The Short Version:
All items are sold "AS IS, WHERE IS" and with all faults.
* All descriptions believed to be accurate but not warrantied.
* Announcements (verbal, written, online or otherwise) made on the day of the Auction shall be binding over all printed material or oral statements made.
* Bidder inspection is encouraged.
* By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them.
* Bids may not be cancelled once they are placed - ALL SALES ARE FINAL
* Howell & Sons, Inc., Reserves the right to reject any bid at its sole discretion.
* Howell & Sons, Inc., may act to protect the interest of buyers and sellers as an agent, by bidding through the Auctioneer.
* Applicable taxes will be collected (except in the case of tax exemption with certificate on file).
* A Buyer's premium will be charged as follows: 10% up to $499.99; 5% up to $2,499.99; 0% over $2,500. A 3% convenience fee is added for ALL lots selling through internet bidding.
* Payments accepted are Cash, Check, Cashiers Check, Wire Transfer, Credit and Debit cards and must be made by Tuesday following the close of the Auction
* A 3% bank surcharge is applied to ALL Credit and Debit Card purchases whether online or at the Auction Field . Photo I.D. is required for Credit Card Purchases
* A $35 charge is assessed on all returned checks.
* Items must be removed from the Auction Field by Thursday following the completion of the Auction. The Auction Field is closed on Sundays.
* Shippers must comply with the above unless other arrangements have previously been made.

Bidder is responsible to inspect all items and age, condition, description and authenticity of all items prior to placing any bid. Howell & Sons, Inc., shall have no liability, as a result of any errors in description, cataloging, mislabeling or imperfections, for any item. All lot descriptions are merely a guide and the accuracy thereof cannot be guaranteed or warranted by Howell & Sons, Inc., and any lot or item information provided by Howell & Sons, Inc., or its representatives is not guaranteed.
By placing a bid, buyers acknowledge that they have either inspected the item in question, obtained a satisfactory condition report, or are satisfied with the item "as is". Howell & Sons, Inc., recommends each item be examined thoroughly to determine condition and whether or not items have been repaired, restored, or damaged. This is a Consignment Auction. Neither Howell & Sons, Inc., nor the seller make any warranty or representation with respect to the correctness of the catalog.
All participants in the auction must register prior to placing a bid. When you proceed to the registration page for the online auction, you are required to furnish your contact and credit card details. This information will be used to generate your invoice. Providing false information when registering, such as a false name, or fraudulent contact information can result in suspension, banishment and/or legal action. Failure to honor winning bids will also have similar consequences.
Please make sure you know what you are bidding on. BIDS CANNOT BE CANCELLED. All sales are final. In the event of duplicate bids, the Field bid take precedence. If the bid is tied between internet bidders, the earliest bid will be recognized. In the event of a dispute between two or more bidders, the item may be put back up for resale.
Order of sale and bidding increments shall be at the sole discretion of the Auctioneer. The Auctioneer reserves the right to delete or add items at its discretion. Howell & Sons, Inc., may at its sole discretion, act to protect the interest of buyers and sellers as an agent, by bidding through the Auctioneer. The Auctioneer may open bidding on any item by placing a bid as an agent for any buyer or seller. The Auctioneer may continue to bid as an agent for a buyer or seller, either by placing consecutive bids or by placing bids in response to other bidders. Howell & Sons, Inc., may, at its sole discretion, change, modify or alter bidding procedures and conduct Auctions, or cancel or postpone Auctions, at any time including after beginning an Auction. Announcements (verbal, written, online or otherwise) made on the day of the Auction shall be binding over all printed material or oral statements made.
Howell & Sons, Inc., will not be responsible for technology disruptions, errors, or failures (including disruptions to bidding or the failure to execute, recognize, or record online bids), whether caused by (i) loss of connectivity, breakdown, disruption, or failure of the Online Auction Platform, (ii) breakdown, disruption, or failure of a Bidder's internet connection, computer, or system, or (iii) otherwise. Auctioneer may, but will not be required to, continue, suspend, delay, extend, reschedule, or close the Auction because of disruptions caused by technology failures, even after bidding has commenced.
Howell & Sons, Inc., may use an Online Auction Platform Provider to facilitate the Auction. Under no circumstances will Howell & Sons, Inc., be liable for any failure of the Online Auction Platform Provider to perform all or any of its obligations, or for the failure of any affiliates, employees, agents, representatives, or contractors of the Online Auction Platform Provider to perform their obligations.
Immediately upon the conclusion of the bidding and an item is deemed SOLD, ownership shall pass to the Purchaser. Howell & Sons, Inc., shall not be responsible for any loss or damage to any lot or item once the auction is concluded. Bidder is responsible to insure all purchased items immediately.
Howell & Sons, Inc., may refuse any bidder registration privileges at any Auction and/or refuse access to, or remove any person from an Auction site for any reason including, without limitation, bid or item tampering, collusive bidding, violation of these terms or inappropriate behavior. All Bidders agree to leave the auction site upon request by Howell & Sons, Inc.
