" All Properties are being sold as-is and where-is in every way; no exception. All sales are final. Buyers are responsible to use their own judgment in preview of goods. Inspection of merchandise sold is to be the sole responsibility of the buyer. All information whether oral or written, as derived from sources believed to be correct but is not guaranteed. All information given is from sources believed to be correct, but is not guaranteed. Buyers are best advised to rely entirely on their own information, judgments and inspection of the articles and bid accordingly.
" The auctioneer reserves the right to accept bids in any increment they feel is in the best interest of the auction, and the auctioneer reserves the right to stop the bidding if he feels a person's conduct, actions, or adverse comments are not in the best interest of the auction.
" If you cannot attend the preview but have questions about a particular lot, please contact Dudley's Auction at 352-637-9588 or by emailing Emily@dudleysauction.com for condition report, or to receive additional photos.
" Buyer is responsible for removal of all purchases. Buyer should bring any and all tools required to remove purchases. Dudley's Auction will not be supplying labor, tools or equipment for salvage removal.
" All items must be removed on Load out Dates (June 23rd & 24th) during load out times (7am - 5pm). Any item remaining after the load out dates will become the property of the owner. Failure to remove merchandise within time specified will result in a forfeiture of all monies received. Such forfeiture(s) shall constitute a breach of contract and all purchasers shall remain liable and at risk for any loss, expenses and damages arising from said defaults. Items not paid for in full or not removed within time specified herein may be resold at public or private sale, or disposed of in any manner deemed to be best interest of the seller, without further notice or compensation to the purchaser.
" All invoices will be charged to the credit card registered with at the close of auction. If you would like to pay by cash or check, you MUST let the auction company know during auction registration.
" The Auctioneer reserves the right to accept bids in any increment he feels in the best interest of the seller and to reject the bidding of any person whose conduct, actions or adverse comments are not in the best interest of the seller. The Auction Company reserves the right to withdraw any items from the auction prior to the sale. In case of a disputed bid the decision of the auctioneer shall be final.
" A buyer's premium of 15% will be applicable to all credit card purchases at this auction, with a 2% discount if buyer pays with cash or check.
" Sales Tax will be charged in accordance with state laws. Dealers must provide current certificate of resale, signed and dated at the time payment, to be considered exempt from taxation.
" All Items in the sale are the sole responsibility of the buyer to disconnect and remove all items.
" No Claims will be allowed once goods are removed from premise. Buyer does hereby waive the right to trial by jury to any action litigation that arises in connection with this Auction contract or the auction itself. Disputes arising under this contract will be governed by the laws of the state of Florida.
" BIDDERS AND OTHERS ATTENDING THIS AUCTION AGREE THAT THEY READ AND FULLY UNDERSTAND THESE TERMS AND AGREE TO BE BOUND HEREBY.
" Persons attending preview, sale or removing goods assume all risk of damage or loss to person/property and specifically release the Auctioneer, Dudley's Auction and owners of the real property from any claims arising from attendance of said auction or presence at property.
BY REGISTERING FOR THE AUCTION THE BUYER AGREES THAT TEHY HAVE READ AND FULLY UNDERSTAND THESE TERMS, AND AGREE TO BE BOUND HEREBY.
