Final Pickup of Merchandise – Sunday April 25th 2021 at 5:00 PM “CST”, items not picked up by this time will become the property of K&E Auction Group, LLC for the disposal as K&E Auction Group, LLC sees appropriate and any expenses in doing so will be at the expense of and charged to the Bidder. Payment is due in USD (U.S. Dollars) by the Closing of the Bidding – any items not paid for in full by this time will become the property of K&E Auction Group, LLC for disposal as K&E Auction Group, LLC sees appropriate and any expense in doing so will be at the expense of and charged to the Bidder. Cards on file will be charged within 24 hours following the auction. AUCTION TERMS & CONDITIONS, BIDDER TERMS & CONDITIONS – We advise all bidders to read the Terms and Conditions of the Sale before bidding with K&E Auction Group, LLC. Those who bid are bound by those Terms and Conditions of the Sale, as amended by any oral announcement or posted notices, which together form the contract of the sale between the successful Bidder (purchaser), K&E Auction Group, LLC, and the Seller (cosigner) of the merchandise. TERMS OF SALE – When bidding on any lot offered by K&E Auction Group, LLC, the Bidder indicates acceptance of the following Terms of Sale. Any participation by the Registered Principle Bidder or his/her agent in the auction binds you to this agreement of these terms whether or not you read or understand said terms. K&E Auction Group, LLC reserves the right to reject any bid at our sole discretion. CONDITIONS OF ITEMS – K&E Auction Group, LLC makes every effort to accurately describe all items offered in its auction and/or private treaty sale, however all merchandise in the Auction of sale are sold“AS IS WHERE IS”, and it is the Bidder’s responsibility to determine the condition of each item. KNOW WHAT YOU ARE BIDDING ON. K&E Auction Group, LLC will not be held responsible for typographical errors. Neither we nor the Consigner make any guarantees, warranties, or representation expressed, or implied, regarding the property or the correctness of the catalog or other description of the authenticity of authorship, physical condition, size, quality, rarity, importance, provenance, exhibition, literature or historic relevance, of the property or otherwise. No statement anywhere or anytime whether oral or written, shall be deemed as such a guarantee, warranty, or representation. Prospective Bidders should inspect the property before bidding to determine its condition, size, use and whether or not it has been repaired, altered, restored or otherwise not as intended. The Consigner and K&E Auction Group, LLC make no representation or warranty as to whether the purchaser acquires any reproduction rights in the property. Returns will not be accepted under any circumstances. All items are sold for display purposes. If electrical, mechanical or other working parts are inoperable even if working at the time of the sale, K&E Auction Group, LLC is not liable due to the inherent nature of the age or condition of the merchandise. BIDDING RIGHTS AND RESPONSIBILITIES – The Auctioneer will determine the highest bidder. The auctioneer alone has the right to reopen the bidding of an item if deemed necessary due to a dispute. Title to all merchandise shall pass to the highest Bidder. The buyer will then assume all risk and full responsibility of the lot purchased once ownership has changed. WE DO NOT GUARANTEE THAT BIDS PLACED WILL BE RECEIVED AND PROCESSED IN A TIMELY MANNER. ONLINE BIDDING – This Auction is an Online Only Auction and all Terms and Conditions will apply. Online bidding will take place on Hibid.com. If you have previously registered with Hibid or another Hibid powered website then your existing username and password will work. RESERVES – Some items in this auction may carry a reserve. K&E Auction Group, LLC reserves the right to cancel and/or reopen the auction in the case of system failures. BUYER’S PREMIUM – All successful bids are subject to a 10% buyer’s premium. ADDITIONAL CHARGES: A $25 Lot Fee per auction will be assigned to each Consignor of merchandise. This fee will be waived if the consigned item sells. SALES TAX – All buyers will pay applicable state sales tax. Sales Tax will be charged unless the buyer provides a current Texas state exemption form, by way of Resale Tax permit number or Agriculture Exemption Number, NO EXCEPTIONS. These forms must be emailed or dropped off in person prior to the bidding. K&E Auction Group, LLC will make a copy of your exemption forms for record keeping as required by the State of Texas. We will charge sales tax on all merchandise if these forms are not presented prior to the auction. Buyers should email tax exempt forms to K&E Auction Group, LLC prior to the auction (email address: info@keauctiongroup.com) PAYMENT – All payment will be by credit card. Bidders will be required to register their card prior to bidding. K&E Auction Group, LLC will accept Master Card, Visa and Discover cards. American Express is not accepted. In the few situations where a successful bidder does not remit payment when due, those items not paid and/or picked up by the deadline date will become the property of K&E Auction Group, LLC for disposal as K&E Auction Group, LLC sees appropriate. Any expenses in doing so will be at the expense of and charged to the Bidder. K&E Auction Group, LLC may proceed with the legal steps necessary to protect its interests and will block the bidder from future auction participation. MERCHANDISE PICK UP – Items paid for must be packed, transported and/or removed by the purchaser at his/her own risk after the close of the sale. Employees/Agents of K&E Auction Group, LLC shall not be required to pack, load or transport the merchandise. It is fully at the risk and responsibility and expense of the purchaser. K&E Auction Group, LLC shall not be held liable for any loss or damage that may be caused by the said employees/agents. Packing, loading, shipping and removal of merchandise is not a Condition of Sale. Buyer is purchasing all merchandise “AS IS WHERE IS” without exception. ALL SALES ARE FINAL. NO EXCEPTIONS. Items may be picked up after the completion of the Auction during the following times: Sunday April 18th from 2:00 AM – 5:00 PM “CST” or by apt call 254-291-2465. Final pickup of merchandise – Sunday, April 25, 2021 at 5:00 PM “CST”, items not picked up by this time will become the property of K&E Auction Group, LLC for the disposal as K&E Auction Group, LLC sees appropriate and any expenses in doing so will be at the expense of and charged to the Bidder. POST SALE RETURN POLICY – K&E Auction Group, LLC provides a catalog description of the merchandise we sell. Every effort is made to ensure those descriptions are accurate and that they fully disclose any exceptions to condition. K&E Auction Group, LLC will not accept any returns for any reason or reasons. All merchandise sold “AS IS WHERE IS” without exception. You are advised to inspect the merchandise fully either in person or with your agent, employee, or a knowledgeable person prior to bidding on any merchandise offered in this auction. I agree to indemnify and hold K&E Auction Group, LLC, its auctioneers, personnel, staff, agent(s), workers harmless against any claims arising from dealing with said property pursuant to this commission including loss or damage. This written contract constitutes the entire Agreement between the parties and no modification of this contract shall be effective unless made in writing and signed by both parties. Consignor acknowledges receipt of a copy of this contract and any attachments (if any). Consignor also acknowledges that they have read and understood this contract and agree to the responsibilities, obligations, and conditions thereof. In the event any one or more of the provisions contained in this contract shall for any reason be held by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other provisions in this contract. This contract shall be governed by the laws of the State of Texas and venue for any lawsuit involving this contract shall be in Coryell County, Texas.
