Description
Having decided to retire from farming, Dan McCullough will sell his Farm Equipment at Public Auction, including online bidding through HiBid.com. Online Pre-Bidding begins at 1:00 PM CST on Sunday Dec 13th, 2020. Public auction begins at 9:30 AM CST on Monday Dec. 28th, 2020. Online Bidding will begin at Approx. 11:00 AM CST (+/- 15 minutes). AUCTION TERMS & CONDITIONS: In order to register and receive access to the online bidding/pre-bidding platform, a Bidder must accept and acknowledge these Terms and Conditions. 1. Payment: Proper ID; Cash; Company, Personal & Cashier's Checks (checks over $5000 must have a bank letter of guarantee); Bank Wire Transfers, Credit Cards (Visa, Master Card & Discover, with a 3% Courtesy Fee). 2. Payment in full must be made within 48 hours after close of the auction in the form Cash, Wire Transfer, Cashier’s Check or a Company Check accompanied with a bank letter of guarantee. 3. A 2.5% Buyers Premium (with $750 cap) will apply per item to all online purchases. 4. The Winning Bidder for the property shall receive an e-mail from Mike Peterson Auctioneers which will detail a date and a time for the retrieval of the personal property, subject to further specific arrangements of the parties. No lots will be picked up until all payments are paid in full. Buyers must have a printed paid in full receipt in order to pick up purchases Pickup Location: Auction Site - 1962 N State Route 1, Watseka, Illinois, 60970 Pickup times are as follows: Monday, Dec. 28th - Day of Auction, 9AM-6PM CST Tuesday, Dec. 29th, 2020 8AM-3PM CST Wednesday, Dec 30th, By Appointment Only Loading will be available through Monday. Load Out Equipment will be Removed Monday Evening! 5. All purchases must be removed from the premises in one week. 6. The Buyer agrees to insure the equipment or item purchased against all losses from the Auction Date until removal of the Equipment by the Buyer. Neither Auctioneer nor Equipmentfacts shall have any responsibility or liability whatsoever for or pertaining to the equipment or item purchased once the Buyer has been determined to be the successful bidder. 7. It is the full responsibility of the Buyer for any shipping arrangements and scheduling must go through the auction company before pick up. 8. Not responsible for accidents or items purchased day of auction. 9. Announcements Sale Day take precedence over all printed material. Not responsible for accidents or misrepresentation. All items are sold AS-IS where is with no exceptions. No warranties or guarantees are expressed or implied by the Auction Company. We do our best to give accurate descriptions and images of the lots, though it is up to the Buyer to determine size and condition of items. An online bid is an obligation to purchase. ABSOLUTELY NO REFUNDS will be given for lots in this Auction, as all sales are final. Lots left on the premises after scheduled days of pickup are considered abandoned and become the property of the Auction Company unless prior arrangements are made. 10. The Auction Company nor the Software Provider will be responsible for any interruption in service, errors, caused by any means including power failures or website outages. This auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void a sale, suspend bidding and re-sell any item/lots that were affected by any malfunction. The decision of the Auctioneer is final as is the case in a live auction. 11. As a Bidder you are responsible for any and all bids placed under your bidding number and password. The security of your Bidder Information is your sole responsibility. 12. Any bid placed shall constitute a legally binding and enforceable offer to purchase the subject lot. All bids therefore constitute an irrevocable offer to purchase and shall remain valid and enforceable until the Seller declares the property "Sold" and the auction has concluded. 13. Auctioneer reserves the right to reject any bid placed. Auctioneer agrees to timely advise any Bidder of a rejected bid. 14. Auctioneer reserves the right to reject any Bidder from access to the interactive online bidding platform. 13. The Winning Bidder covenants and agrees to purchase the subject lot at the price of the Winning Bid, and upon the terms and conditions hereinafter provided. 15. Failure to appear at the appointed date, time, and location by the Winning Bidder, shall be considered an act of default by the Winning Bidder, and the Seller shall be entitled to pursue any and all legal and equitable remedies against the Winning Bidder which are available to Seller pursuant to the laws of the jurisdiction of the State of Illinois. In the event that Seller and/or Auctioneer file suit against Winning Bidder, Seller and/or Auctioneer shall be entitled to recover all reasonable attorneys' fees, costs and expenses incurred. 16. Time shall be of the essence as to all of Buyer's obligations. 17. Not withstanding any term to the contrary all sales and transfers shall be conducted in accordance with Federal, State and Local Laws. 18. By registering for the online bidding/pre-bidding platform, the Bidder acknowledges and understands that he or she is responsible for compliance with all local laws, and the Bidder further represents, covenants and warrants that all registration information is accurate. 19. The Seller, Broker, Auctioneer and their representatives, attorneys, agents, and sub-agents, assume no liability for errors or omissions in this or any other property listing or advertising or promotional/publicity statements and material. The Seller, Broker, Auctioneer and their representatives, attorneys, agents and sub-agents, make no guarantee as to the accuracy of the information herein contained or in any other property listing or advertising or promotional/publicity statements and material. 21. Bidders are personally responsible for any bids made with ther Bidding Number. If the highest bid for any particular lot is submitted using your Bidding Number, you are responsible and liable for any payments due hereunder, without protest, set-off or claim against the Auctioneer or Equipmentfacts LLC ("Equipmentfacts"). 22. The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute the Auctioneer and Equipmentfacts shall have absolute discretion either to settle such dispute as they determine. 23. Neither Auctioneer nor Equipmentfacts shall be liable for any loss or damage howsoever arising (including but not limited to costs of attendance of Bidders at the Auction) from any Lots not presented for sale. 24. You acknowledge and understand that the descriptions of the Lot(s) in the catalogue for each auction are provided by the Vendor(s) or other third parties over whom the Auctioneer and Equipmentfacts have no control, not by the Auctioneer or Equipmentfacts. The Auctioneer and Equipmentfacts shall not be liable for any deficiencies, misstatements, misrepresentations and/or errors in any description(s), oral or printed, and neither the Auctioneer nor Equipmentfacts guarantee or warrant the authenticity, genuineness, origin, age, condition or quality of any Lot(s), and all statements as to these matters whether contained in the catalogue or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact by the Auctioneer or Equipmentfacts. All claims against the Auctioneer and Equipmentfacts, and their respective employees and agents, arising out of or related to any Lot description are hereby waived and forever released. 25. Each and every Lot is sold "as-is, where-is." The Auctioneer and Equipmentfacts provide no guarantees or warranties whatsoever, express or implied, in respect of the equipment contained in or constituting a Lot. All representations made by the Auctioneer and Equipmentfacts, as well as their respective employees or agents, are to be considered lay opinions only and neither the Auctioneer nor Equipmentfacts shall be liable for any purchase made by a Buyer in reliance upon them, and all such claims arising out of or related thereto are hereby waived and forever released. 26. By registering and bidding, the Buyer acknowledges that they have submitted themselves to the personal jurisdiction of the State of Illinois. Buyer acknowledges that any and all disputes shall be governed by Illinois Law, conflicts of laws provisions notwithstanding, and that any and all litigation associated with any purchase and sale hereunder shall be filed in the Twenty-First Judicial Circuit, Iroquois County, Watseka, Illinois. 27. The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth herein.
