Seller, Kissner LLC., offers this grain elevator handling site at online auction with no reservation of selling price. Elevator site is located partly on real estate owned by Seller, and partly on adjacent railroad right of way owned by Norfolk-Southern, a railroad company, which has leased right of way to Seller. Norfolk Southern has separately leased to Seller 1200 ft of railroad track for Seller's use in operation of the grain elevator facility. The leases provide that Norfolk Southern must approve assignment of said leases by Seller to the Buyer so as to be effective, which is a condition precedent to the sale.
Winning bidder will be required to submit applications and fees to Norfolk Southern Railroad for approval to lease said 1.5 acres of adjacent railroad right of way plus an additional lease of 1200 feet of railroad track within the right of way from Norfolk Southern Railroad, which is a condition precedent to the sale of the real estate. New negotiated Annual Land Lease & Track Lease must be approved by railroad. Escrow monies will be refunded to new Buyer(s), if conditions precedent are not true.
