scheduled third-party shipping details. Failure to collect lot(s) during the scheduled Sign Up Genius slots, approved alternate pickup dates/times, or within 15 days of the auction's close (for lot(s) stored longer due to alternative pickup arrangements) will result in the classification of the lot(s) as abandoned. Consequently, the buyer forfeits any claim to the lot(s), and Montana Pickin' reserves the right to take appropriate actions, including resale or disposal of the abandoned lot(s). No refunds will be provided for abandoned lot(s).
