Sale Terms 1) No Shipping is offered for this sale. All items you must pay for and pick up the following two days after the close of the auction. If additional time is needed for pick up please contact us. Payment however needs to be done within those two original pick up days. Payment Is only accepted in Cash or Credit/Debit card. 2) All property is sold "as is, where is" without any warranty or guarantee, expressed or implied. You may contact us to schedule an appointment to preview an item. Previews will be held the Day prior to auction closing. 3) Sales tax. Local sales tax will be charged unless at the time of payment we are provided with a copy of your resell tax id. 4) Bidders Premium is 10% 5) Item Descriptions are done to the best of our ability . All items are final sale. Please review description, photos and if needed make a reservation for an item preview. All items sold as is, where is and with all faults. 6) Failure to follow any terms and conditions will get you blocked from any future auctions. Auction Bidder Terms and Conditions. By entering or using site, our online bidding services and or by registering or bidding, the Bidder (you) agree to all set forth terms and conditions as outlined below. Auctioneer ( Diggers Estates) reserves the right to add , remove and or change terms and conditions from time to time as needed. Bidder also agree to all such changes by any use of the site. Only registered users are allowed to bid and the bidder, as an account holder after having registered, is responsible for the account password and any use of said account. Information gathered in registering, and use of the site is held confidential. Diggers will not sell nor share any personal information for any reason with the exception of police proceedings or by a judge ordered warrant. When bidder registers they are entering into a legal and binding contract. Bidder agrees to provide honest, and current information while registering to use the site. Bidders under 18 years of age are not permitted. Bidders must be and remain in good standing with Diggers Estates. Diggers reserves the right to reject an online bidders registration, and or terminate any users right to use the online bidding for any reason and without limitation. Bidder and his or her agents and employees agree to assume all risks of damage to person or property. Bidder and his or her agents and employees specifically release and forever indemnify Auctioneer, it's employees, agents, and assigns, from any liability and causes of action. ALL SALES ARE FINAL. THERE ARE NO REFUNDS, EXCHANGES or REFUSALS All property is sold "as is, where is" without any warranty or guarantee, expressed or implied.. As the highest bidder, you are the buyer and are bound by the terms and conditions of this agreement and sale. The BUYER assumes full responsibility for any item purchased at time it is sold, including the security of the item(s). Though we will do our best to maintain security of the items, there will be no refunds for stolen or missing items once the Auctioneer announces, "sold". In no event shall a bidder or buyer hold the Auctioneer responsible for having made or implied any warranty or merchantability or fitness for any specific purpose. 1) Bidder understands that they are entering into a binding contract by registering and or bidding. Bidder is responsible for all bids entered. Bids cannot be changed, altered, or cancelled even if entered in error and notified to us. Bidder accepts full responsibility for any and all bids entered upon their account and including the liability to pay on time for any won lots . 2) Bidder will provide complete and correct information during registration and will update our files of any changes to that information. Bidder also agrees to use site in a legal manner and will not use any tactic, software, or other means to change, prevent, or in any way alter he natural proceedings of the site. In special cases and certain catalogs bidder may be required to provide social security number and or log a valid Credit Card on file with us. You will be notified if any such need arises. Bidder will register and conduct all transactions as an individual and not as a business with limited liability. 3) Bidder grants a guarantee to pay for won lots as well as any required fees on time set forth in catalog and with funds accepted by Diggers. If no time is set for payment and pick up then the 48 hour default time applies. Bidder accepts all responsibility for items from the closing time of the sale ( hammer drop) through pick up. Bidder understands and agrees that all sales are final and as is. Diggers is not responsible for any item as of purpose, condition, use, or for any unknown flaws or errors. There are no exchanges, refunds, or guarantees on any item. Bidder is responsible to set up a showing of any items they want to look over more closely. This can be done by contacting Diggers Retail Location. Bidder releases Diggers and its principles of any liability for loss to persons or property while on Diggers places of operation for previews, pick ups, or any other reason. Without limitation you enter at your own risk. All bids and all sales are final. Failure to comply to that will most likely end your ability to use the online bidding services in the future. Items not paid for or picked up in allotted time are considered abandoned and will revert back to Diggers for resale or disposal and with no recourse or refund to bidder. 4) Bidder by entering or using the site and or bidding service agrees to any and all rules and conditions set forth in the sale catalogs along with all those set forth here. 5) Bidder agrees to pay for and pick up won items in the time set forth by the sales catalog. Pick up is at bidders responsibility, expense, and risk. Pick up times and locations will be provided per catalog. 6) Bidder understands and accepts that any item can be pulled from sale at any time. Diggers also maintains the right to refuse any bid for any reason as well as the right to cancel any bid. Diggers also reserves the right to end any persons permission to enter or use the site as well as physical properties. 7) Bidder agrees to release Diggers from liability for any errors, mistakes, or damages, including but not limited to errors with item photos, specifics, conditions, age, valuations, times, descriptions. Use of the online bidding services as well as access to physical locations is at your own risk and you agree to hold Diggers harmless. 8) Bidder agrees Diggers is not responsible for any issues or problems that arise from, at, or during, Bidder releases Diggers and its principles of any liability , loss of persons and or property, as well as any other loss encountered while conducting our business. All terms as well as rights are an agreement between Diggers Estates and the registered bidder and cannot be conveyed, assigned, or transferred to any other party or persons. 9) Bidder agrees here that regardless of situation in the case of any litigation Diggers can only be held liable for the closing price of contested item. Bidder releases Diggers from any costs above and beyond that and waives the right to personal and or property loss. 10) Bidder releases Diggers from liability regarding problems and or cost that arise from using the site due to but not limited to , networks down, software glitches, slow connections, account access issues, refresh rates, bounced connections, resolution quality, security issues, unauthorized access, automatic email failures, as well as any other technical difficulty. 11) The bidder / buyer agrees to reimburse the Auctioneer for all expenses incurred in the collection of any unsatisfied debt in conjunction with this auction. In the unlikely need for representation both Diggers and bidder agree now to binding professional mediation rather than court venue. If mediation may not be had, the Bidder agrees that this agreement is governed by the laws of Colorado. Any venue of court will be within El Paso Colorado and by a judge without jury and said costs awarded to the prevailing party. Any part of this agreement that may be found unenforceable or not valid does not prevent the remainder of the agreement from being in full force and effect. Auction Terms & Conditions REGISTRATION: It is the sole responsibility of the bidder to provide a complete and accurate profile at the time of registration. All bidders must be 18 years old and provide valid drivers license information at the time of registration. Diggers reserves the right to deny registration at it's discretion. PAYMENT: By registering to bid and participating in our auction events, you agree to abide by the payment terms stated in the details of each Auction Event. SALES TAX: All Sales are taxed according to state regulation. 8.1% unless you have a valid UPDATED resale license with Diggers Estates. TAX EXEMPT: It is the Bidder's responsibility to provide the appropriate resale or exemption certificate for each auction at which the Bidder makes a purchase. If you do not provide a valid updated license you WILL be charged tax. AUCTION ITEM DESCRIPTIONS: All items are described and believe to be correct by the selling parties. Nevertheless, neither those descriptions nor any oral statements made by Owner/Seller or DIGGERS Auction Company concerning these items or lots shall be construed as a warranty either express or implied. ITEMS AND LOTS ARE SOLD AS IS - WHERE IS and WITH ALL FAULTS. Bidder acknowledges that all items and lots were available for inspection prior to the auction and, by these terms, The Diggers Auction Company and Owner/Seller encouraged Bidders to carefully inspect each item prior to bidding. THERE ARE NO WARRANTIES OF ANY ITEM SOLD. WITHDRAWAL OF ITEMS: From time to time, it may become necessary to withdraw items from a sale after they are listed. The Diggers Auction Company realizes this is an inconvenience and will not take this course of action lightly. However, we do reserve the right to remove items from the auction in the event the need arises. REMOVAL: Once the auction is over, the buyer owns the item. The Buyer assumes all risk of damage and/or loss of the property until removed from sale premises. The pickup information is stated in each auction event's details. WHAT IS A BID: When a bid is placed a contract is made. The bid is a binding contract between you and the Owner/Seller and the bid cannot be retracted. Once you place a bid and win, you are contractually required to buy the product at the said price you bid. Not paying for and picking up an item may get you banned from future auctions.
