All lots are sold AS-IS, WHERE-IS, with all faults, imperfections and errors of description. Due diligence is the responsibility of the bidder/buyer. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. PAYMENTS: All sales are final. No credit card charge backs will be allowed. All accounts must be settled at the conclusion of the auction. We accept Visa, MasterCard, Paypal, Cash, Check, Venmo & Wire Transfers. DEFAULT OF BUYER: Successful bidder not paying for items within 3 days of the date of the auction will be considered in default. Such default by the Successful Bidder will result in that Bidders liability to both the Seller and WESTERN COLORADO AUCTIONS. Seller shall have the right to (a) declare this contractual agreement cancelled and recover full damage for its breach, (b) to elect to affirm this contractual agreement and enforce its specific performance or (c) Seller can resell the items either publicly or privately with WESTERN COLORADO AUCTIONS and in such an event, the Buyer shall be liable for payment of any deficiency realized from the second sale plus all costs, including, but not limited to the holding/transporting/storage costs of the items, the expenses of both sales, legal and incidental damages of both the Seller and WESTERN COLORADO AUCTIONS. In addition, WESTERN COLORADO AUCTIONS also reserves the right to recover any damages separately from the breach of the Buyer. The purchaser agrees to pay all reasonable attorney fees and costs incurred by WESTERN COLORADO AUCTIONS in the collection of funds. The purchaser also agrees that a storage/handling fee of 2% per month be added to the balance of any unpaid balance due WESTERN COLORADO AUCTIONS and any other costs or losses incurred by the Buyers failure to adhere to these terms. Any debt collection or dispute proceedings will be litigated or arbitrated in MESA COUNTY, COLORADO at the option of both the Seller and WESTERN COLORADO AUCTIONS. Both the Successful Bidder and Seller shall indemnify WESTERN COLORADO AUCTIONS for and hold harmless from any costs, losses, liabilities, or expenses, including attorney fees resulting from WESTERN COLORADO AUCTIONS being named as a party to any legal action resulting from either Bidders or Sellers failure to fulfill any obligations and undertakings as set forth in this contractual agreement. SHIPPING: Unless indicated that the Buyer will pick up, the auction company will arrange packing and shipping. Packing and shipping costs are the responsibility of the Buyer. All items will be insured for the purchase price. Our first priority is to deliver your new purchase in excellent condition. BIDDER VERIFICATION: Bidding rights are provisional, and if identity verification is questionable, WESTERN COLORADO AUCTIONS has the right to reject the registration, and bidding activity will be terminated. The Seller and WESTERN COLORADO AUCTIONS reserve the right to preclude any person from bidding if there is any question as to the person's credentials, mental fitness, etc. Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. If the registered bidder's user name is offensive to WESTERN COLORADO AUCTIONS or in their sole opinion detrimental to Bidding Activity, then WESTERN COLORADO AUCTIONS reserves the right to delete the bidder from bidding or unilaterally change the username with notification to the Bidder. CONDUCT OF THE AUCTION: Conduct of the auction and increments of bidding are at the direction and discretion of Western Colorado Auctions, Inc. All decisions of WESTERN COLORADO AUCTIONS are final. Your bid on this auction indicates both an understanding and an acceptance of the terms of this contractual agreement between you, as the Bidder, and both WESTERN COLORADO AUCTIONS and the Seller. Your bid further indicates that you, as the Bidder, are prepared to purchase items under these terms and conditions. 4 Day Credit Charge After 4 days if payment has not been received we will process your card for payment. Shipping Terms Each shipped package will include a handle fee for materials and labor to package. We ship using priority mail and ship with insurance. CONDITIONS OF SALE 1. The highest bidder shall be the purchaser, & any dispute arising either before, during or after the sale, shall be determined by the Auctioneer. 2. Lots may be grouped, withdrawn or divided at the discretion of the Auctioneer. 3. The Vendor retains the right to fix a reserve price, or to bid for any lot. 4. Purchasers shall give their bidding number after the sale of each lot, and shall arrange for the removal of same at their own expense, of the lots so purchased on the delivery day stated, without causing damage to either the premises or other lots. Any lots not so removed may be re - sold by the Auctioneer, and any deposits forfeited. No items may be removed from sale without docket. . All goods must be paid for and collected or Shipped within 7 Days 5. Lots bought or unsold by auction must be collected within 7 DAYS. After the expiry of this period, a storage charge of $5 per item per day will be charged. Storage charges must be paid before the items can be released. 6. Goods left in for sale & then withdrawn by the vendor prior to the sale are liable to a 18% charge on the value estimated by the Auctioneer 7. The goods remain on the premises at the purchaser's risk from the fall of the hammer, & shall be taken with all imperfections, damage or errors of description. Every effort is made to describe each lot correctly, fairly and in an informative way. Usually no reference is made as to the condition of in the catalogue, but this does not imply that it is free of faults or restoration. Interested parties are deemed to have viewed the item{s} which they intend to bid for and to have fully satisfied themselves as to the condition of the same. 8. The purchase money together with 15% Auctioneer's fees and Vat @ 23% on the fees shall be payable immediately after the auction. There is also a 3 % charge on all credit card payments. No lots will be delivered to the purchaser until he/she has made payment in full. Payments may be made in cash, Credit Card, Debit Card, Banker's draft, Credit transfer or guaranteed cheques, No third party cheques 9. Should a purchaser fail to comply with these conditions, he/she may forfeit the deposit & the Auctioneer may re - sell the lot or lots as he deems fit. Any deficiency in the price at the second sale shall be made good by the first purchaser but any surplus shall belong to the vendor. 10. Western Colorado Auctions does not accept responsibility for lots damaged by changes in atmospheric conditions nor shall Western Colorado Auctions be liable for any damage to glass or picture frames 11. Default, Western Colorado Auctions Disclaims responsibility for default by either the purchaser or the vendor because he acts as the agent for the vendor only & therefore does not pay out to the vendor until payment is received from the purchaser. 12. All prospective buyers by making a bid for any of the lots advertised in the catalogue acknowledge that their attention has been drawn to these conditions of sale & that they are bound by them. 13. The Auctioneer may refuse to take any bid without giving any reason. 14. Shipping and P+P can be arranged in house but incurs a fee.
